2 AN Oll,DINANCE OF THE MAYOIl, AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO APPROVING THE ANNEXATION OF DISTRICT NO. 132.

WHEREAS, heretofore proceedings were initiated by the Common Council
5
of the City of San Bernardino, on its own motion, to annex to the City of
6
San Bernardino certain contiguous uninhabited territory hereinafter described;
7
and
8
WHEREAS, on the 30th day of January, 1961, a resolution was adopted
9
by the aforesaid Common Council of the City of San Bernardino, California, de-
10
elating that proceedings had been initiated by said Council and proposing the

annexation for the reasons therein stated of the aforementioned uninhabited
12
territory to be generally known 'as Annexation District No. 132 to the City of
13
San Berna.;rdino, and that said resoJl1tion provided that the prQPosed annexation
14
should be generally known'and identified as Annexation District No. 132; and
15
WHEREAS, said resolution set forth th~rein that all the property
16
included in the aforesaid territQrr should be taxed equally with the other
17
property within the said City to pay t,he bonded' indebtedness and any and all
18
general indebtedness and liability of the,City of San Bernardino contracted
19
prior to or exist+ng q;r outstandipg at the ti~e of the aforesaid proposed annexa-
tion of the aforesaid p;roperty as provided in the hereinbefore mentioned
20

21 Government Code; and

WHEREAS, said resolution did fix, determine and declare that a
23
hearing be held on the 6th day of March, 1961, at the hour of 9:30o'clock A.M.
24
in the Council Chambers of the City Hall in the City of San llernardino, and the
25

same was the day, hour and place designated where any person owning real estate
26
within such territory so proposed to be annexed and having any objections to
27
the proposed annexation might object before the Common Council and show cause
28
why such territory should not be annexed; andfllrthermore, the said resolution
29
provided that at any time not later than the said hour set, as mentioned herein-
30
before for the said hearing, any owner of property within the said territory
31

proposed ,to be annexed might file written protest with the City of San Bernardino
32
against such annexation; and

3 WHEREAS, no written,protest of any kind or nature whatsoever were
4 filed with the City Clerk of the City of San,.Bernardino prior to 9130 0' clock
5 A.M. on the 10th day of April, 1961j and
6 ' WHEREAS, it appears to 'the Common Council of the City of San Bernardino
7: that the aforesaid annexatioQ proceedings. have been completed and 'every thing

approve at this time the annexation of the aforesaid territory.

S~CTION ONE: That said territory herein described as Annexation
District No. 132 is hereby annexed and incorporated in and made a part of the
City of san Bernardino.
SECTION TWO: The territory herein referred to as being annexed to the
City of ,San Bernardino is particularly described as follows, to wit:
Those portions of Lots 1 and 11, BlQCk 54, Lots 1 and 4,
Block 65, Loots 7, 8, 9, and 10, Block 75, Rallcho San I\ert;tar-
dine, in the COUllty of San Berpardino,State Of California,

S!lCTION THREE: That the above described property will be subject to

taxation equally with the prop~rty within such municipal corporation to pay

its proportion of the following bonded indebtedness of the City cif San

Bernardino, which said bonded indebtedness was outstanding or theretofore
authorized <lnd is outstanding at the time., of said annexation, to wit:

A bonded inc;lebtedne~s of $200,000.0,pincurred for the construction and

completion of a convention h,all, the outstanding indebtedness thereon being
13
$5,000.00, bearing io.terest at. the rate of 5% per annum;
A bonded indebtedness Of $275,000.00 incurred for the acquisition and
14

construction of water works, including "Devil Canyon Water Works", water
rights, ;rights of way; pipe lines, wells and pumping plants, the. outStanding
17
indebtedness thereon being .$27,500.00~ Ilearing interest at the rate of 5%
18
per annum;

A bonded indelltedness of $490,000.00 incurred for the acquisition
and constTuction of a public library, including additions to and enlargements
21
of the public library system of said City, the outstanding indebtedness thereon
22
being $450,000.00, bearing interest at the rates of 4-3/4%, ~1/4% and 3-1/2%
23
per annum.

SECTION FOUR: The property herein annexed is declared to .be a part
25

of Ward 3 and the boundaries of Ward 3 are hereby altered to include said
annexed territory, and saill property is placed and d.eclared to be in M-I
27
Light IndustTial Zone.

SECTtON FIVE: The City Clerk shall certify to the passage of this
29
ordinance and.shallcause the same to be published three consecutive times,
30
exclusive of holidays, in the San Bernardino Evening Telegram, a daily newspaper
31
designated for that purpose,
