HomeMy WebLinkAbout2397 / 1 ORDINANCE NO. c:? c::fJ '7,1 AN ORDINANCE OF THE CITY OF SAN BERNARDINO CREATING THE POSITION OF ADMINISTRATIVE OFFICER, ESTABLISHING DUTIES THEREFOR AND REPEALING ORDINANCE NO. 1829. . 2 3 4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNAR- DINO DO ORDAIN AS FOLLOWS: 5 6 SECTION ONE: There is hereby created the position of 7 Administrative Officer to the Mayor and ~on Council, which 8 position may be designated as "Administrative Officer". 9 SECTION TWO: The Administrative Officer shall be 10 chosen on the basis of administrative and executive ability. He 11 shall have at least five years of experience in responsible 12 executive or administrative positions and shall possess the 13 ability to plan and execute the policies and programs of the 14 Mayor and Common Council, including budgeting, budgetary control 15 and the coordination of various City activities. He shall become 16 and remain a resident of the City of San Bernardino during his 17 tenure of office. He shall devote his entire time to the duties 18 of his office and shall not engage in any other business or 19 occupation. 20 SECTION THREE: The Administrative Officer shall be 21 appointed by and serve at the pleasure of the Mayor and Common 22 Council. He may be discharged by a vote of four-fifths of the 23 Common Council and his appointment terminated upon written notice U to him of such discharge and termination. The Administrative 25 Officer shall give the Mayor and Common Council not less than U thirty days' written notice of his intent to resign. 27 SECTION FOUR: The salary of the Administrative Officer 28 shall be fixed annually by 1=he Mayor and Common Council and it 29 shalL,be paid in the same manner as the salaries of other City ~ employees. He is granted and is entitled to all of the benefits 31 conferred upon City employees relating to sick leave, vacation 32 leave, holidays, medical and hospital insurance, workmen'scompensa 'io' -1- 22 23 24 25 26 ?:7 28 29 30 31 32 1 and travel expense, and by the State Employees' Retirement System. . 2 SECTION FIVE: The Administrative Officer may employ 3 assistants and assign to them various duties prescribed in this 4 Ordinance. The positions for such assistants shall be created 5 by the Mayor and Coumon Council and the appointments to and the 6 employments thereunder shall be provisions of the City Civil 7 Service Rules and Regulations. 8 SECTION SIX: Under the supervision of the Mayor and Common Council, and subject to the approval and direction and control thereof, the Administrative Officer shall be responsible for the performance of such duties and ministerial functions as may be placed in his charge by the Mayor and Common Council, and in connection therewith, shall report to the Mayor and Common Council from time to time the status and enforcement of the Mayor and Common Council's policies, rules and regulations, and in this connection, shall supervise and direct the activities of financing, 9 10 11 12 13 14 15 16 17 purchasing and personnel. The Administrative Officer shall: 18 (a) Attend all meetings of the Mayor and Common Council except when excused therefrom, and advise and make recommendations to the Mayor and Common Council upon matters which are brought before them and which are within his administrative authority; (b) Coordinate the work of departments and agencies which are under the direct jurisdiction or fiscal control of the Mayor and Coumon Council. In this connection, the Administrative Officer may require periodic submission of organizational charts and departmental activity reports; inform departments on actions, decisions and policies of the Mayor and Common Council affecting 19 20 21 department operations; (c) Subject to rules, regulations and ordinances of the Mayor and Common Council, cause to be prepared and submitted requests for the creation of new positions and capital outlay items. He may request such information, charts and statistics -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 ~ 21 22 23 ~ 25 ~ n ~ ~ ~ 31 32 as ~y be necessary for his recommendations; (d) Supervise in cooperation with the Finance Officer the preparation of the annual City Budget. In the performance of this duty, the Administrative Officer shall review all depart- mental and agency requests and all items in the proposed budget, including revenues, expenditures and reserves. He shall submit his recommendauion on the proposed budget to the Mayor and Common Council; (e) Review all departmental and agency requests for adjustments and transfers of budget funds and shall make recomm- endations concerning them to the Mayor and Common Council; (f) On behalf of the Mayor and Common Council, recomm- end adjustments between accounts of the maintenance and operation and capital outlay appropriations of individual City departments and agencies, provided that such adjustments do not increase the totals of the amounts budgeted for such categories of expenditure~ (g) Exercise general supervision over the Public Build- ings of the City of San Bernardino with the exception of those under jurisdiction of the Municipal Water Department and the Free Public Library Board; (h) Maintain continuous research into administrative practices, study and make recommendations to the Mayor and Common Council concerning such changes or modifications as will improve the efficiency and economy of City governmental operations; (i) Be responsible for the City Insurance Policies and shall supervise the recovery of any claims against such policies; U) In cooperation with City departments and agencies, the Administrative Officer shall develop work measurement, process organization and procedures programs and operating manuals; (k) Promote proper preparation and dissemination of periodic reports and informative pamphlets or brochures; -3- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 (1) The Administrative Officer shall recommend to the . Mayor and ComIIlon Council the adoption of new and revised orders and resolutions when in his judgaent such action will prOlllote improved City services and operations and are in the public interest; (m) Make such other investigations, studies and surveys and perform such other duties as may be ordered by the Mayor and Common Councilor as deemed necessary. SECTION SEVEN: The Administrative Officer may call upon any officer, or head of any department, institution or dis- trict under the control or jurisdiction of the Mayor and Common Council to provide information and to assist in carrying out the policies and orders of the Mayor and Common Council and the duties herein vested intthe Administrative Officer. SECTION EIGHT: No provision of this Ordinance is in- tended to vest in the Administrative Officer any duties or grant to him any authority which is vested by general law or by the Charter of the City of San Bernardino in the Mayor and Common Councilor in any other City department, officer, board, comm- ission or employee. SECTION NINE: Ordinance No. 1829 is hereby repealed. All Ordinances or parts of Ordinances or Resolutions or parts of Resolutions in conflict herewith are hereby repealed. SECTION TEN: If any section, sub-section, paragraph, sentence, clause or phrase of this ordinance is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portion or provision of this ordinance.
