2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO APPROVING THE ANNEXATION OF DISTRICT NO. 135.

WHEREAS, heretofore, proceedings were initiated by the Common Council
5
of the City of San Bernardino, on its own motion, to annex to the City of
6
San Bernardino certain contiguous uninhabited territory hereinafter described;
7
and
8
WHEREAS, on the 8th day of May, 1961, a resolution was adopted by the
9
aforesaid Common Council of the City of San Bernardino, California, declaring
10
that proceedings had been initiated by said Council and proposing the annexation
11
for the reasons therein stated of the aforementioned uninhabited territory, to
12
be generally known as Annexation District No. 135 to the City of San Bernardino,
13
and that said resolution provided that the proposed annexation should be
14
generally known and identified as Annexation District No. 135; and
15
WHEREAS, said resolution set forth therein that all the property
16
included in the aforesaid territory should be taxed equally with the other
17
property within the said City to pay the bonded indebtedness and any and all
18
general indebtedness and liability of the City of San Bernardino contracted
19
prior to or existing or outstanding at the time of the aforesaid proposed
20
annexation of the aforesaid property as provided in the hereinbefore mentioned
21
Government Code; and

WHEREAS, said resolution did fix, determine and declare that a
23
hearing be held on the 19th day of June, 1961, at the hour of 9:30 o'clock A. M.
24
in the Council Chambers of the City Hall in the City of San Bernardino, and the
25
same was the day, hour and place designated where any person owning real estate
26
within such territory so proposed to be annexed and having any objections to
27
the proposed annexation might object before the Common Council and show cause
28
whYnsuch territory should not be annexed, and furthermore, the said resolution
29
provided that at any time not later than the said hour set, as mentioned herein-
30
before for the said hearing, any owner of property within the said territory
31
proposed to be annexed might file written protest with the City of San Bernardino
32
against such annexation; and
1 WHEREAS, no written protests of any kind or nature whatsoever were
2 filed with the City Clerk of the City of San Bernardino prior to 9:30 o'clock
3 A. M. on the 19th day of June, 1961; and
4 WHEREAS, it appears to the Common Council of the City of San Bernardino
5 that the aforesaid annexation proceedings have been completed and everything
6 performed at this time in accordance with said Government Code, as mentioned
7 hereinbefore, and any and all other laws in any way connected with the said
8 annexation procedure having been complied with; and
9 WHEREAS, the Common Council of the City of San Bernardino desire to
10 approve at this time the annexation of the aforesaid territory.
11 NOW, THEIl.EFORE, THE COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DOES
12 HEREBY ORDAIN AS FOLLOWS:

SECTION ONE: That said territory herein described as Annexation
14 District No. 135 is hereby annexed and incorporated in and made a part of the
15 City of San Bernardino.

SECTION TWO: The territory herein referred to as being annexed to the
17
City of San Bernardino is particularly described as follows, to wit:

That portion of Lots 6 and 31, Mount Vernon Orange Grove
and Fruit Company's Lands as per plat recorded in Book 12
of Maps, Page 16, records of the County Recorder of San
Bernardino County, described as follows:

Beginning at a point on the present corporate limits of
the City of San Bernardino, said point being 303.00 feet
Southerly from the South line of Nineteenth Street
(formerly Linville Street), 60.00 feet wide, and 150.00
feet Westerly of the West line of Muscott Street, 82.50
feet wide; thence Westerly along said present corporate
limits of the City of San Bernardino to a point 718.81
feet Westerly of the West line of said Muscott Street;
thence Southerly and parallel with the West line of said
Muscott Street, a distance of 322.00 feet; thence Easterly
and parallel with the South line of said Nineteenth Street
to a point 150.00 feet Westerly of the West line of said
Muscott Street, said point also being on the present
corporate limits of the City of San Bernardino; thence
Northerly along said present corporate limits, a distance
of 322.00 feet to the point of beginning.

SECTION THREE: That the above described property will be subject to
31 taxation equally with the property within such municipal corporation to pay
32 its proportion of the following bonded indebtedness of the City of San Bernardino,

1 which said bonded indebtedness was outstanding or theretofore authorized and is
2 outstanding at the time of said annexation, to wit:
3 A bonded indebtedness of $200,000.00 incurred for the construction
4 and completion of a convention hall, the outstanding indebtedness thereon being
5 $5,000.00, bearing interest at the rate of 5% per annum;
6 A bonded indebtedness of $275,000.00 incurred for the acquisition and
7 construction of water works, including "Devil Canyon Water Works", water rights,
8 rights of way, pipe line, wells and pumping plants, the outstanding indebtedness
9 thereon being $27,500.00, bearing interest at the rate of 5% per annum;
10 A bonded indebtedness of $490,000.00 incurred for the acquisition
11 and construction of a public library, including additions to and enlargements
12 of the public library system of said City, the outstanding indebtedness thereon
13 being $450,000.00, bearing interest at the rates of 4 3/4%, 3 1/4% and 3 1/2%\
14 per annum.

SECTION FOUR: The property herein annexed is declared to be a part
16 of Ward 5, and the boundaries of Ward 5 are hereby altered to include said
17 annexed territory; and said property is placed and declared to be in R-l,
18 Single Family Residential Zone.

SECTION FIVE: The City Clerk shall certify to the passage of
20
this ordinance and shall cause the same to be published three consecutive times,
21
exclusive of holidays, in the San Bernardino Evening Telegram, a daily newspaper
22
designated for that purpose.

I HEREBY CERTIFY that the foregoing ordinance was duly adopted by
24
the Mayor and Common Council of the City of San Bernardino at an adjourned
