2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO APPROVING THE ANNEXATION OF DISTRICT NO. 137.

WHEREAS, heretofore, proceedings were initiated by the Common Council
5
of the City of San Bernardino, on its own motion, to annex to the City of
6
San Bernardino certain contiguous uninhabited territory hereinafter described;
7
and
8
WHEREAS, on the 10th day of July, 1961, a resolution was adopted by
9
the aforesaid Common Council of the City of San Bernardino, California,
10
declaring that proceedings had been initiated by said Council and proposing the
11
annexation for the reasons therein stated of the aforementioned uninhabited
12
territory, to be generally known as Annexation District No. 137 to the City of
13
San Bernardino, and that said resolution provided that the proposed annexation
14
should be generally known and identified as Annexation District No. 137; and
15
WHEREAS, said resolution set forth therein that all the property
16
included in the aforesaid territory should be taxed equally with the other
17
property within the said City to pay the bonded indebtedness and any and all
18
general indebtedness and liability of the City of San Bernardino contracted
19
prior to or existing or outstanding at the time of the aforesaid proposed
20
annexation of the aforesaid property as provided in the hereinbefore mentioned
21
Government Code; and
22
WHEREAS, said resolution did fix, determine and declare that a hearing
23
be held on the 14th day of August, 1961, at the hour of 9:30 o'clock A. M. in
24
the Council Chambers of the City Hall in the City of San Bernardino, and the
25
same was the day, hour and place designated where any person owning real estate
26
within such territory so proposed to be annexed and having any objections to
27
the proposed annexation might object before the Common Council and show cause
28
why such territory should not be annexed; and furthermore, the said resolution
29
provided that at any time not later than the said hour set, as mentioned herein-
30
before for the said hearing, any owner of property within the said territory
31
proposed to be annexed might file written protest with the City of San
32
Bernardino against such annexation; and

WHEREAS, no written protests of any kind or nature whatsoever were

2 filed with the City Clerk of the City of San Bernardino prior to 9:30 o'clock
3 A. M. on the 14th day of August, 1961; and
4 WHEREAS, it appears to the Common Council of the City of San Bernardino
5 that the aforesaid annexation proceedings have been completed and everything
6 performed at this time in accordance with said Government Code, as mentioned
7 hereinbefore, and any and all other laws in any way connected with the said
8 annexation procedure having been complied with; and
9 WHEREAS, the Common Council of the City of San Bernardino desire to
10 approve at this time the annexation of the aforesaid territory.
11 NOW, THEREFORE, THE COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DOES
12 HEREBY ORDAIN AS FOLLOWS:

SECTION ONE: That said territory herein described as Annexation
14 District No. 137 is hereby annexed and incorporated in and made a part of the
15 City of San Bernardino.

SECTION TWO: The territory herein referred to as being annexed to
17
the City of San Bernardino is particularly described as follows, to wit:

All those portions of Sections 20, 21 and 28, Township 1
North, Range 4 West, San Bernardino Base and Meridian, if
said section lines were extended across the Rancho Muscupiabe
as per plat thereof recorded in Book 7 of Maps, Page 23,
Records of the County Recorder of San Bernardino County,
described as follows:

Beginning at a point on the Westerly prolongation of the
North line of the Arrowhead Tract as per plat thereof recorded
in Book 11 of Maps, Page 37, Records of the County Recorder
of said County, said point being 1883.36 feet West of the
Northwest corner of said Arrowhead Tract, said point also
being on the present corporate limits of the City of San
Bernardino; subsequent courSes herein described are on the
present corporate limits of the City of San Bernardino;
thence Southerly along said city limit line to a point
200.00 feet North of the Westerly prolongation of the North
line of Marshall Boulevard, 82.50 feet wide, delineated as
Twenty-seventh Street on the map of said Arrowhead Tract;
thence Westerly along a line which is 300.00 feet North and
parallel to said Westerly prolongation of the North line of
Marshall Boulevard to the Southeast corner of Annexation
No. 72 of the City of San Bernardino; thence Northerly along
the East line of said annexation to the Northeast corner
thereof; thence West along the North line of said annexation
to the Northwest corner thereof; thence S 00 08' 45" W to a
point that is 4268.26 feet North of the North line of the
Rancho San Bernardino as per plat thereof recorded in Book 7

of Maps, Page 2, records of the County Recorder of said
County; thence N 890 52' IS" W 88.03 feet; thence N
380 31' 55" W 1643.77 feet; thence S 51-28' 05" W 720
feet; thence N 380 31' 55" W 3585.15 feet; thence leaving
the present corporate limits of the City of San Bernardino,
East to a point that is 48 chains East and parallel to
course No. 38 and 119 chains 73 1/2 links North of Course
No. 37 as delineated on said map of the Rancho Muscupiabe,
said point being described in parcel No. 5 in that certain
deed to the Transcontinental Investment Co. recorded
April 11, 1960 in Book 5107, Page 163, Official Records
of said County; thence South and parallel to the Northerly
prolongation of said course No. 38 to a point that is
100 chains North of the South line of said Rancho
Muscupiabe as described in parcel No. 2 in said deed to
Transcontinental Investment Co., said point also being on
a line which is the Westerly prolongation of the North
line of said Arrowhead Tract; thence East along said
Westerly prolongation to the point of beginning.

Map recorded in Book 18 of Records of Survey's Pages 9 to
11 inclusive, records of said County.

SECTION THREE: That the above described property will be subject to
14
taxation equally with the property within such municipal corporation to pay
15
its proportion of the following bonded indebtedness of the City of San
16
Bernardino, which said bonded indebtedness was outstanding or theretofore
17
authorized and is outstanding at the time of said annexation, to wit:

A bonded indebtedness of $200,000.00 incurred for the construction
19
and completion of a convention hall, the outstanding indebtedness thereon being
20
$5,000.00, bearing interest at the rate of 5% per annum;
21
A bonded indebtedness of $275,000.00 incurred for the acquisition and
22
construction of water works, including "Devil Canyon Water Works", water rights,
23
rights of way, pipe lines, wells and pumping plants, the outstanding indebtedness
24
thereon being $20,625.00, bearing interest at the rate of 5% per annum;
25
A bonded indebtedness of $490,000.00 incurred for the acquisition
26
and construction of a public library, including additions to and enlargement
27
of the public Itbrary system of said City, the outstanding indebtedness thereon
28
being $450,000.00, bearing interest at the rates of 4 3/4%, 3 1/4% and 3 1/2%
29
per annum..

SECTION FOUR: The property herein annexed is declared to be a part
31 of Ward 5 and the boundaries of Ward 5 are hereby altered to include said
32 annexed territory; and said property is placed and declared to be in

SECTION FIVE: The City Clerk shall certify to the passage of this
3 ordinance and shall cause the same to be published three consecutive times,
4 exclusive of holidays, in the San Bernardino Evening Telegram, a daily newspaper
5 designated for that purpose.

I HEREBY CERTIFY that the foregoing ordinance was duly adopted by
7
the Mayor and Common Council of the City of San Bernardino at an ~djourned regula
