HomeMy WebLinkAbout2229 .' . . r.?1, C/,; 1 ORDINANCE NO. ...';l=<.2;? , . 2 AN ORDINANCE REGULATING OUTDOOR ADVERTISING STRUCTURES AND SIGNS LOCATED ADJACENT TO FREEWAYS WITHIN THE CITY OF SAN BERNAR- :5 DINO. 4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO 5 DO ORDAIN AS FOLLOWS: 6 7 SECTION ONE: DEFINITIONS: 1. "Advertising structure" means any structure of any 8 kind or character erected or maintained for outdoor advertising 9 purposes, upon which any poster, bill, printing,painting or 10 other advertisement of any kind whatsoever may b~ placed, 11 including statuary, for advertising purposes. 12 ':'Advertising structure" does not include: 13 14 15 16 17 18 HI 1 20 I a. "Advertising display" means advertising structures and signs. 4. "Freeway" means a highway in respect to which the owners of abutting lands have no right or easement of access to or from their abutting lands or in respect to which such owners have only limited or restricted right or easement of access, and which is declared to be such in compliance with the Streets and Highways Code of the State of California. 5. "Landscaped freeway" means a sectiop or sections of a freeway which is now, or hereafter may be, improved by the planting of at least on one side of the freeway right of way of lawns, trees, shrubs, flowers or other ornamental vegetation which shall require reasonable maintenance. Planting for the purpose of soil erosion control, traffic safety requirements, reduction of fire hazards, or traffic noise abatement, shall not change the character of a freeway to a landscaped freeway. SECTION TWO: It is unlawful to place or maintain any advertising structure, sign or display on property adjacent to a section of freeway which has been or hereafter may be land- scaped as defined herein if the advertising display is designed to be viewed primarily by persons traveling on such landscaped section of a freeway. SECTION THREE: Any advertising structure, sign or display which is now, or hereafter may be in violation of the provisions of Section Two hereof, shall be removed within one hundred eighty (180) days from the date when the contract for the landscaping of the particular section or sections of a freeway shall have been signed. SECTION FOUR: The provisions of Section Two hereof shall -2- .- .. . . 1 2 S , 5 not apply to any advertising structure or sign if the same is used exclusively as follows: 1. To advertise the sale or lease of the property upon which such advertising display is placed. 2. To designate the name of the owner or occupant of the 6 premises upon which such advertising display is placed or to 7 identify such premises. 8 3. To advertise goods manufactured, produced, or sold, or 9 services rendered, on the property upon which such advertising 10 display is placed. 11 12 IS 14 15 16 17 18 19 SECTION FIVE: PENAL PROVISIONS. Any person violating any of the provisions of this ordenance shall be deemed guilty of a misdemeanor, and upon conviction thereof, shall be punished by fine not to exceed $300.00, or by im," '.sonment in the County Jail not to exceed 90 days, or by both such fine and imprisonment at the discretion of the Court. SECTION SIX: EFFECT OF ORDINANCE. If any section, sub- section, sentence, clause or phrase of this ordinance is for any reason held to be unconstitutional, such decision shall not affect , 20 the validity of the remaining portions hereof. The Council hereby 21 22 2S 24 25 26 27 , 28 29 :50 31 32 declares that it would have passed the ordinance and each section, subsection, clause or phrase hereof, irrespective of the fact that anyone or more sections, subsections, clauses or phrases are unconstitutional. SECTION SEVEN: REPEAL. All ordinances or parts of ordi- nances in conflict with or inconsistent with the provisions of this ordinance are hereby repealed.
