" , . 1 2 3 4 5 6 ORDINANCE NO~..2:2.j-r AN ORDINANCE AMENDING ORDINANCE NO. 1991 OF THE CITY OF SAN BERNARDINO, KNOWN AS THE LAND USE ZONING ORDINANCE, BY AMENDING THE SECTIONS RELATING TO YARDS. THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: SECTION ONE: That Ordinance No. 1991, Section Two, 7 Sub-section 2.2, the definition of "GARAGE, PRIVATE", is hereby 8 amended to read as follows: 9 GARAGE, PRIVATE shall mean a detached accessory building 10 or an accessory building attached to the main building on the 11 same lot as a dwelling for the housing o.f vehicles of the 12 occupants of ~he dwelling, including covered parking spaces 13 or carports. 14 SECTION TWO: That Ordinance No. 1991, Section Four, 15 Sub-section 4.2~D-2-a, is hereby amended to read as follows: 16 a. There shall be a side yard of not less than ten (10) 17 percent of the width of the lot, but need not exceed five (5) 18 feet nor may it be less .than three (3) feet. 19 21 20 Sub-section 5.2-D-2, is hereby amended to read as follows: SECTION THREE: That Ordinance No. 1991, Section Five, 2. SIDE - There shall be a side yard of not less than 22 ten (10) percent of the width of the lot, but need not exceed 23 five (5) feet nor may it be less than three (3) feet. In the 24 case of two single family dwellings on the same lot, side by 25 side, the side yard between buildings may not be less than ten 26 27 28 29 30 (10) feet. For corner and reversed corner lot see Section 4.2-D-3. Where a building has its rear to a side lot line the side yard to the rear shall be not less than five (5 ) feet; the side yard in fropt of the building, fifteel1 (15 ) feet. SECTION FOUR: That Ordinance No. 1991. Section Six, 31 Sub-section 6.2-D-2, is hereby amended to read as follows: 32 2. Where a 3 building has its rear to a side yard to the rear shall be not 4 less than five (5) feet, the side yard in front of the building, 5 fifteen (15) feet. 6 SECTION FIVE: That Ordinance No. 1991, Section Seven, 7 Sub-section 7.2-0-2, is hereby amended to read as follows: 8 2. SlOE - Every lot shall have a side yard of not less 9 than five (5) feet. Said side yard shall be increased two 10 and one-half (2\) feet in width for every story above the 11 second story. See Section 4.2-0-2 for side yards on corner lots 12 and reversed corner lots. Where a building has its rear to a 13 side lot line the side yard to the rear shall be not less than 14 five (5) feet, the. side yard in front of the building, fifteen 15 (15) feet. 16 SECTION SIX: That Ordinance No. 1991, Section Twenty, 17 Sub-section 20.7-A, is hereby amended to read as follows: 18 A. RESIDENTIAL DISTRICT - There shall be at least one (1) 19 and not more than three (3) parking spaces in a garage or covered 20 parking place in a carport for every dwelling unit. Those 21 parking spaces shall be on the same lot with the main building 22 or on a lot contiguous to and permanently available for such 23 parking facilities. Such parking spaces shall be located to 24 the rear of the front setback line, except in mountain areas 25 or hillside lots where garages or carports may be located in the 26 front yard when approved by the Commission. 27 Where a private garage or accessory building is located 28 on the rear of the lot and has its access to an alley, it shall 29 be not less than fifteen (15) feet from the center line of said 30 alley. Where a detached garage is located other than on the 31 front yard of a lot and has access to the street on the front 32 by means of a driveway located on the same lot with the garage, -2- --\." .... ~> ", . . 1 said garage shall be located not closer than three (3) ,feet from 2 the side and/or rear property lines of the lot. No garage entry 3 may be closer than eighteen (18) feet from any street except in 4 mountainous areas. This paragraph is subject to and is modified 5 by Section Four, Sub-section 4.2-D-3-b. 6 SECTION SEVEN: That Ordinance No. 1991, Section Twenty-One, 7 Sub-section 2l.4-A is hereby amended to read as follows: 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 A. A covered driveway may be permitted in a side yarQ provided that the structure is not more than one (1) story in height, twenty (20) feet in length and is entirely open on three (3) sides except for the supporting columns and customary archi- tectural features.
