AN ORDINANCE REGULATING THE USE OF CITY SUPPLIED
WATER BY AIR CONDITIONING AND REFRIGERATION SYSTEMS AND
REQUIRING WATER CONSERVATION DEVICE EQUIPMENT FOR SUCH
SYSTEMS .

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
5 BERNARDINO DO ORDAIN AS FOLLOWS:
6 SECTION ONE: DEFINITIONS: For the purpose of this Ordinance
7 the following terms shall have, and shall be construed to have the following
8 meanings:
9 1. The terms "Air Conditioning System" and "Refrigeration
10 System" shall include any combination of equipment, whether compressor
11 or other type, by which heat is removed from the air and from which
12 the accumulated or affluent heat is wholly or partially removed by the
13 use of water.
14 2. "Air Conditioning System" shall mean an installation for
15 maintenance by heat removal of temperatures which are not less than 50
16 degrees Fahrenheit.
17 3. "System" shall mean any combination of apparatus or indivi-
18 dual unit supplied with water through any single customer service pipe
19 connected to the public water system.
20 4. "Person" shall mean and Include a natural person, partnership
21 corporation or association. Whenever used with respect to any penalty the
22 term "person" as applied to, parmership or associations, shall mean the
23 partners or members thereof, and as applied to corporations, the officers
24 thereof.
25 5. 'Department" shall mean the Building Inspection Department.
26 SECTION TWO: APPLICATION FOR INSPECTION REQUIRED:
27 An application for inspection shall be required before the installa-
28 tion, operation or use of any equipment for airconditioning or refrigeration
29 which, when in conjunction with all other equipment in the same system,
30 constitute~ a total system capacity of greater than 1-1/2 tons /24 hours,
31 and which requires a supply of water from the public water system.
32 SECTION THREE: APPLICATION FOR INSPECTION:

1 1. Every application for inspection shall be made to the Department
2 on a form provided by that Department and shall be signed by the applicant
3 who is either the owner or lessee of the premises, or the duly licensed
4 contractor authorized to perform the work. The application shall provide
5 the folloWing information:
6 a. Name and address of the applicant.
7 b. Location of the premises where installation is proposed.
8 c. Name and address of the owners of the premises.
9 d. Names of mahufacturers of the units requiring water.
10 e. Manufacturer's identification and classification of the
11 refrigeration units.
12 f. Manufacturer's rating of maximum refrigerative capacity
13 of the unit or units under the conditions of the planned
14 installation. (Rating may be stated in tons per 24 hours
15 or in BTU per hour).
16 g. Horsepower of compressor prime mover, if unit is of
17 compressor type.
18 h. Where water conservation devices are required ( to comply
19 with Section Six hereof), the manufacturer's name, identifl-
20 cation,classification and size of the conservation equipment.
21 1. Elevation and plan showing general piping arrangement and
22 details of all points of connection to building supply water
23 piping. (Piping direct to condenser units, make-up supply
24 into tower pan and so forth).
25 j. Such additional information as shall be required by the Depart-
26 ment.
27 2. For the purposes of this Ordinance, in no event shall the
28 rated capacity in tons be considered less than the following:
29 a. Total maximum BTU per hour of capacity of the installation
30 divided by 12,000, or
31 b.. The nameplate horsepower of any compressor prime mover
32 unit, for any air conditioning inStallation; or

c. Two thirds of the nameplate horsepower of (2) above, for any
.
2 refrigeration installation.
3 3. In the absence of the required manufacturer's maximum rating
4 l(f) above, the Depart ment may specify the tonnage of the installation at
5 the ratings indicated by a, b, or c of sub-section "2" of this section; or,
6 if these appear inadequate, then by whatever other measure of capacity
7 appears to him to be proper.
8 SECTION FOUR: FEE FOR APPLICATION FOR INSPECTION.
9 A fee shall be paid, at the time of application for inspectiQn,
10 tQ cover one inspection of the installation. The fee shall be $2.00 plus
11 25q; per ton of capacity. For each additiOnal inspectiQn required because
12 of condemnation of work, or because of premature request fQr inspection,
13 an additional charge shall be made, equal to seventy-five per cent Qf the
14 original fee.

SECTION FIVE: COOLING TOWERS: GENERAL:
1. Every cooling tower shall comply with the requirements fQr
roof structures as set forth in the Uniform Building Code.
Exception: Cooling towers Qn buildings outside of any fire
district may be cQnstucted Qf wood.
2. Cooling towers, when used in connection with water-cooled
condensing units, shall be equipped with a positive bleed tQ prevent ex-
cessive build-up of alkalinity and algae. Disposal of bleed-Qff water shall
be into a sanitary sewer system in a manner complying with the Uniform
Plumbi~ Code.
3. All water supply and waste water piping and connections shall
comply with prQvisions of the Uniform Plumbing CQde.
SECTION SIX: All systems having total capacities exceeding
1-1/2 tons for twenty-four hours shall be equipped with evaporative condens-
ors, cooling towers, spray ponds or other approved water conservation
equipment.
SECTION SEVEN: Every evaporative cooler shall be prQvided
with a circulating pump.

1 SECTION EIGHT: All portions of the water pump motor in or
2 attached to any evaporative cooler shall be not less than four inches (4 ")
3 from any filter or evaporative pad or separated therefrom by means of a
4 suitable corrosion resistive metal shield.
5 SECTION NINE: EFFECTIVE DATE:
6 1. For new installations these regulations shall be effective upon
7 the effective date of this Ordinance.
8 2. Existing installations shall be modified to conform to the
9 provisions of these regulations. Modifications shall be completed in
10 accordance with the provisions of this paragraph within two (2) months
11 after the effective date of this Ordinance. In the event that a critical
12 condition develops in the public water supply system, fifteen days after
13 adoption, all installations not equipped to conserve water shall be subject
14 to immediate discontinuance on orders of the Department.
15 SECTION TEN,,: PENAL TIES:
16 1. Failure to comply with the provisions of this Ordinance shall
17 be sufficient cause for discontinuance of service of water and electricity
18 for the operation of the apparatus or equipment.
19 2. Any person who shall install, replace, operate or use any
20 equipment or apparatus without first making an application for inspection
21 required by this Ordinance is guilty of a misdemeanor.
22 SECTION ELEVEN: Inconsistent Ordinances or parts of
23 Ordinances heretofore in effect which are in conflict with, or which are
24 inconsistent with, the provisions of this Ordinance, to the extent of their
25 inconsistency are hereby repealed.
26 SECTION TWELVE: SEPARABILITY:
27 The invalidity of any section, clause, sentence or provision of this
28 Ordinance shall not affect the validity of any other part thereof which can
29 be given effect without such invalid part or parts.
30 SECTION THIRTEEN: Because of the urgent necessity for water
31 conservation this ordinance is necessary to safeguard the public health and
32 safety and shall take effect immediately upon its passage and adoption.
