2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO APPROVING THE ANNEXATION OF DISTRICT NO. 127.

WHEREAS, heretofore proceedings were initiated by the Common Council
5
of the City of San Bernardino, on its own motion, to annex tQ the City of
6
San Bernardino certain contiguous uninhabited territory hereinafter described;
and

WHEREAS, on the 2nd day of May, 1960, a resolution was adopted by
9

the aforesaid Common. Council of the City of San Bernardino, California,
declaring that proceedings had been initiated by said Council and proposing
the annexation for the reasons there'in stated of the aforementioned unin-
habited territory to be generally known as Annexation District No. 127 to
the City of San Bernardino, and that said resolution provided that the
proposed annexation should be generally known and identified as Annexation
District No. 127; and
WHEREAS, said resolution set forth therein that all the property
included in the aforesaid territory should be taxed equally with the other
property within the said City to pay the bonded indebtedness and any and all
general indebtedness and liability of the City of San Bernardino contracted
prior to or existing or outstanding at the time of the aforesaid proposed
annexation of the aforesaid property, as provided in the hereinbefore
mentioned Government Code; and
WHEREAS, the said resolution .did fix, determine and declare that a
hearing be held on the 27th day of June, 1960, at the hour of 9: 30 0.' clock
A.M. in the Council Chambers of the City Hall in the City of San Bernardino,
and the same was the,day, hour and place designated where any person owning
real estate within such territory so proposed to be annexed. and having any
objections to the proposed annexation might object before the Common Council
and show cause why such territory should not be annexed, and furthermore, the
said resolution provided that at any time not later than the said hour set,
as mentioned hereinbefore for the said hearing, any owner of property within
the said territory proposed to be annexed might file written protest with

1 the City of San Bernardino against such annexation; and
2 WHEREAS, no wri.tten protest of any kind or nature whatsoever were
3 filed with the City Clerk of the City of San Bernardino prior to 9:30 o'clock
4 A.M. on the 27th day of June, 1960; and
5 WHEREAS, it appears to the Common Council of the City of San Ber-
6 nardino that the aforesaid annexation proceedings have been completed and
7 everything performed at this time in accordance with said Government Code,
8 and mentioned hereinbefore, and any and all other laws in any way connected
10 WHEREAS, the Common Council of the City of San Bernardino desire to
9 with the said annexation procedure having been complied with; and
11 approve at this time the annexation of the aforesaid territory.
12 NOW, THEREFORE, THE COMMON COUNCIL OF THE CITY. OF SAN BERNARDINO
13 DOES HEREBY ORDAIN AS FOLLOWS:

SECTION ONE: That said territory herein described as Annexation
15 District No. 127 is hereby annexed and incorporated in and made a part of
16 the City of San Bernardino.

SECTION TWO: The territory herein referred to as being annexed to
the City of San Bernardino is particularly described as follows, to wit:
That portion of Lots 12, 13, 14, 16, 17, 18 and 19 of
Block 25 of Rancho San Bernardino according to the map
thereof as recorded in the Recorder's Office in Book 7
of Maps, at page 2, Records of San Bernardino County,
more particularly described as follows:
Beginning at a point on the line of the present corporate
limits of the City of San Bernardino, said point being
the intersection of the Northerly line of the Pacific
Electric Railway Company Right of Way, as delineated on
State Board of Equalization Land Identification Map No.
856-36-31B, Parcel No.6 of said Railway Company's
property, and the Northeasterly line of the land described
in the Right of Way Easement from Pacific Electric Rail-
way Company to San Bernardino County Flood Control District
recorded May 31, 1947 in Book 2051 of Official Records, at
page 457; thence North 30. 45' 07" West along said North-
easterly line to a point 205 feet Southerly of, and
measured at right angles to the Northerly line of the
Atchison, Topeka and Santa Fe Railroad Company Right of
Way as delineated on State Board of Equalization Land
Identification Map No. 804-36-l3C, Parcel No.3, of said
Railroad Company's property, said Northerly line also
being the present corporate limits of the City of San
Bernardino; thence Easterly parallel with said Northerly
line 590 feet more or less to a point on the Southwesterly

line of the Atchison, Topeka and Santa Fe Railroad
Company's Right of Way, 100 feet wide as delineated
on State Board of Equalization Land Identification
Map. No; 804-36-89, Parcel No.1; thence Southeasterly
along said Southwesterly line of said railroad Right
of Way to its intersection with the Northerly line of
Parcel No. 4 as delineated on State Board of Equali-
zation Land Identification Map No. 804-36-89; thence
Westerly along said Northerly line to the intersection
of the East line of Lot 18 of Block 25 of said Rancho;-
thence Southerly along the West line of said Parcel
No. 4 to the Southeast corner of said Lot 18; thence
Easterly along the South line of Lot 19 of said Rancho
to the West line of said Parcel No.4; thence Southerly
along the Westerly line of said Parcel No. 4 to its
intersection with the Northerly line of the Pacific
Electric Railway Complifiy RiglifQf Way; as delineated
on State Board of Equalization -Land Identification
Map No. 856-36-3lB, Parcel No. 6 of said Railway
Company's property, said Northerly line also being
the present corporate limitsQf -the City of San Ber-
nardino; thence. Westerly along said NQrtherly line
also being the present corporate limits of the City
of San Bernardino a distance of 460 feet more Qr less
to the. point of beginning.

SECTION THREE: That the above described property will be subject
to taxation equally with the property within such municipal corpQration to
pay its proportion of the following bonded indebtedness of the City of San
Bernardino, which said bonded indebtedness was outstanding or theretofore
authorized and is outstanding at the time of said annexation, to wit:
A bonded indebtedness of $200,000.00 incurred for construction ahd
completion of a convention hall, the outstanding indebtedness thereon being
$6,000.00, bearing interest at the rate of 5% per annum;
A bonded indebtedness of $275,000.00 incurred for the acquisiti,Qn
and construction of water works, including "Devil Canyon Water Works", water
rights, rights of way, .pipe lines, wells and pumping plants, the outstanding
indebtedness thereon being $27,500.00, bearing interest at the rate of
5% per annum;
A bonded indebtedness of $490,000.00 incurred for the acquisition
and construction of a public library, including additions to and enlargements
of the public library system of said City, the outstanding indebteqness
thereon being $470,000.00, bearing interest at the rates of 4-3/4%, 3-1/4%
and 3-1/2% per annum.

SECTION FOUR: The property herein annexed is declared to be a part
2 of Ward 3 and the boundaries of Ward 3 are hereby altered to include said
3 annexed territory, and said property is placed and declared to be in M-2
4 General Industrial Zone.

SECTION FIVE: The City Clerk shall certify to the passage of this
6 ordinance and shall cause the Same to be published three consecutive times,
7 exclusive of holidays, in the San Bernardino Evening Telegram, a daily
8 newspaper designated for that purpose.
9 I HEREBY C~TIFY that the foregoing ordinance was duly adopted by
the Mayor and Common Council of the City of San Bernardino at a
regular meeting thereof, held on the ~71~ day of ~~.~~
