HomeMy WebLinkAbout2234 . ~.- . . . . 1 ORDINANCE NO ..-e?-2~rl. 2 AN ORDINANCE PROVIDING FOR THE PROTECTION OF THE PUBLIC HEALTH AND SAFETY, AND THE EXAMINATION, REGISTRATION, LICENSING 3 OF PERSONS ENGAGED IN THE BUSINESS OF PLUMBING, OR LABORING AT THE TRADE OF PLUMBING, GAS AND DRAINAGE SYSTEMS; CREATING A BOARD 4 OF PLUMBING EXAMINERS AND PRESCRIBING THEIR DUTIES AND THE DUTIES OF THE PLUMBING INSPECTOR; DEFINING CERTAIN TERMS, ESTABLISHING 5 MINIMUM REGULATIONS FOR THE INSTALLATION, ALTERATION OR REPAIR OF PLUMBING, GAS AND DRAINAGE SYSTEMS AND INSPECTION THEREOF; 6 PROVIDING PENALTIES FOR ITS VIOLATION, AND REPEALING ORDINANCE NO. 2065, AND ALL OTHER CONFLICTING ORDINANCES. 7 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO 8 DO ORDAIN AS FOLLOWS: 9 SECTION ONE: AGoption by Reference - That the rules and 10 regulations providing for and governing the installation of 11 plumbing, and the carrying on of the business of plumbing, as set 12 forth in the plumbing code printed in book form, entitled 13 "Uniform Plumbing Code ," 1958 Edition, said code being prepared 14 by the Western Plumbing Officials Association, three (3) copies 15 of which code have heretofore been filed with and are now on 16 file in the office of the City Clerk of the City of San Bernardino, 17 and which plumbing codes are identified by the certificate attached 18 thereto of the City Clerk of said City, reading as follows: 19 "I, JACK T. City Clerk of the City of San Bernardino," the City of , 1958. 25 be and the same are hereby established as rules and regulations 26 providing for and governing the installation of plumbing, and the 27 carrying on of the business of plumbing in said City; and each 28 and every part of said code, and each and every provision therein 29 contained, except as herein specifically mentioned, is hereby 30 referred to and is hereby adopted and made a part hereof as though 31 fully set forth in this Ordinance, and the provisions of said 32 code are hereby established as rules and regulations providing -1- . . 1 for and governing the installation of plumbing, and the carrying 2 on of the business of plumbing in said City. 3 SECTION TWO: Exceptions. The following Sections of said 4 code are hereby amended to read as follows: 5 1.1 ADMINISTRATIVE AUTHORITY AND ASSISTANTS. Whenever the 6 term "administrative authority" is used in this code it shall be 7 construed to mean the Chief Plumbing Inspector or his authorized 8 representative. ~ 1. 2 ASSISTANTS. Whenever the term "assistants" is used 10 in this code it shall be construed to mean the Plumbing Inspectors. 11 1.2(a) QUALIFICATIONS. All inspectors shall be practical 12 plumbers having not less than two (2) years experience as journey- 13 man plumbers. 14 1.3 DEPARTMENT HAVING JURISDICTION. Unless otherwise pro- 15 vided for by law, the office of the Administrative Authority shall 16 be part of the Building Inspection Department. 17 1. 7 VIOLATIONS AND PENALTIES. Any person, firm or corpor- 18 ation violating any of the provisions of this code shall be deemed l~ guilty of a misdemeanor and upon conviction thereof shall be pun- 20 ishable by a fine of not to exceed Three Hundred Dollars ($-300.00) 21 or by imprisonment in the City Jail fo.r not to exceed three (3) 22 months, or by both such fine and imprisonment. !ach separate day 23 or any portion thereof during which any violation of this code 24 occurs or continues shall be deemed to constitute a separate 25 offense, and upon conviction thereof shall be punishable as 26 herein provided. 27 The issuance or granting of a permit or approval of plans 28 and specifications shall not be deemed or construed to be a permit 29 for, or an approval of, any violation of any of the provisions 30 of this code. No.permit presuming to give authority to violate 31 or cancel the provisions of this code shall be valid, except 32 insofar as the work or use which it authorizes is lawful. -2- 1 2 :5 4. 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 :50 31 32 ~ ," " . . The issuance or granting of a permit or approval of plans shall not prevent the Administrative Authority from thereafter requiring the correction of errors in said plans and specifica- tions or from preventing construction operations being carried on thereunder when in violation of this code or of any other ordinance or from revoking any Certificate or Approval when issued in error. Every permit issued by the Administrative Authority under the provisions of this code shall expire by limitation and become null and void, if the work authorized by such permit is not com- menced within sixty (60) days from the date of. issuance of such permit, or if the work authorized by such permit is suspended or abandoned at any time after the work is commenced for a period of sixty (60) days. Before such work can be recommenced a new permit shall be first obtained so to do. 2.4 APPOINTMENT OF BOARD OF EXAMINERS. The Board of Plumber Examiners shall be under the Department having juris- diction provided for by law or the charter provisions and unless otherwise provided for shall consist of five (5) members having thereon no less than two (2) qualified Plumbing Contractors and no less than two (2) qualified Journeyman Plumbers and one member of the Plumbing Department to act as secretary. The Board shall be appointed by the authority empowered to appoint such boards upon the taking effect of this Code. The members of said Board shall serve for two (2) years, unless sooner removed for malfeasance in office, neglect of duty of incapacity. 2.6 APPLICATION FEE. Every person applying for a Plumber's Certificate of Qualification or Registration shall pay to the secretary of the Board of Plumber Examiners at the time he makes such application the following fees: (a) Journeyman Plumber's Certificate. . . . . . . $3.50 2.9 EXPIRATION OF CERTIFICATES OF QUALIFICATION OR -3- " . ~ .. 1 2 3 4. 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 . . REGISTRATION. Every Certificate of Qualification or Registration shall remain in force and effect until its expiration date unless cancelled or revoked. <a) Journeyman Plumber's Certificate of Qualification or Registration shall expire on December 31st of each year. 2.10 FEES FOR RENEWAL OF CERTIFICATES OF QUALIFICATION OR REGISTRATION. All Plumber Certificates of Qualification, except Certificates which have been cancelled or revoked, may be renewed from year to year upon request and payment of the required renewal fee. If a renewal of a Certificate by requested and the required fee paid within 30 days of the expiration date of such Certificate, the renewal fee shall be $l.OQ. If such renewal be requested and the required fee paid more than 30 days, but less than 90 days after the expiration date of such Certificate, the renewal fee shall be $2.00. If such renewal be requested and the required fee paid more than 90 days after the expiration date of such Certificate, the fee shall be $3.50 and the Board of Plumber Examiners may require the applicant to make out a new application and take an examination, or the B~dmay at its discretion renew the expired Certificate. SECTION THREE: Exceptions. The said Plumbing Code is hereby amended by adding thereto a new section entitled Section 1.15, reading as follows: 1.15 LIABILITY OF CITY OFFICIAL OR EMPLOYEE. Neither this Ordinance nor the said Uniform Plumbing Code shall be con- strued as imposing upon the City of San Bernardino any liability or responsibility for damage from defective plumbing or drainage system, or the installation thereof, nor shall the City of San Bernardino, or any official or employee thereof be held as assuming any such liability or responsibility by reason of the inspection authorized thereunder. SECTION FOUR: Exception. The said Plumbing Code is -4- i I I I I i i I I , .. , . " ~ . . .. . . 1 hereby amended by adding thereto a new section entitled Section 2 1010, reading as follows: 3 1010. No person shall advertise, sell or offer for use or 4 sale, any water-treating chemical or substance, water-using or 5 water-treating chemical or substance, water-using or water- 6 operated equipment, mechanism or contrivance, if the Health 7 Officer finds that the use of such chemical ot substance equip- S ment, mechanism or contrivance may cause contamination or pollution 9 of the domestic water system. Such devices may be permitted when 10 equipped with back-flow protection meeting the requirements of 11 the Uniform Plumbing Code. 12 SECTION FIVE: The said Plumbing Code is hereby amended 13 by adding thereto a new section entitled Section 410, reading 14 as follows: 15 410. HOUSE DRAINS SHALL CONNECT TO ONE OUTLET. In a 16 single family dwelling all plumbing drains shall connect to one 17 outlet. Such outlet shall not exceed ninety (900) degrees from 18 the direction of the closest public sewer or if there is no 19 public sewer then from the proposed public sewer. If more than 20 one stub-out is used, the contractor installing the plumbing 21 shall connect all such stub-outs to each other so that there 22 shall be one outlet. The materials used shall be as required 23 elsewhere in this code. 24 SECTION SIX: VALIDITY OF ORDINANCE. If any section, 25 subsection, sentence, clause or phrase of this Ordinance is for 26 any reason held to be unconstitutional, such decision shall not 27 affect the validity of the remaining portions of this Ordinance. 28 The Council of the City of San Bernardino hereby declares 29 it would have passed this Ordinance and each section, sub-section, 30 clause or phrase thereof irrespective of the fact that anyone or 31 more sections, sub-sections, clauses or phrases be declared 32 illegal. -5- . , . ," . . 1 SECTION SEVEN: REVOCATION. The Mayor and COlIIDon Council 2 of the City of San Bernardino shall have the power, upon recom- ~ mendation of the plumbing inspector, to suspend or revoke the 1icens 4 of any person violating the terms and provisions of said plumbing 5 code, provided that such suspension or revocation shall not be 6 ordered by said Mayor and Common Council without first holding 7 a public hearing thereof and without giving reasonable notice of 8 such hearing to the person, firm or corporation so charged with 9 said violation. 10 SECTION EIGHT: REPEAL OF CONFLICTING ORDINANCES. 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29> ~O 31 32 Ordinance No. 2065 and all other Ordinances of the City of San Bernardino in conflict herewith are hereby repealed.
