AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AMENDING ORDINANCE NO. 821, ENTITLED
a "A CODIFYING ORDINANCE OF THE CITY OF SAN BERNARDINO."

4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO DO ORDAIN AS FOLLOWS:

SECTION ONE:
Ordinance No. 821, Section 527, is hereby
6 amended to read as follows:

SECTION 527: No person owning or having charge, custody,
8
control, or possession of any vicious or dangerous dog or animal
9
shall permit it to run at large, or to run loose or unrestrained
10
in the City of San Bernardino.
The fact that said dog or animal
11 has bitten any person shall be prima facie evidence that it is a
12 vicious or. dangerous animal.

Each person who owns or has charge, custody, control,
or possession of a vicious or dangerous dog or animal shall cause
it at all times to be leashed, tied securely to a stationary
object, or confined within a fenced or enclosed area, provided
that notice in writing to this effect has first been mailed to

18 said person ,by the Humane Officer. After such notice, any person
19
who violates and is convicted under the provisions of this
Section shall be punished by a fine of not less than Fifty ($50.00)
Dollars nor more than Five Hundred ($500.00) Dollars or by

imprisonment for not less than one day nor more than six months
or by both such fine and imprisonment.
SECTION TIvO: Ordinance No. 821, Section 528, is hereby

25 amended to read as follows:

SECTION 528: Each vicious or dangerous dog or animal
27 found running at large shall be impounded by the Humane Officer
28 for a period of seventy-two hours, and in the event the owner or
~ possessor of such dog or animal shall not, on or before the
30 expiration of said period, call for and claim said dog or animal,
31 paying the sum of Five ($5.00) Dollars for each day that the dog

1 or animal shall be impounded, said dog or animal shall be killed
2 by the Humane Officer.

SECTION THREE: Ordinance No. 821, Section 523, is
4 I hereby amended to read as follows:
5 I SECTION 523: The Humane Officer shall have the right
6
to seize any dog or animal within the City of San Bernardino
having or suspected to have rabies or hydrophobia and in the event
he shall determine that such dog or animal is afflicted with rabies
or hydrophobia, the dog or animal shall be forthwith killed by the
Humane Officer; provided that if such dog or animal shall be
suspected of having rabies or hydrophobia, it may be confined by
the Humane Officer for such time as is necessary, and if the
Humane Officer shall then determine that said dog or animal does
not have rabies or hydrophobia, it shall be returned to the owner
upon payment by the owner of the sum of Twenty Five ($.25) Cents
per day for each day that the dog or animal shall be confined.
I HEREBY CERTIFY that the foregoing Ordinance was duly
adopted by the Mayor and Common Council of the City of San
