ORDINANCE NO._~~~~ AN ORDINANCE OF THE CITY OF SAN BERNARDINO, CALIFORNIA, ORDERING, CALLING, PROVIDING FOR AND GIVING NOTICE OF A SPECIAL ELECTION TO BE HELD IN THE CITY OF SAN BERNARDINO ON THE 21ST DAY OF MARCH, 1961, FOR THE PURPOSE OF SUBMITTING TO THE ~UALIFIED VOTERS OF SAID CITY A PROPOSITION TO INCUR BONDED INDEBTEDNESS BY SAID CITY FOR A CERTAIN MUNICIPAL IMPROVEMENT, AND CONSOLIDATING SAID ELECTION WITH THE CITY PRIMARY ELECTION TO BE HELD ON SAID DATE. WHEREAS, the Mayor and Common Council of the City of 9fn Bernardino, california, did on the ~~ ~ / day of J1...~AL/ , 1961, by a vote of more than two-t~ds of the members of said Common Council, adopt Resolution No, <,~p / cJ , entitled "A resolution of the Mayor and Common Council of the City of San Bernardino, california, determining that the public interest and necessity demand the acquisition and construction of a certain municipal improvement, and making findings relating thereto," which said resolu- tion was duly signed and approved by the Mayor of said city and attested and certified by the City Clerk of said city; The Mayor and Common Council of the City of san Bernardino DO ORDAIN as follows: . . Section 1. That a special election be held, and the same is hereby called to be held, in the City of san Bernardino, california, on the 21st day of March, 1961, for the purpose of submitting to the qualified voters of said city the proposition hereinafter set forth of incurring indebtedness and issuing bonds of said city therefor, in the amount hereinafter set forth, and for the objects and pur- poses set forth in said resolution and in the ballot proposi- tion hereafter set forth. Section 2. That the estimated cost of the municipal improvement described in said proposition entitled CITY OF SAN BERNARDINO PARK AND RECREATION BONDS is the sum of $1,958,000 and that the amount of the principal of the indebtedness to be incurred therefor is the sum of $1,958,000. That the estimated cost of the municipal improvement as above stated includes the following: (a) legal or other fees incidental to or connected with the authorization, issuance and sale of the bonds, and (b) the costs of printing the bonds and other costs and expenses incidental to or connected with the issuance and sale of the bonds. Section 3. That the maximum rate of interest to be paid on said indebtedness shall not exceed six per cent (6%) per annum, payable annually the first year and semiannually thereafter, the actual rate or rates of interest on said bonds to be determined at or prior to the time of the sale or sales thereof. 2. . . Section 4. That the polls for said election shall be opened at seven o'clock A.M., of the day of said election and shall remain open continuously from said time until seven o'clock P.M., of the same day, when said polls shall be closed, except as provided in Section 5734 of the Elections Code of the State of California. Section 5. That on the ballots to be used at said election in addition to any other matters required by law, there shall be printed substantially the following: MARK CROSS (+) ON BALLOT ONLY WITH RUBBER STAMP; NEVER WITH PEN OR PENCIL. (ABSENTEE BALLOTS MAY BE MARKED WITH PEN AND INK OR PENCIL.) - INSTRUCTIONS TO VOTERS To vote on any measure, stamp a cross (+J in the voting square after the word "YES or after the word "NO". All marks, except the cross (+) are forbidden. All dis- tinguishing marks or erasures are forbidden and make the ballot void. If you wrongly stamp, tear or deface this ballot, return it to the inspector of elec- tion and obtain another. On absent voter ballots mar~ a cross (+) with pen or pencil. 3. I I , i I . . CITY OF SAN BERNARDINO PARK AND RECREATION BONDS: Shall the City of San Bernardino incur a bonded indebtedness in the principal sum of $1,958,000 for the acquisition and con- struction by said city of a certain municipal improvement, to wit: the extension and develop- ment of the public park system of the city and the construc- tion therein (including recon- struction) of facilities for public recreation, including the acquisition of real property for parks and park uses, the landscaping and planting of grounds, the con- struction of lighting facili- ties, restrooms, tool houses and storage buildings, water- ing facilities, sanitary sewers, drainage facilities, drives and vehicle parking areas; the construction of facilities for public recreation, includ- ing swimming pools and bath- house facilities, all purpose courts, baseball and softball fields, bleachers, picnic facilities, playgrounds with necessary apparatus and equip- ment; recreation buildings with equipment, apparatus and furniture therefor, adult recreation facilities, and including for the foregoing the acquisition of any real property, easements, rights of way, equipment, apparatus and other property necessary therefor? : YES : : : : : : : NO 4. . . Section 6. A cross (+) placed in the voting square after the word "YES" in the manner hereinbefore provided shall be counted in favor of the adoption of the proposition. A cross (+) placed in the voting square after the word "NO" in the manner hereinbefore provided shall be counted against the adoption of the proposition. Section 7. That if the proposition for the incurring of bonded indebtedness so submitted receives the requisite number of votes, to wit, two-thirds of the votes of the qualified electors voting on said proposition, bonds of said city, in not exceeding the principal amount stated in such proposition, shall be issued and sold for the object and purpose set forth in said proposition. Section 8. That said special election hereby called to be held in the City of san Bernardino on the 21st day of March, 1961, shall be and is hereby ordered consolidated with the City of san Bernardino primary election to be held in said city on said date, and such election shall be held in all respects as if there were only one election, and only one form of ballot shall be used thereat. The precincts, polling places and officers of election for this special election shall be the same as those provided for said primary election, and said precincts, polling places and officers of election are set forth in the notice for said primary election. said notice will be published in the SAN BERNARDINO EVENING TELEGRAM on the 17th day of February, 1961. 5. . . Section 9. That only qualified voters of the City of San Bernardino shall be permitted to vote at the election hereby called. Section 10. That the City Clerk shall certify to the passage and adoption of this ordinance by a vote of more than two-thirds of all the members of the Common Council of said city and shall cause said ordinance to be published once a day for at least seven (7) days prior to the date of said election in the SAN BERNARDINO EVENING TELEGRAM, a newspaper of general circulation published daily in said city.
