AN ORDINANCE OF THE CITY OF SAN BERNARDINO PROVIDING FOR
3 THE PROTECTION OF THE PUBLIC HEALTH AND SAFETY, AND THE EXAMINATION,
REGISTRATION, AND LICENSING OF PERSONS ENGAGED IN THE BUSINESS OF
4 PLUMBING, OR LABORING AT THE TRADE OF PLUMBING, OR WITH GAS AND
DRAINAGE SYSTEMS; CREATING A BOARD OF PLUMBING EXAMINERS AND PRES-
5 CRIBING ITS DUfIES AND THE DUfIES OF THE PLUMBING EXAMINER AND
THE PLUMBING INSPECTOR; ESTABLISHING MINIMUM REGULATIONS FOR THE
6 INSTALLATION, ALTERATION OR REPAIR OF PLUMBING, GAS AND DRAINAGE
SYSTEMS AND INSPECTIONS THEREOF; PROVIDING PENALTIES FOR VIOLA-
7 TIONS; ADOPTING AND ESTABLISHING RULES AND REGULATIONS FOR THE
INSTALLATION. ALTERATION AND REPAIR OF PLUMBING, GAS AND DRAINAGE
8 SYSTEMS AND RELATED MATTERS; ADOPTING THE UNIFORM PLUMBING CODE,
1961 EDITION; AND REPEALING ORDINANCE NO. 2234.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
10 DO ORDAIN AS FOLLOWS:

SECTION ONE: This ordinance shall be known as the "UNIFORM
12 PLUMBING ORDINANCE."

SECTION TWO: Those certain rules and regulations which
provide for and govern the installation, alteration and repair of
plumbing, gas and drainage systems and the inspections thereof,
the examination, registration and licensing of persons engaged in
the business of plumbing, or laboring at the trade of plumbing or
with gas and drainage systems in the City of San Bernardino, the
creation of a Board of Plumbing Examiners and prescribing its duties
and the duties of the plumbing examiner and the plumbing inspector,
and the penalties for violations thereof, as set forth in that
certain code printed in book form, and entitled "Uniform Plumbing
Code, 1961 Edition", as prepared and promulgated by the Western
Plumbing Officials Association, three (3) copies of which code
have heretofore been filed with and are now on file in the office

of the City Clerk of the City of San Bernardino, and which copies
are identified by certificates attached thereto, reading substan-
tially as follows:

be and the same are hereby established as rules and regulations
and a code of said city; and each and every part of said code,
and each and every provision therein contained, is hereby referred

8 to and designated as the "Uniform Plumbing Code, 1961 Edition,"

and is hereby adopted and made a part hereof as though fully set
forth at length in this ordinance.
SECTION THREE: The following sections and provisions of
the Uniform Plumbing Code, 1961 Edition, are hereby amended to
read as follows:
Section 1.1 ADMINISTRATIVE AUTHORITY AND ASSISTANTS. When-
ever the term "administrative authority" is used in this code it
shall be construed to mean the Chief Plumbing Inspector or his
authorized representative.
Section 1.2 ASSISTANTS. Whenever the term "assistants"
is used in this code it shall be construed to mean the Plumbing
Inspectors.
Section 1.3 DEPARTMENT HAVING JURISDICTION. Unless other-
22 wise provided for by law, the office of the Administrative Auth-
23 ority shall be part of the Department of Building and Safety.

Section 1.7 VIOLATIONS AND PENALTIES. Any person, firm
or corporation violating or causing or permitting the violation
of any of the provisions of this code or ordinance shall be deemed
guilty of a misdemeanor and upon conviction thereof shall be punis -
able by a fine of not to exceed Five Hundred Dollars ($500.00) or
by imprisonment in the City Jail for not to exceed Six (6) months,
or by both such fine and imprisonment. Each separate day or any
portion thereof during which any violation of this code or ordin-
ance occurs or continues shall be deemed to constitute a separate

1 offense, and upon conviction thereof shall be punishable as herein

2 provided.
3 The issuance or granting of a permit or approval of plans
4 and specifications shall not be deemed or construed to be a permit
5 for, or an approval of, any violation of any of the provisions of
6
this code.
No permit presuming to give authority to violate or
7
cancel the provisions of this code shall be valid, except insofar
as the work or use which it authorizes is lawful.
The issuance or granting of a permit or approval of plans
shall not prevent the Administrative Authority from thereafter
requiring the correction of errors in said plans and specifications
or from preventing construction operations being carried on there-
under when in violation of this code or of any other ordinance or
from revoking any Certificate or Approval when issued in error.
Every permit issued by the Administrative Authority under
the provisions of this code shall expire by limitation and become
null and void, if the work authorized by such permit is not commenc d
within sixty (60) days from the date of issuance of such permit, or
if the work authorized by such permit is suspended or abandoned at
any time after the work is commenced for a period of sixty (60)
days. Before such work can be recommenced a new permit shall be
first obtained so to do.
~en work for which a plumbing permit is required by this
ordinance is started or proceeded with prior to obtaining said
permit, the fees specified in the Uniform Plumbing Code shall be
doubled, but the payment of such double fee shall not relieve any
person from fully complYQDg with the requirements of this code in
the execution of the work nor from any other penalties prescribed

Section 2.4 APPOIN'lMENT OF BOARD OF EXAMINERS. The Board
of Plumber Examiners shall be under the Department having juris-
diction provided for by law or the charter provisions and unless
otherwise provided for shall cOnStst of five (5) members having
thereon no less than two (2) qualified Plumbing Contractors
and no less than two (2) qualified Journeymen Plumbers and one
member of the Plumbing Department to act as secretary.
The Board shall be appointed by the authority empowered
to appoint such boards upon the taking effect of this code.
The members of said Board shall serve for two (2) years,
unless sooner removed for malfeasance in office, neglect of duty
Qt: incapacity.
Section 2.6 APPLICATION FEE. Every person applying for
a Plumber's Certificate of Qualification or Registration shall
pay to the secretary of the Board of Plumber Examiners at the
time he makes such application the following fees:
(a) Journeyman Plumber's Certificate. . .$3.50
Section 2.9 EXPIRATION OF CERTIFICATES OF QUALIFICATION
OR REGISTRATION. Every Certificate of Qual-

1 ific~ion or Registratio~ shall remain in force and effect until
2 its expiration date unless cancelled or revoked.
3 (a) Journeyman Plumber's Certificate of Qualification or
4 Registration shall expire on December 31st of each year.
5 Section 2.10 FEES FOR RENEWAL OF CERTIFICATES OF QUALIFIC-
ATION OR REGISTRATION. All Plumber Certific-

ates of Qualification, except Certificates which have been cancelle
or revoked, may be renewed from year to year upon request and pay-

~ent of the required renewal fee.
If a renewal of a Certificate be

requested and the required fee paid within 30 days of the expir-
ation date of such Certificate, the renewal fee shall be $1.00.
If such renewal be requested and the required fee paid more than
30 days, but less than 90 days after the expiration date of such

Certificate, the renewal fee shall be $2.00.
If such renewal be

requested and the required fee paid more than 90 days after the
expiration date of such certificate, the fee shall be $3.50 and the
Board of Plumber Examiners may require the applicant to make out a I
new application and take an examination, or the Board may at its
discretion renew the expired Certificate.
Section 702 (c) Each waste outlet for a plumbing fitting
that requires roughing in above floor shall be immediately in the
rear of the fixture trap and no concealed change of direction or
offset shall be installed between any such fixture trap and its
vent. Any exposed fitting installed between a trap and its vent
shall be so located as to be readily removable for cleaning purpose .
This is to eliminate blockage as much as possible in trap arms.
SECTION FOUR: Said Uniform Plumbing Code is hereby amended
by deleting therefrom the following sections, sub-sections and pro-
visions:

by adding thereto the sections and sub-sections hereinafter set
forth to read as follows:

Section 1.15 LIABILITY OF CITY OFFICIAL OR EMPLOYEE.
Neither this Ordinance nor the said Uniform Plumbing
Code shall be construed as imposing upon the City of San Bernardino
any liability or responsibility for damage from defective plumbing
or drainage system, or the installation thereof, nor shall the City
of San Bernardino, or any official or employee thereof be held as
assuming any such liability or responsibility by reason of the in-
spection authorized thereunder.

Section 1.16 SUBSTANCES OR EQUIPMENT POLLUTING WATER.
No person shall advertise, sell or offer for use or
sale, any water-treating chemical or substance, water-using or
water-treating chemical or substance, water-using or water-
operated equipment, mechanism or contrivance, if the Health Officer
finds that the use of such chemical or substanc~ equipment, mech-
anism or contrivance may cause contamination or pollution of the
domestic water system. Such devices may be permitted when equipped
with back-flow protection meeting the requirements of the Uniform
Plumbing Code.
Section 1.2 (a) QUALIFICATIONS. Each inspector shall be
a practical plumber having not less than two (2) years experience
as a journeyman plumber.
Section 1.71 \~ere work for which a permit is required by
this code is completed prior to the issuance of said permit, an
additional fee of ten (10) percent of the cost of the project, or
the sum of $200.00, whichever is less, shall be paid, and it shall
be the duty of the Chief Plumbing Inspector to levy and collect
said additional fees. The payment of such fee shall not relieve
any persons or firms from fully complying with other provisions
of this code or from any other penalties prescribed herein.
Section;403 (c) The minimum size for the building drain
installed in any cOImllercial construction shall be 4" in size.
Section 410 HOUSE DRAINS SHALL CONNECT TO ONE OUTLET.

1 . In a single family dwelling all plumbing drains shall
2 connect to one outlet. Such outlet shall not exceed ninety (900)
3 degrees from the direction of the closest public sewer or if there'
4 is no public sewer then from the proposed public sewer. If more
5 than one stub-out is used, the contractor installing the plumbing
6 shall connect all such stub-outs to each other so that there shall
7 be one outlet. The materials used shall be as required elsewhere
8
in this code.

SECTION FIVE:
The word "City" in the aforesaid sections

and code shall be deemed to refer to and designate the City of
San Bernardino, and any reference to any act or legislative enact-
ment therein referred to shall be deemed to designate and embrace
the statutes of the State of California, and amendments thereof,
dealing with the subject matter thereby and therein referred to.

SECTION SIX: REVOCATION. The Mayor and Coumon Council of
the City of San Bernardino shall have the power, upon recommend-
ation of the plumbing inspector, to suspend or revoke the license
of any person violating the terms and provisions of said plumbing
code, provided that such suspension or revocation shall not be
ordered by aid Mayor and COIIIIlon Council without first holding a
public hearing thereof and without giving reasonable notice of suc
hearing to the person, firm or corporation so charged with said
violation.
SECTION SEVEN: If any section, sub-section, sentence,
clause or phrase of this Ordinance or said code is for any reason
held to be invalid or unconstitutional by the decision of any
court of competent jurisdiction, such decision shall not affect
the validity of the remaining portions of said Ordinance or code.

The Mayor and Common Council of the City of San Bernardino hereby
.
declare that they would have passed said ordinance and code, and
each section, sub-section, sentence, clause and phrase thereof,
irrespective of the fact that anyone or more other sections, sub-
sections, clauses or phrases be declared invalid or unconstitutiona .
SECTION EIGHT: Ordinance No. 2234 is hereby repealed.
