HomeMy WebLinkAbout2269 . . . 1 ORDINANCE NO.~~~~ 2 AN ORDINANCE OF TIlE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO ~~END1NG ORDINANCE NO. 763, ENTITLED, "AN ORDINANCE PROVIDING FOR 3 THE LICENSING OF BUSINESS, SHOWS, EXHIBITIONS AND GAMES CONDUCTED OR CARRIED ON IN THE CITY OF SAN BERNARDINO, FIXING THE RATE OF LICENSE THEREFOR AND 4 PROVIDING FOR COLLECTION THEREOF", AND REPEAUNG SECTIONS FIFTY-TWO AND EIGlITY-FlVE. 5 6 THE A~YOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: 7 SECTION ONE: That said Ordinance No. 763, Section Fifty-three, 8 shall be and is hereby amended to read as follows: 9 "Section Fifty-three: For every person, firm or corporation con- 10 ducting, managing or carrying on the business of operating or maintaining 11 shuffle boards, $3.00 per quarter, or any part of such quarterly period, 12 payable quarterly in advance, for e'achsuch shuffle board." 13 SECTION TWO: That said Ordinance No. 763, Section Seventy-seven, 14 shall be and is hereby amended to read as follows: 15 "Section Seventy-seven: For every person, firm or corporation 16 conducting, managing or carrying on the business of selling fruits or vege- 17 tables from a vehicle, other than as a peddler, and having no fixed place of business in the City of San Bernardino, $10.00 per day for each such vehicle." 18 19 SECTION THREE: That said Ordinance No. 763, Section 115 shall be 20 and is hereby amended to read as follows: "Section 115: The provisions of this Ordinance shall not apply to 21 22 23 any bona fide non-profit charitable, fraternal or religious institution or organization of or within, the City of San Berna~dino, where the proceeds of 24 the activity covered by the exemption are to be used for the lawful purposes of said organization; provided, however, that no exemption hereunder shall be 25 26 valicl unless application therefor has been made, in writing to the City Clerk, 27 and a Certificate of Exemption iS,sued by th,~ City Clerk, which certificate 28 shall cover a period of not more than one year from date thereof, and shall 29 be displayed or available for presentment to any enforcement officer of the City of San Bernardino on request, on the premises covered by the Certificate; 30 31 32 . ... 20 21 22 23 24 25 26 . . . 1 provided, further, that no exemption shall be granted hereunder where any 2 person, firm, concern or orga~ization not meeting the foregoing qualifications 3 receives any share or interest in the activity proposed to be covered by the 4 exemption, or the proceeds or income therefrom." 5 SECTION FOUR: That said Ordinance No. 763, Section Fifty-two, 6 pertaining to shuffle boards, and Section Eighty-five, pertaining to 7 soliciting are hereby repealed. 8 SECTION FIVE: The Ci ty Clerk shall certify to the passage of this 9 Ordinance and shall cause the same to be published. in the San Bernardino 10 Evening Telegram, a daily newspaper hereby designated for that purpose. 11 I HEREBY CERTIFY that the foregoing Ordinance was duly adoP~~ the Mayor and Common Council of the Ci ty of San Bernardino at #ar ,') Ir- meeting thereof held on thec27d day of . y" , 1959, by the / /J following vote, to wit: V.
