HomeMy WebLinkAbout2210 . , . . . 1 NOTICE OF ELECTION ORDINAM:E NO 0:.:,;;2/ lJ 2 3 AN ORDINANCE OF THE CITY OF SAN BERNARDINO CAILING A SPECIAL ELECTION TO BE HELD ON THE EIGHTH DAY OF APRIL, 1958, PERTAINING TO THE ANNEXATION OF A 4 DISTRICT CALLED: 5 "ANNEXATION DISTRICT NO. 110" 6 WHEREAS, by resolution, the Mayor and Common Council of the City of San 7 Bernardino declared its intention to call a special election to be held on the 8 eighth day of April, 1958, in certain inhabited territory contiguous to said City 9 proposed to be annexed to said City, for the purpose of submitting to the quali- 10 fied electors residing in said territory the question whether. or not said terri- 11 tory shall be annexed to said City; and 12 WHEREAS, a copy of said resolution was published as required by law; and 13 WHEREAS, at a time not later than the hour set by said resolution for 14 hearing objections to the proposed election no written or oral protests were made 15 by the owners of one-half of the value of the territory proposed to be annexed as 16 shown by the last equalized assessment roll of the property within the territory 17 proposed to be annexed; and 18 WHEREAS, all proceedings have been had in accordance with said resolu- 19 tion and the Annexation Act of 1913, reference thereto hereby being made for fur- 20 ther, particulars; 21 NOW, THEREFORE, the Mayor and Common Council of the City of San Bernar- 22 dino do ordain as follows: 23 SECTION ONE: A special election hereby is called to be held on the 8th 24 day of April, 1958, in the territory hereinafter described and proposed to be 25 annexed to the City of San Bernardino, for the purpose of submitting to the quali- 26 fied electors residing in said territory the question whether or not such terri- 27 tory shall be annexed to, incorporated in, and made a part of said City of San Ber 28 nardino, and whether or not the property in said territory shall, after such annex 29 ation, be subject to taxation, equally with the property within the City of San 30 Bernardino, to pay the entire bonded indebtedness of the City of San Bernardino 31 outstanding at the date of filing of the petition for annexation. 32 Beginning at a point on the present corporate limits of the City w . . 1 2 3 4 5 6 7 8 9 10 11 12 13 of San Bernardino, said point being the intersection of the North line of Foothill Drive and the Northerly prolongation of the West line of Tract No. 5118, as per plat recorded in Book 67 of Maps at page 13, Records of the County Recorder of San Bernardino County; thence Southerly along the Northerly prolongation of the West line of said Tract No. 5118, the West line of said Tract No. 5118 and the West line of Tract No. 5119, as per plat recorded in Book 67 of Maps at page 14, Records of the County Recorder of San Bernardino County, to the Northeast corner afLot 55, Tract No. 4637, as per plat re- corded in Book 58 of Maps at page 84, Records of the County Recorder of San Bernardino County; thence.South<<!dyalong the East line of Lots 55, 56, 57, 58, 59, 60, 61, 62 and 63 of said Tract No. 4637 and the Southerly prolongation of the East line of said Lot 63 to the center line of Eureka Streilt; thence Westerly along the center line of Eureka Street to the Southerly ~olongation of the West line of Lot 64 of said Tract No. 4637; thence Northerly along the Southerly prolongation of the West line of said Lot 64 and the West line of Lots 64, 65, 66, 67, 68, 69, 70, 11 and 72 of said Tract No. 4637 to the Northwest corner of said Lot 72; thence Northerly and parallel to the West line of said Tracts No. 5119 and 5118 and parallel to the Northerly prolongation of the West line of Tract No. 5118 to a point on the North line of Foothill Drive, said point being on the present corporate limits of the City of San Bernardino; thence Easterly along the North line of Foothill Drive, being along the present corporate limits of the City of San Bernardino, to the point of beginning. 14 15 16 17 18 SECrION TWO: TIME OF OPENING AND CLOSING OF POLLS. The polls at said election shall be opened at 7 o'clock A.M. of the day herein fixed for the holding of said election and shall be kept open until 7 o'clock P.M. of the same day, when the polls shall be closed. SECrION THREE: BALLOTS. Upon the ballots to be used at said election 19 there shall be printed the words: 20 SHALL ANNEXATION DISTRICT NO. 110 BE ANNEXED TO, INCORPORATED IN AND 21 MADE A PART OF THE CITY OF SAN BERNARDINO AND THE PROPERTY IN SUCH TERRITORY BE, 22 AFTER SUCH ANNEXATION, SUBJECT TO TAXATION EQUALLY WITH THE PROPERTY WITHIN THE 23 CITY OF SAN BERNARDINO, TO PAY ITS PRO-RATA PORTION, BASED UPON ASSESSED VALUATION 24 OF ALL BONDED INDEBTEDNESS OF THE CITY OF SAN BERNARDINO Ol1rSTANDING AT THE DATE 25 OF THE FILING OF THE PKl'ITION FOR ANNEXATION? 26 Opposite these words there shall be printed the words "Yes" and "No", 27 and to the right of each of these last two words there shall be a voting square. 28 If an elector shall stamp a cross (+) in the voting square after the printed word 29 "Yes" the vote of such elector shall be counted in favor of the annexation of said 30 territory to the City of San Bernardino, and if an elector shall stamp a cross ~) 31 in the voting square after the printed word "No" the vote of such elector shall be 32 counted against such annexation. - 2 - , " . . 1 In all particulars not herein recited said election shall be held in con 2 formity, as near as may be, with the laws of the State of California concerning 3 general elections and with said Annexation Act of 1913. 4 SECTION FOUR: For purpose of said election there hereby is established 5 in the territory described herein one (1) voting precinct, which shall include all 6 of said territory. The following is the polling place of said election precinct 7 and the following named persons hereby are named officers of election and shall 8 constitute the board of election for such election precinct: 9 Polling Place- Garage - Mrs. Helen Weber 5539 Bonnie Street, San Bernardino 10 11 12 Inspect or - Mrs. Helen Weber 5539 Bonnie Street, San Bernardino Judge - Norine Druse 5519 Bonnie Street, San Bernardino 13 14 15 16 Judge - Dorothy Kenney 5590 Bonnie Street, San Bernardino SECTION FIVE: This ordinance shall take effect upon its publication. SECTION SIX: The City Clerk shall certify to the passage and adoption 17 of this ordinance by the Council of the City of San Bernardino and shall cause the 18 same to be published three consecutive days in the San Bernardino Evening Telegram, 19 a daily newspaper of general ,circulation printed and published within the City of 20 San Bernardino, and once a week for four (4) weeks prior to the date of the elec- 21 tion in the Colton Daily Courier, a newspaper of general circulation printed and 22 published outside of the City of San Bernardino but in the County of San Bernardin< 23 California, which said ordinance shall be preceded by the words "Notice of Election' 24 and that due publication of this ordinance as herein provided is hereby determined 25 to be sufficient notice of said election, and the only notice that shall be re- 26 qui red to be given. 27 I HEREBY CERTIFY that the foregoing'ordinance was duly passed and adopted 28 by the Mayor and Common Council of the City of,.~ Bernardino at an adjourned regu- 29 lar meeting thereof held on the~ day o~/'i<<:#r' 1958, by the follow- 30 ing vote, to-wit: / ,A d'/.I.-I-)ttp'~d ,&i.:V 31 AYES: Councilmen >f.4.-L/~ tl 'f1-t4J. ~;a-u; ~ , '. / ' 32 NOES: /,zI1,~ 'ABSENT:' ,~-L< ~;:~ ~ /7;// /' ,~. ,;. ~- if City Clerk - 3- ..., .. )... . . 1 2 1958.
