"AND PROVIDING FOR THE COLLECTION AND DISPOSAL OF RUBBISH. d 1'1 THE MAYOR AND Cct1MON COUNCIL OF THE CITY OF SAN BERNARDINO 5 i DO ORDAIN AS FOLLOWS: 1 2 3 6 SECTION ONE: Ordinance No. 1698, Section Eight, is hereby 7 amended to read as follows: 8 SECTION EIGHT: That no person, firm or corporation, except 9 the City Rubbish Collector or a person, firm or corporation having 10 the requisite license and permit provided for in Section Eight and 11 One-Half of this Ordinance shall remove rubbish from any place or 12 premises in the City of San Bernardino or conveyor transport the 13 same over the public highways thereof, except that any person, firm 14 or corporation in the lawful possession of any property, other than 15 a place of.. business, may collect and remove therefrom, and in a 16 vehicle owned or lawfully possessed by him, transport any rubbish 17 naturally accumulating upon such property so owned or lawfully 18 possessed by him. 19 SECTION TWO: Ordinance No. 1698, Section Eight and One- W Half, is hereby amended to read as follows: 21 SECTION EIGHT AND ONE-HALF: It is unlawful for any person, 22 firm or corporation, except an agent or employee of the City of 23 San Bernardino, or a person, firm or corporation excepted under ~ Section Eight hereof, or a person, firm or corporation possessing 25 the requisite business license and having obtained from the Mayor 26 and Common Council upon the recommendation of the Superintendent of 27 the Refuse Disposal Department a permit to collect rubbish in 28 accordance with the rules and regulations of the Refuse Disposal 29 Department as approved by the Mayor and Common Council, ca: except 30 a person, firm or corporation having a contract awarded pursuant to Section Twelve, infra, to collect, remove or dispose of rubbish within said City; provided that a person, firm or corporation, 31 32 \ ~ 1 having obtained said business license and permit, may collect, . 2 remove and dispose of rubbish only from the following locations: 3 I (1) motels, apartment buildings and gasoline service stations, ~ 4 II (2) the back yards of residential dwellings and buildings in re- s ,I sidential zones and,(3) business, commercial and manufacturing es- 6 tablishments within the business districts. Business, commercial and manufacturing establishments as used herein shall mean those business, commercial and manufacturing establishments within the business districts, as hereinafter defined whether located inside or outside said City, which are being served by said person, firm or corporation at the time of the adoption of this amendment. Business districts for the purpose of this ordinance are defined to be the following districts and land use zones: C-l, Neighborhood Commercial District C-2, Community Commercial District C-3, General Commercial District C-3-A, Limited General Commercial District C-4, Central Business District C-M, Commercial - Manufacturing District M-l, Light Manufacturing District M-2, General Manufacturing District 7 8 9 10 11 12 13 14 15 16 17 18 19 The rubbish accounts of business, commercial and manufactur ing establishments which are being served by a person, firm or corporation at the time of the adoption of this amendment may con- tinue to be served by said person, firm or corporation so long as he or it is continuously in business and complies at all times with each and every provision of this ordinance and of the rules and regulations of the Refuse Disposal Department. Said accounts may not be sold, transferred or renewed and shall terminate per- manently when service is discontinued for any reason. Said person, firm or corporation desiring to continue to service said accounts shall register in the Office of the Superintendent of the Refuse Disposal Department and. shall provide names, addresses and other " ~ 21 22 23 ~ 25 26 ~ 28 ~ ~ 31 relevant data pertaining to said accounts as may be required by said Superintendent or the Rules and Regulations of said Department 32 -2- 1 2 3 ,I 411 5 ,I 611 7 8 91 , 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 ~ within thirty days from and after the effective date of this amend- . ment. SECTION THREE: Ordinance No. 1698 is hereby amended by adding thereto Section Eleven and One-Half to read as follows: SECTION ELEVEN AND ONE-HALF: No battery acid, poisonous, caustic or toxic material or other substance capable of damaging clothing or causing injury to the person shall be mixed or Placed. I with any J:Dil&:UIh or garbage which is to be collected, removed or dU., posed of by the City Rubbish Collector, City Garbage Collector or other duly qualified and licensed person, firm or corporation.
