AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO APPROVING THE ANNEXATION OF DISTRICT NO. 138. WHEREAS, heretofore, proceedings were initiated by the Common Council of the City of San Bernardino, on its own motion, to annex to the City of San Bernardino certain contiguous uninhabited territory hereinafter described; and WHEREAS, on the 31st day of July, 1961, a resolution was adopted by the aforesaid Common Council of the City of San. Bernardino, California, declaring that proceedings had been initiated by said Council and proposing the annexation for the reasons therein stated of the aforementioned uninhabited territory, to be generally known as Annexation District No. 138 to the City of San Bernardino, and that said resolution provided that the proposed annexation should be generally known and identified as Annexation District No. 138; and WHEREAS, said resolution set forth therein that all the property included in the aforesaid territory should be taxed equally with the other property within the said City to pay the bonded indebtedness and any and all general indebtedness and liability of the City of San Bernardino contracted prior to or existing or outstanding at the time of the aforesaid proposed annexation of the aforesaid property as provided in the hereinbefore mentioned Government Code; and WHEREAS, said resolution did fix, determine and declare that a hearing be held on the 5th day of September, 1961, at the hour of 9:30 o'clock A. M. in the Council Chambers of the City Hall in the City of San Bernardino, and the same was the day, hour and place designated where any person owning real estate within such territory so proposed to be annexed and having any objections to the proposed annexation might object before the Common Council and show cause why such territory should not be annexed, and furthermore, the said resolution provided that at any time not later than the said hour set, as mentioned herein- be~ore for the said hearing, any owner of property within the said territory proposed to be annexed might file written protest with the City of San Bernar- dino against such annexation; and WHEREAS, no written protests of any kind or nature whatsoever were 7 8 9 10 11 12 13 14 15 16 17 I I 18 I 19 I 20 I 21 I i i I 22 I 23 , II 24 I 25 , I I 26 27 28 29 30 31 32 I I :1 1 filed with the City Clerk of the City of San Bernardino prior to 9:30 o'clock . 2 ' A. M. on the 5th day of September, 1961; and 3 WHEREAS, it appears to the Common Council of the City of San Bernardino 4 that the aEoresaid annexation proceedings have been completed and everything 5 performed at this time in accordance with said Government Code, as mentioned 6 hereinbefore, and any and all other laws in any way connected with the said annexation procedure having been complied with; and WHEREAS, the Common Council of the City of San Bernardino desire to approve at this time the annexation of the aforesaid territory. NOW, THEREFORE, THE COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DOES HEREBY ORDAIN AS FOLLOWS: SECTION ONE: That said territory herein described as Annexation District No. 138 is hereby annexed and incorporated in and made a part of the City of San Bernardino. SECTION TWO: The territory herein referred to as being annexed to the City of San Bernardino is particularly described as follows, to wit: Lots 15 and 16 and those portions of Lots 2, 10 and 14 of Block 54, according to the Map of Rancho San Bernardino, as shown on the plat thereof recorded in the Recorder's Office in Book 7 of Maps, at page 2, Records of San Bernardino County, more particularly descirbed as follows to wit: Beginning at the Northeast corner of said Lot 15, also being on the present corporate limits of the City of San Bernardino; thence Southerly along the East line of said Lot 15 to its intersection with the Westerly prolongation of the Northerly line of that certain property conveyed to the Smith Packing Company by deed recorded January 24, 1957 in Book 4139, Page 89 of Official Records of said County; thence Easterly along said Westerly prolongation and Northerly line of said Smith Packing Company's pro- perty and continuing Easterly along the Easterly prolon- gation of said North line of said Smith Packing Company's property to its intersection with the centerline of South "E" Street, 82.50 feet wide; thence Southerly along said centerline of South "E" Street to a point; said point being 236 feet North of the intersection of the centerline of Colton Avenue (also known as "F" Street) and the centerline of South "E" Street; said point being described in the deed to The Riverside Water Company recorded January 6, 1914, in Book 532 of Deed, at page 206; thence South 480 40' West 362 feet more or less to said centerline of Colton Avenue as delineated on Licensed Land Surveyor's Map recorded May 28, 1940 in Book 4 at page 12, Records of Survey; thence Westerly along said centerline of Colton Avenue to its intersection with the Southerly prolongation - 2 - 'I I 1 of the West line of said Lot 10; thence Northerly along said Southerly prolongation and the West line of said Lot 10 to the Southeast corner of said Lot 16; thence Westerly along the South line of said Lot 16 to the Southwest corner thereof; thence Northerly along the West line of said Lot 16 to the Northwest corner thereof; also being on the present corporate limits of the City of San Bernardino; thence Easterly along the North line of said Lot 16 and 15 and said present corporate limit line of the City of San Bernardino to the point of beginning. . 2 3 4 5 6 7 SECTION THREE: That the above described property will be subject to 8 taxation equally with the property within such municipal corporation to pay 9 its proportion of the following bonded indebtedness of the City of San 10 Bernardino, which said bonded indebtedness was outstanding or theretofore 11 authorized and is outstanding at the time of said annexation, to wit: 12 A bonded indebtedness of $275,000.00 incurred for the acquisition 13 and construction of water works, including "Devil Canyon Water Works", water 14 rights, rights of way, pipe lines, wells and pumping plants, the outstanding 15 indebtedness thereon being $20,625.00, bearing interest at the rate of 16 5% per annum; 17 A bonded indebtedness of $490,000.00 incurred for the acquisition 18 and construction of a public library, including additions to and enlargement 19 of the public library system of said City, the outstanding indebtedness thereon 20 being $450,000.00, bearing interest at the rates of 4 3/4%, 3 1/4% and 3 1/2% 21 per annum. 22 23 of Ward 3, and the boundaries of Ward 3 are hereby altered to include said SECTION FOUR: The property herein annexed is declared to be a part 24 annexed territory; and said property is placed and declared to be in ''Q'' 25 Open Zone. 26 27 ordinance and shall cause the same to be published three consecutive times, SECTION FIVE: The City Clerk shall certify to the passage of this 28 exclusive of holidays, in the San Bernardino Evening Telegram, a daily 29 newspaper designated for that purpose. 30 31 32 - 3 - 1 2 I , 3 I 4 ! 5 6 7 8 9 10 ,I I 11 I I 12 13 14 15 16 17 18 19 20 21 II I .
