2 AN ORDINANCE OF THE CITY OF SAN BERNARDINO CALLING A SPECIAL
ELECTION TO BE HELD ON THE THIRTIETH DAY OF AUGllST, 1960, PERTAINING TO THE
3 ANNEXATION OF A DISTRICT CALLED:
4 "ANNEXATION DISTRICT NO. 128"
5 WHEREAS, by resolution, the Mayor and Common Council of the City of
6 San Bernardino declared its intention to call a special election to be held
7 on the thirtieth day of August, 1960, in certain inhabited territory
8 contiguous to said City proposed to be annexed to said City, for the purpose
9 of submitting to the qualifil!d electors residing in said territory the question
10 whether or not said territory shall be annexed to said City; and
11 WHEREAS, a copy of said resolntion was published as required by
12 law; and
13 WHEREAS, at a time not later than the hour set by said resolution
14 for hearing objections to the proposed election, no written or oral protests
15 were made by the owners of one-half of the value of the territory proposed to
16 be annexed as shown by the last equalized assessment roll of the property
17 within the territory proposed to be annexed; and
18 WHEREAS, all proceedings have been had in accordance with said
19 re6olution and the Annexation Act of 1913, reference thereto hereby being
20 made for further particulars;
21 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
22 BERNARDINO DO ORDAIN AS FOLLOWS:

SECTION ONE: A special election hereby is called to be held on
24 the ~Oth day of August, 1960, in the territory hereinafter described and
25 proposed to be annexed to the City of San Bernardino, for the purpose of
26 submitting to the qualified electors residing in said territory the question
27 whether or not such territory shall be annexed to, incorporated in and made
28 a part of said City of San Bernardino, and whether or not the property in said
29 territory shall, after such annexation, be subject to taxation equally with
30 the property within the City of San Bernardino to pay the entire bonded
31 indebtedness of the City of San Bernardino outstanding at the date of filing

2 Said territory is described as follows:
3 All that portion of the Orange Grove Tract, as per plat
recorded in Book 11 of Maps at Page 14, Records of the
4 County Recorder of San Bernardino County and all that
pOTtion of the West Nighlands, as per plat recorded in
5 Book 5 of Maps at Page 77, Records of the County Recorder
of San Bernardino County, described as follows:

Beginning at a point on the present corporate limits of
the City of San Bernardino, said point being the Northeast
corner of Lot 6 of Tract No, 3879, Highland Park as per
plat recorded in Book 50 of Maps, Page 50, Records of th~
County Recorder of San Bernardino County; thence westerly
along the North line of Lots 6, 5, 4, 3 and 2 of Tract No.
3879, being along the present corporate limits of the City
of San Bernardino, to the Northeast corner of Tract No. 5499,
as per plat recorded in BOl)k 67 of Map'!, Page 60, Records
of the County Recorder of San Bernardino County; thence
Westerly along the North line of said Tract No. 5499. being
along the present corporate limits of the City of San
Bernardino, to the Northwest corner of said Tract No. 5499,
said point being also on the Easterly line of the 40 foot
Flood Control Easement; thence Northerly along the Easterly
line of said 40 foot Flood Control ES'!ement being along the
present corporate limits of the City of San Bernardino, to
a point 50 feet Southerly from the center line of Highland
Avenue; thence Westerly, parallel with and 50 feet Southerly
from the center line. of Highland Avenue, being along the'
present corporate limits of the City of San Bernardino, to
a point of intersection of the West line projected Southerly
of the easement as conveyed to the San Bernardino County
Flood Control, recoTded December 13, 1948 in Book 2334 of
Official Records, Page 282, Records of San Bernardino County;
thence Northerly along the Southerly extension thereof and
the West line of said San Bernardino County Flood Qontrol
Easement to the center' lin'e. of Pumlllo Street, 82.50 feet
wide, as .shown on said Orange Grove Tract and West Highlands;
thence Easterly along said center line of pumalo ~treet, to
the Northerly prolongation of the East line of Lot 2, Block
6, West Highland; theI\Ce Southerly along the Northerly pro-
longation of the East 'line of said Lot 2, the East line of
said Lot 2 and.the Southerly prolongation of the East line
of said Lot 2, to the cen~,!r line of nigh land Avenue, 120
feet wide, as shown'ori said map of West Highlands; thence
Westerly along the center line of Highland Avenue to the
Northerly prolongation of the East line of said Lot 6, Tract
No. 3879; thence Southerly along the Northe:rly prolongation
of the East line of said Lot 6, to the point of beginning.

SECTION TWO: TIME OF OPENING AND CLOSING OF POLLS. The polls at
28 said election shall be opened at 7 o'clock A. M. of the day herein fixed for
29 the holding of said election and shall be kept open until 7 o'clock P. M. of
:SO the same day, when the polls shall be closed.

SECTION THREE: BALLOTS. Upon the ballots to be used at said

1 election there shall be printed the words:
2 SHALL ANNEXATION DISTRICT NO. 128 BE ANNEXED TO, INCORPORATED IN
3 AND MADE A PART OF THE CITY OF SAN BERNARDINO AND THE PROPERTY IN SUCH TERRI-
4 TORY BE, AFTER SUCH ANNEXATION, SUBJECT TO TAXATION EQUALLY WITH THE PROPERTY
5 WITHIN THE CITY OF SAN BERNARDINO, TO PAY ITS PRO-RATA PORTION, BASED UPON
6 ASSESSED VALUATION OF ALL BCNDED INDEBTEDNESS OF THE CITY OF SAN BERNARDINO
7 OUTSTANDING AT THE DATE OF .THE FILING OF THE PETITION FOR ANNEXATION?
8 Opposite these words there shall be printed the words "Yes" and "No",
9 and to the right of each of these last two words there shall be a voting
10 square. If an elector shall stamp a cross (+) in the voting square after the
11 printed word "Yes", the vote of such elector shall be counted in favor of the
12 annexation of said territory to the City of San Bernardino, and if an elector
13 shall stamp a cross (+) in the voting square after the printed word "No", the
14 vote of such elector shall be counted against such annexation.
15 In all particulars not herein recited said election shall be held
16 in conformity, as near as may be, with the laws of the State of California
17 concerning general elections and with said Annexation Act of 1913.

SECTION FOUR: For purpose of said election there hereby is
19 established in the territory described herein one (1) voting precinct which
20 shall include all of said territory. The following is the polling place pf
21 said election precinct and the following named persons hereby are named
22 officers of election and shall constitute the board of election for such
23 election precinct:

SECTION FIVE: This ordinance shall tl'ke effect upon its
31 publication.

SECTION SIX: The City Clerk shall certify to the passage and adoptio
2 of this ordinance by the Council of the City of San Bernardino and shall cause
3 the same to be published three consecutive days in the San Bernardino Evening
4 Telegram, a daily newspaper of general circulation printed and published
5 within the City of San Bernardino, and once a week for four (4) weeks prior
6 to the date of the election in the Colton Daily Courier, a newspaper of
7 general circulation printed and published outside of the City of San Bernardino
8 but in the County of San Bernardino, California, which said ordinance shall
9 be preceded by the words "Notice of Election", and that due publication of
10 this ordinance as herein provided is hereby determined to be sufficient notice
11 of said election, and the only notice that shall be required to be given.

by the Mayor and Common Council of the City of San Bernardino at a
