ORDINANCE NO.~-?~~
2 AN ORDINANCE OF THE CITY OF SAN ~ERNARDINO PROHIBITING THE
POSSESSION OF OBSCENE PICTURES, BOOKS AND FILM.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
4 DO ORDAIN AS FOLLOWS:

SECTION ONE: It is unlawful for any person to have in his
6 possession any obscene or indecent writing, book, pamphlet, pic-
7 ture, print, negative, photograph, drawing, engraving, mold, cut,
6 cast, figure, motion picture film, phonograph recording, wire
9 recording or transcription of any kind in any of the following
10 places:

1. In any school, school-grounds, public park or play-
12 ground or in any public place, grounds, street or way within
13 300 yards of any school, park or playground;
14
2. In any place of business where ice-cream, soft drinks,
15 candy, food, school supplies, magazines, books, pamphlets, papers,
16 pictures or postcards are sold or kept for sale;

3. In any toilet or restroom open to the public;
4. In any poolroom or billiard parlor, or in any place
19 where alcoholic liquor is sold or offered for sale to the public;

5. In any place where phonograph records, photographs,
21 motion pictures, or transcriptions of any kind are made, used,
22 maintained, sold or exhibited.

SECTION TWO: INDECENT MOTION PICTURES.
1. No person shall show, exhibit, display, rent, sell,
25 lend or give to any person, any motion picture or the projection
26 of any picture, which pictures, illustrates or depicts any ob-
27 scene, immoral, indecent, lewd or lascivious act or acts.

2. No person shall knowingly and wilfully view or remain
29 present where any motion picture, illustrating or depicting any
30 obscene, immoral, indecent, lewd, or lascivious act or acts is
31 being shown, exhibited or displayed.

3. Any person authorized or enjoined to arrest any person

1 for the violation of subsection "1" of this section is equally
2 authorized and enjoined to seize any motion picture or film,
3 the exhibition and display of which is by this section prohibited,
4 in the possession or under the control of the person so arrested,
5 and deliver the same to the magis~rate before whom the person
6 so arrested is required to be taken.'

SECTION THREE: The Mayor and Common CounciL hereby
8 declare that their purpose in passing this ordinance is to
9 supplement the California Penal Code, Section 311.
SECTION FOUR: This ordinance is necessary to safeguard
public morals and shall take effect immediately upon its passage
and adoption.
