ORDINANCE NO. c:!../ /CJ AN ORDINANCE OF THE CITY OF SAN BERNARDINO, CALIFORNIA, ORDERING, CALLING, PROVIDING FOR AND GIVING NOTICE OF A SPECIAL ELECTION TO BE HELD IN THE CITY OF SAN BERNARDINO ON THE 11TH DAY OF JUNE, 1957, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY A PROPOSITION FOR THE ISSUANCE OF SEWER REVENUE BONDS BY SAID CITY. The Mayor and Common Council of the City of San Bernardino DO ORDAIN as follows: Section 1. That a special election be held and the same is hereby called to be held in the City of San Bernardino, California, on Tuesday, the 11th day of June, 1957, for the purpose of submitting to the qualified voters of said city the proposition of issuing sewer revenue bonds pursuant to the Revenue Bond Law of 194i (Chapter 6, Part 1, Division 2, Title 5 of the Government Code of the State of California) in the amount and for the objec~s and purposes hereinafter set forth, including aill"expenses incidental thereto or connected therewith. Section 2. That the purpose for which said bonded indebtedness is to be incurred and revenue bonds issued therefor is as follows: , . . . The acquisition, construction and financing by the City of San Bernardino of additions to and improvements (other than repairs) of the sewage collection, treatment and disposal system of said city, consisting of a new sewage treat- ment plant, trunk, interceptor and out- fall sewers, a sewer ventilating system, pumping stations, effluent reclamation works with pumping stations, pipelines and spreading grounds, and including the acquisition of all land, easements, pipe, pumps, machinery, equipment and other property necessary for any of the fore- going, and including engineering, inspec- tion and legal fees, costs of the issu- ance of the revenue bonds, bond reserve funds and other costs and expenses incidental to or connected with such acquisition, construction and financing. Section 3. That the estimated cost of such acquisition, construction and financing, including engineering, inspection and legal fees, costs of the issuance of the revenue bonds, bond reserve funds, and other costs and expenses incidental to or connected with such acquisition, construction and financing, is $4,900,000. That the principal amount of the bonds proposed to be iSSUed is $4,900,000. That themaximwn rate of interest to be paid on said bonds shall not 2. . . / ...' exceed the maximum rate permitted by law, to wit, six per cent (6%) per annum, payable semiannually, the actual rate or rates of interest on said bonds to be determined at or prior to the time of the sale or sales thereof. Section 4. That if the proposition for the incurring of bonded indebtedness so submitted receives the requisite number of votes, to wit: the votes of a majority of all the voters voting on the proposition, revenue bonds as provided ~erein in not exceeding the principal amount stated in such proposition shall be issued and sold for the purpose Set forth herein. Said bonds are to be revenue bonds payable exclusively from the revenues of the enterprise and are not to be secured by the taxing power of the City of San Bernardino. Section 5. That the enterprise referred to herein is defined to be the entire sewer system (includ- ing all buildings, systems, plants, works, facilities or undertakings used for or useful in the collection, treatment or disposal of sewage and the reclamation of effluent therefrom) of the City of San Bernardino as such system now exists, together with all improve- ments and extensions to said system later constructed or acquired, including the improvements and extensions made with funds derived from the sale of the revenue bonds herein proposed to be issued. Section 6. That the necessary and reasonable 3. . . maintenance and operation costs of the enterprise (which include the reasonable expenses of billing and collec- tion of service charges, management, repair and other expenses necessary to maintain and preserve the sewer system and said works in good repair and working order) shall be paid from the revenues of the enterprise prior to the payment of the principal and interest on the bonds proposed to be issued and sums for other security funds which may be provided. Section 7. That the polls for said election shall be opened at seven o'clock A.M., of the day of said election and shall remain open continuously from said time until seven o'clock P.M., of the same day, when said polls shall be closed, except as provided in Section 5734 of the Elections Code of the State of California. Section 8. That on the ballots to be used at said special election, in addition to any other matter required by law, there shall be printed sub- stantially the following: MARK CROSS (+) ON BALLOT ONLY WITH RUBBER STAMP; NEVER WITH PEN OR PENCIL. (ABSENTEE BALLOTS MAY BE MARKED WITH PEN AND INK OR PENCIL.) - INSTRUCTIONS TO VOTERS To vote on any measure, stamp a cross (+) in the voting square after the word "YES" or after the ,'word "NO". All marks, except the cross (+Y are forbidden. All dis- tinguishing marks or erasures are forbidden and make the ballot void. 4. . . If you wrongly stamp, tear or deface this ballot, return it to the inspector of election and obtain another. On absent voter ballots mark a cross (+) with pen or pencil. : . . . . That in all particulars not herein recited the election shall be conducted as provided by law for other municipal elections in said city. Section 11. That for the purpose of holding said special election there shall be and are hereby established eighty-one (81) voting precincts designated as hereinafter stated. Each such voting precinct shall consist of acol1l5olidation of regular election precincts in the City of San Bernardino (of the numbers herein- after stated) established for the holding of state and county elections, as said regular election precincts exist on the date of adoption of this ordinance. That the. polling places for the respective precincts shall be the places hereinafter designated; and that the persons hereinafter named, being competent and qualified . electors and residents of said city and of their respec- tive voting precincts, are hereby appointed officers of election for their respective voting precincts and they shall hold said election and make return thereof in the manner provided by law. 6. . .
