2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO, AfPROVING THE ANNEXATION OF DISTRICT NO. 119.

WHEREAS, heretofore a petition was filed with the Common Council of

the City of San Bernardino requesting that certain uninhabited territory
5
6
contiguous to said City be annexed to the City of San Bernardino and which
said petition described said territory and the boundaries thereof proposed to
7
be annexed to the City; and
8 I.
WHEREAS, said petition was filed by the owners of not less than one-
9
fourth of the area of land in such territory and representing not less than
one-fourth of the assessed value of such. territory according to the last pre..
cedi ng equali2:ed assessment roll of the County of San Bernardino, in which
.
said County the City of San Bernardino is situated; and
WHEREAS, the said petition requested the said territory to be
.
annexed to and included in the said municipal corporation, in accordance wi th
the provisions of the Government Code, Section 35300, et seq., and
WHEREAS, on the 23rd day of March, 1959, a Resolution was adopted by
the aforesaid Common Council of the City of San Bernardinp, California, pro-
posing the annexation of the aforesaid uninhabited territory to be generally
known as the ANNEXATION DISTRICT NO. 119 to the City of Sa~Bernardino, and
that said Resolution provided therein that the proposed annexation should be
generally known and identified as ANNEXATION DISTRICT NO. 119; and
WHEREAS, said Resolution set forth therein that all the property
included in the aforesaid territory should be taxed equally with the other
property within the said City to pay the bonded indebtedness, and any and all
general indebtedness and liability of the City of San Bernardino, contracted
prior to or existing or outsta~ding at the time of the aforesaid proposed
annexation of the aforesaid property, as provided in the hereinbefore mentioned
GOvernment Code; and
WHEREAS, the said Resolution did fix, determine and declare that a
hearing be held on the 4th day of May, 1959, at the hour of 7.30 o'clock P.M"
in the Council Chambers of the City Hall in the. City of San Bernardino, and

the same was the day, hour and place designated where any person owning real
estate within such territory so proposed to be annexed and having any ob-
jection to the proposed annexation might object before the Common Council and
show cause why such territory should not be annexed, and furthermore, the said
Resolution provided that at any time not later than the said hour set, as
mentioned hereinbefore for the said hearing, any owner of property within the
said territory proposed to be annexed might file written protest with the City
of San Bernardino against such annexation; and
WHEREAS, no objections or protests of any kind or nature whatsoever
were made or filed,ei ther written or oral, with the said Ci ty of San Bernar-
dino, and no protests or objections of any nature whatsoever were made, either
written or oral, at the meeting of the Common Council on the 4th day of
May, 1959, as mentioned hereinbefore, .at which said meeting the said Common
Council publicly announced that any person, firm or corporation desiring to
protest or obj ect to said annexation might do so at said meeting; and.
WHEREAS, it appears to the Common Council of the Ci ty of San Bernar-
dinothat the aforesaid annexation, proceedings have been completed and every-
thing performed at ihis time, in accordance with .said Government Code, and
mentioned hereinbefore, 811d any and all other 1a~s in any way connected with
the said annexation procedure, having been compli'ed wi th; and
WHEREAS, the Common Council of the City of San Bernardino desire to
approve at this time the annexat,ion of the aforesaid territory,
NOW, THEREFORE, llIECOMMONCOUNCH.OF mE CITY OF SAN BERNARDINO
DOES HffimY ORDAIN AS FOLLOWS:
SECTION ONE: That said territory as herein described as Annexation
District No. 119 is hereby annexed and incorporated in and made a part of the
City of San Bernardino.
SECTION TWO: The territory herein referred to as being annexed to
the City of San Bernardino is particularly described as follows,to Wit:
All that p9rtion of Lots 5, 6. and 31 of the Mount Vernon
Orange Grove and Fruit Company' 5 Lands, as per plat thereof
recorded in Book 12 of Maps, page 16, records of the County
Recorder of San Bernardino County, described as follows:.

Beginning at a point on the present corporate limits of
the City of San Bernardino, said point being on the
South line of 19th Street, 150 feet West of the West
line of Muscott Street; thence Southerly and parallel
with the West line of said Muscott Street. being along
the present corporate limits of the City of San Bernar~
dino a distance of 303.00 feet; thence Westerly and
parallel with the South line of said 19th Street to a
point 118.81 feet Westerly of the West line of said
Muscott Street; thence Northerly and parallel with the
West line of said Muscott Street toa point on the South
line of said 19th Street, silid point being on the present
corporate limits of the City of San Bernardino; thence
Easterly along the South line of said 19th Street, being
along the present corporate limits of the City of San
Bernardino. to the point of beginning.

SECTION THREE: That the above described property. will be subject
to taxation equally with the property within such municipal corporation., to,
pay its proportion of the following bonded indebtedness of the City of San
Bernardino, which said bonded indebtedness was outstanding at the time of
filing said petition or theretofore authorized, and is outstanding at the
time of said annexation, to wit:
A bonded indebtedness of $200,000,00 incurred for the construction
and completion of a convention hall, the outstanding indebtedness thereon
being $15,000.00, bearing interest at the rate of 5% per annum;
A bonded indebtedness of $215,000.00 incurred for the acquisition
and construction of water works, including "Devil Canyon Water Works", water
rights, rights of way, pipe lines, wells and pumping plants, the outstanding
indebtedness thereon being $41,250.00, bearing interest at the rate of 5%
per annum;
A bonded indebtedness of $490,000.00 incurred for the acquisition
and construction of a public library, including additions to and enlargements
of the public library system of said City, the outstanding indebtedness
thereon being $490,000.00, bearing interest at the rates of 4-3/4j~, 3-1/4%
and 3-1/2% per annum.
SECTION FOUR: The property herein annexed is declared to be apart
of Ward 5, and the boundaries of Ward 5 are hereby altered to include said
annexed territory; and said property is placed and declared to be in R-l
Single Family Residential Zone.

SECTION FIVE: The City Clerk shall certify to the passage of this

Ordinance and shall cause the same to be published three consecutive times in

the San Bernardino Evening Telegram, a daily newspaper designated for that
purpose.
