2 AN ORDINANCE OF TIlE MAYOR AND COMMON COUNCIL OF TIlE CITY OF SAN
BERNARDINO APPROVING TIlE ANNEXATION OF DISTRICT NO. 131.

WHEREAS, heretofore a petition was filed with the Common Council of
4
the City of San Bernardino requesting that certain uninhabited territory
5
6
contiguous to said City be annexed to the City of San Bernardino, and which
. ,
7
said petition described said territory and the boundaries thereof proposed to
8
be annexed to the City; and
9
WHEREAS, said petition was filed by the owners of not less than one-
10
fourth of the area of land in such territory and representing not less than
11
one-fourth of the assessed value of such territory according to the last pre-
12
ceding equalized assessment roll of the County of San Bernardino, in which said
13
. County the City of San Bernardino is situated; and
14
WHEREAS, said petition requested the said terrrtory to be annexed to
and included in the said municipal corporation in accordance with the provisions
15
16
of the Government Code, Section 35300, etseq.; and
17
WHEREAS, on the 12th day of September, 1960, a Resolution was adopted
18
by the aforesaid Common Council of the City of San Bernardino, California,
19
proposing the annexation of the aforesaid uninhabited territory to be generally
20
known as ANNEXATION DISTRICT NO. 131 to the City of San Bernardino, and that
21
said Resolution provided therein that the proposed annexation should be
22
generally known and identified as ANNEXATION DISTRICT NO. 131; and
23
WHEREAS, said Resolution Set forth therein that all the property
24
included in the aforesaid territory should be taxed equally with the other
25
property within the said City to pay the bonded indebtedness and any and all
26
general indebtednes.s and liability of the City of San Bernardino contracted
27
prior to or existing or outstanding at the time of the aforesaid proposed
28
annexation of the aforesaid property as provided in the hereinbefore mentioned
29
Government Code; and

WHEREAS, said Resolution did fix, determine and declare that a
31
hearing be held on the 17th day of October, 1960, at the hOUr of 9:30 o'clock

A. M. in the Council Chambers of the City Hall in the City of San Bernardino,

and the same was the day, hour and place designated where any person owning
3
real estate within such territory so proposed to be annexed and having any
4
objections to the pl:oposed annexation might object before the Common Council and
5
&hbw cause why such territory should not be annexed, and, furthermore, the
6
said Resolution provided that at any time not later than the said hour set, as
7
mentioned hereinbefore for the said hearing, any owner of property within the
8
said territory proposed to be annexed might file written protest with the City
9
of San Bernardino against such annexation; and
10
WHEREAs, no written protest of any kind or nature whatsoever were
11
filed with the City Clerk of the City of San Bernardino,prior to 9:30 o'clock
12
A. M. on the 17th day of October, 1960; and
13
WHEREAS, it appears to the Common Council of the City of San Bernardino
14
that the aforesaid anne*ation proceedings have been completed and everything
15
performed at this time in accordancewirh said Gov.ernment Code, as mentioned
16
hereinbefore, and any and all other laws in any, way connected with the said
17.
annexation procedure having been c~p1ied with;, and
18
WHEREAS, the Common,Coun~i1 ~f the City of San Bernardino desire.to
19
approve at this time the annexation of the a~ores~id territory.

NOW, THEREFORE, THE COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DOES
HEREBY OIIDAIN AS. FOLLOWS:

SECTION ONE: That said territory herein described as Annexation
23 pistrict No. 131 is hereby annexed and incorporated .irl and made a part of the
24 City of San Bernardino.

SECTION TWO: The territory herein referred to as being annexed to the
26
City of San Bernardino is particularly described as follows, to wit:
That portion of Lots 12 11M 13,according to the Map of part
of the ltuscupiabe Rancho, lying inTQwns~ip 1 lIlo:rth, Range 4
West, San Bernardino Base and Meridian, as per sprvey made
May 41, 1885, at the request of John Hancock in the County
of .San Bernl!rdino, State of California, as pel:" plat. thereof
recorded in the Recordel:"' s Office in Book 2 of Maps, at page
42, recorda bf Sa~ Bernardino County, . described as follows:

Bernardino, 625.16 feet to a point on the Easterly pro-
longation of the South boundary line of Tract No. 4630, as
per plat thereof rel'orded in the Recorder's Office in Book
59 of Maps, at page 29, records of said County~ and being
the Present corporate limits of the City of San Bernardinol
thence Westerly along said Easterly prolongatitOnJof:41id :the
South line of Tract No. 4630 and being along the present
corporate limits of the City of San Bernardino to the
Southwest corner of Lot 6 of said Tract No, 4630; thence
continuing Westerly along the South line of Tract No. 4283
as per plat thereof recorded in the)!.ecorder' s Office in
Book 54 of Maps, at p'age 33, records of said County to a
pOint on the East line of Tract No. 3959 as per plat thereof
recorded in the Recorder's Office in Book 52 of Maps, at
pages 12 through 14, records of San Bernardino County; thence
Southerly along said East line of Tract No. 3959, 770.99
feet to the Northwest e-6rner of LOt 21 of Tract No. 5065 as
per plat thereof as rel'orded in the Recorder's Office in
Book 63 of Maps, at page 5; thence Easterly along the
North line of said Lot 21, the South li.ne of Lot "A", the
North line of Lots 20 and 11, the S~th line of Lot "Ii" and.
the North line of Lots 10 and, 1 to the Northeast corner of
said Lot 1, all in said Tract No. 5Q65;thence Northerly

SECTION THREE: That the above described property will be subject to

taxation equally with the property within such municipal corporation to pay
20
its proportion of the following ,bonded indebtedness of the City of San Bernardino
21
which said bonded indebtedness was outstanding or theretofore authorized and is
22
outstanding at the time of said annexation, to witt
23
A bonded indebtedness of $200,000.00 ,incurred for the construction and
24
completion of a convention hall, the outstanding indebtedness thereon being
25
$5,000.00, bearing interest at the rate of 5% per annum;
26
A bonded indebtedness of $275,000.00 incurred for the acquisition and
27
construction of water works, inct\lding "Devil Canyon Water Works", water rights,
28
rights of way, pipe lines, wells and, pumping plants, the outstanding indebtedness
thereon being $27,500.00, bearing interest at the rate of 5% per annum;
A bonded indebtedness of $490;000.00 incurred for the acquisition and

construction of a public librat'Y, including additions to and enlargements of

the public library system of said City, the outstanding indebtedness thereon
2
being $450,000.00, bearing interest at the rates of 4~3/4~, 3-1/4% and 3-1/2%
3
per annum.

SECTION FOUR: The property herein annexed is declared to be a part of
5
Ward 4, and the boundaries of Ward 4 are hereby altered to include said annexed
6
territory, and said property is placed and declared to be in R-l" Single Family
7
Residential Zone.

SECTION FIVE: The City Clerk shall certify to the passage of this
9
Ordinance and shall cause the same to be, published three consecutive times,
10
exclusive of holidays, in the San Bernardino Evening Telegram, a daily newspaper
11
designated for that purpose.

I HEREBY CERTIFY that the foregoing Ofdinancewas duly adopted by the
13
Mayor and Common Council of the City of San Bernardino at an adjourned regular
meeting thereof hel.d on the~. day of Pr~nkj, 1960, by the
