I AN ORDINANCE OF THE CITY OF SAN BERNARDINO ADOPTING AND 3 I ESTABLISHING RULES AND REGULATIONS FOR ELECTRICAL INSTALLATIONS WITHIN THE CITY OF SAN BERNARDINO; ADOPTING THE UNIFORl1 ~nRING CODE, 4 1961 EDITION, FOR THE PURPOSE OF REDUCING THE PERSONNEL AND FIRE I HAZARD FROM ELECTRICAL CAUSES; PROVIDING A MINIMUM STANDARD FOR 5 ELECTRICAL INSTALLATIONS; PROVIDING FOR RELATED MATTERS AND REPEAL- ING ORDINANCE NO. 2057~AND SECTIONS 16(B)AND(C)OF ORDINANCE NO.19Il. THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO 7 DO ORDAIN AS FOLLOWS: ORDINANCE NO. ~'1~ S2... 6 8 SECTION ONE: This Ordinance shall be known as the "Uniform 9 Wiring Ordinance". 10 SECTION TWO: Those certain rules and regulations which 11 provide for electrical installation and which apply to all wiring 12 and equipment installed, used, maintained, rented, leased, offered 13 for sale, or distributed for use, as set forth in that certain code I 14 printed in booklet form, and entitled "Uniform Wiring Code, 1961 15 Edition", as prepared and promulgated by the Code Committee of the 16 Southern California Chapter of the International Association of 17 Electrical Inspectors, three (3) copies of which code have hereto- 18 fore been filed with and are now on file in the office of the City 19 Clerk of the City of San Bernardino, and which copies are identified 20 by certificates attached thereto, reading substantially as follows: 21 "I, Jack T. Felton, hereby certify that the three annexed 22 copies of the code entitled "Uniform wiring Code, 1961 Edition", 23 were filed in the office of the City Clerk of the City of San Ber- 24 nardino on the 2nd day of February, 1962, and are true, correct and 25 complete copies of said Code which is'sought to be adopted by re- 26 ference by ordinance of the Mayor and Common Council of said City. 27 28 29 JACK T. FELTON City Clerk of the City of San Bernardino," 30 be and the same are hereby established as rules and regulations and 31 a Code of said City; and each and every part of said Code, and each 32 and every provision thereof are hereby referred to and designated C_Ul 1 and adopted by reference as the "Uniform Wiring Code, 1961 Edition", 2 and are made a part hereof as fully as though set forth at length 3 I in this ordinance. 4 SECTION THREE: The following sections and provisions of 5 the Uniform Hiring Code, 1961 Edition, are hereby amended to read 6 as follows: 7 Section 20.1 PERMITS. No electrical equipment shall be in- 8 stalled within or on any building, structure or premises, publicly 9 or privately owned, nor shall any alteration or addition be made 10 in any such existing equipment without first securing a permit 11 therefor from the Electrical Safety Engineer, except as provided 12 in Section 20.2, and except that no permit will be required to 13 execute any of the classes of electrical work specified in the 14 following Sections 20.3 and 20.4. 15 Each General or Electrical Contractor shall submit a 16 complete set of engineered electrical plans, showing in detail 17 service requirements, and all other electrical equipment to be 18 used in any building or premises. 19 The foregoing shall apply to all industrial, commercial, 20 semi-commercial, and apartment services when such service exceeds 21 200 amperes. 22 The plans shall be in the possession of the Electrical 23 Inspection Department before an electrical permit will be issued an 24 before the contractor may start work and they shall have both the 25 approval of the serving utility and the Electrical Safety Engineer. 26 Section 30.4. CO}WffiRCIAL, INDUSTRIAL, ASSID'ffiLY BUILDINGS 27 AND ALL ALTERATIONS. Use regular Fee schedule, provided that not- 28 withstanding any other provision to the contrary in Section 30.5 29 of the Uniform Wiring Code, all commercial and industrial type 30 services shall have a minimum fee of $1.00, plus an additional 31 one-half cent per ampere, and plus $1.00 for each sub-panel. The 32 foregoing applies to both single phase and three phase services. _"J_ ",... I I I, 1 Section 100.3 (A) LOCATION OF BRANCH CIRCUIT PROTECTIVE 2 DEVICES. Branch circuit protective devices shall be installed in 3 and for each occupancy. Nothing contained in this Cha~er shall be 4! deemed or construed to permit the installation of any electrical 5 device or circuit in any occupancy the control or protection of 6 which is not accessible to the occupant at all times. In re- 7 modeled existing occupancies, wherein the occupancy is changed 8 to a different classification, protective devices may be located 9 at one central point. No parts of any circuit shall supply e1ec- 10 trica1 energy to more than one occupancy. 11 PANEL LOCATIONS. Branch circuit distribution panels shall 12 not be located in any clothes, linen, or broom closets. 13 (B) REFRIGERATION, AIR CONDITIONING, COMMER- 14 CIAL, INDUSTRIAL AND RESIDENTlM.. All compressors, air handlers, 15 and packaged typed air conditioning units installed in exposed 16 areas shall be of approved rain-tight equipment. There shall be 17 placed on the unit or immediately adjacent a disconnect switch 18 for the purpose of disconnecting all ungrounded conductors. 19 Some manufacturers install, at the factory, a built-in disconnect- 20 ing breaker and the same is approved and accepted by orders govern- 21 ing this code. 22 (C) EVAPORATIVE COOLERS. All evaporative 23 coolers installed on the roof shall have on the unit, an externally 24 operated switch and shall be of rain tight equipment, one circuit 25 for the blower and one circuit for the pump. The cable shall be 26 of 3 conductor #18 and #16 AWG. Both blower and pump motor shall 27 be grounded with the green conductor, serving as the equipment 28 ground. 29 (D)ATTIC FURNACES. There shall be placed on 30 the unit or immediately adjacent an approved disconnecting switch 31 or mu1tibreaker. The fused switch shall contain type(s) fuses, 32 not to exceed 15 amperes unless motor ratings require fuses or -3- 1 breakers of higher amperage. All conductors shall be encased in . rigid ferrous metal conduit, rigid non-ferrous metal conduit, or flexible conduit. Types(s)(sj)(so) cable is not approved for this type of installation. SECTION FOUR: Said Uniform Wiring Code is hereby amended by adding thereto the sections, sub-sections and paragraphs herein- after set forth to read as follows: Section 150.28. All service poles for permanent or tem- porary service shall comply with rules of the Public Utilities Commission, Electrical Safety Orders, and the Uniform Wiring Code, and shall be located where approved by the Electrical Safety Eng- ineer, and the serving agency. Section 150.29. Temporary serving poles used for con- struction work, Christmas tree lots and other uses, shall consist of the following: An approved rain-tight switch or breaker panel with type (s) fuses or circuit breakers of the proper size. No branch cir- cuit shall exceed 20 amperes. Minimum service raceways shall be not less than 3/4" trade in size and of No. 8 A'WG conductors. Section 150.30. Temporary services for Christmas tree lots shall be the same as Sections 150.28 and 150.29 with the following requirements: Secondary poles shall be 4"x4"x4"x15' pine set to a depth of 30" extending 12' above grade. IDsulators must be placed on the sides of the pole, near the top or on a 2"x4"x18" cross arm. Feeder wires shall be of #12 AWG (Minimum) and must be secured at the insulators by a suitable insulated tie wire. Pigtail sockets may be used for both solid and stranded wire. When pin-type sockets are used, stranded wire is mandatory. Other methods may be used with written permission from the Electrical Safety Enginee . Section 150.31. WIRING METHODS FOR OVERHEAD SERVICES. ENTRANCE CONDUCTORS. All entrance con- 5 ductors used for service on commercial, industrial, and residential 6 buildings shall be copper conductors. 7 Section 150.33. No structure of any nature shall be attach 8 ed to a permanent building directly beneath an existing service 9 drop or where the same will interfere with any service entrance 10 equipment. Services not in conformity herewith shall be relocated 11 to suitable locations, with the approval of both the serving utilit 12 and the Electrical Safety Engineer. 13 Section 150.34. All underground entrance conductors shall ~ be copper conductors. 21 Section 150.36. No swimming pool shall be constructed directly beneath an existing service drop, unless the service en- trance conduit and service entrance conductors can be extended to 22 23 24 a location where the service drop will not be above the pool area. ~ The point of attachment shall be in an approved location. ~ If this method is not practical in the opinion of the Elec- 27 trical Safety Engineer the service shall be relocated to a suitable location where it shall have the approval of both the serving utility and said Engineer. 28 29 30 Section 350.2. Each person, firm,or corporation, taking 31 out a permit for an electrical installation in any building or project shall do so at least one day prior to the start of actual 32 -5- 1 2 3 4 5 6 7 8 ! 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 con~truction. ~ere work for which a permit is required by this Code is completed prior to the issuance of said permit. an addition al fee of 10% of the cost of said installation or a fee in the sum of $100.00. whichever iw less. shall be paid to the Department of Building and Safety. It shall be the duty of the Electrical Safety Engineer to levy and collect said additional fee. The payment of such fee shall not relieve any person. firm. or corporation from complying with other provisions of this Code or from other penalties or fees prescribed herein or by other laws. The Electrical Safety Engineer shall keep a permanent accurate account of all fees and other monies collected and received under this Code. the names of the persons upon whose account the same were paid. the date and the amount thereof together with the locati of the buildings or premises to which they relate. Section 350.3. Any person. firm. or corporation request- ing a final electrical inspection shall notify the Electrical Safety Engineer. If work on said installation is then found by the inspector to be incomplete at the time of inspection so as to re- quire a re-inspection. there shall be assessed a fee of $5.00 as a re-inspection charge. Section 350.4. Any person. firm. or corporation requesting a rough in electrical inspection shall notify the Electrical Safety Engineer. If said installation has not been completed when the in- spection is made and will require re-inspection. there shall be assessed a fee of $5.00 for each re-inspection. Section 350.5. When a rough in electrical installation is found by the inspector to be concealed. or partly concealed. with- out permission from the Electrical Safety Engineer. there shall be assessed a double permit fee. plus a $5.00 inspection charge. This fee shall be assessed against the parties responsible therefor, and shall be in addition to any other fee or penalty prescribed herein. -6- I I I 1 i SECTION FIVE: Said Uniform Wiring Code is hereby amended I . 2 Ii by deleting therefrom the following sections, sub-sections and :3 provisions: 4 5 6 7 Section 70.4 Section 70.7 Section 110.4 Section 150.12 through 150.27 Section 170.5 SECTION SIX: The wordlCity" in the aforesaid sections 8 and code shall be deemed to refer to and designate the City of 9 San Bernardino, and any reference to any act or any legislative 10 enactment therein referred to shall be deemed to designate and em- 11 brace the statutes of the State of California, and amendments there 12 of, dealing with the subject matter thereby and therein referred to 13 II SECTION SEVEN: It shall be unlawful for any person, firm, 14 Ii or corporation to install, use, maintain, alter, repair, rent, 15 lease, offer for sale, or distribute for use, any wiring and equip- 16 ment used for electrical installation in said city, or cause the s e 17 to be done, contrary to or in violation of any of the provisions of 18 I this Code. 19 Any person, firm, or corporation violating or permitting 20 or causing the violation of any of the provisions of this Ordinance 21 I or of the Code adopted herein shall be deemed guilty of a misdemean r, 22 and upon conviction thereof shall be punishable by a fine of not 23 more than Five Hundred Dollars ($500.00), or by imprisonment for a 24 period of not more than six months, or by both such fine and im- 25 prisonment. Each person, firm, or corporation shall be deemed 26 guilty of a separate offense for each day during any portion of 27 which any violation of any provision of this Ordinance or said Code 28 is committed, continued or permitted by such person, firm, or corpo , 29 ation and shall be punishable therefor as provided by this Ordinanc . 30 SECTION EIGHT: If any section, sub-section, sentence, 31 clause or phrase of this Ordinance or said Code is for any reason 32 held to be invalid or unconstitutional by the decision of any court -7- 1 of pompetent jurisdiction, such decision shall not affect the 2 validity of the remaining portions of said Ordinance or Code. The 3 Mayor and Common Council of the City of San Bernardino hereby 4 declare that they would have passed said Ordinance and COde, and 5 each section, sub-section, sentence, clause and phrase thereof, 6 irrespective of the fact that anyone or more other sections, sub- 1 sections, clauses or phrases be declared invalid or unconstitution- 8 al. 9 SECTION NINE: Ordinance No. 1911, Sections l6(B) and (C), 10 and Ordinance No. 2057 are hereby repealed. 11 I HEREBY CERTIFY that the foregoing Ordinance was duly 12 adopted by the Mayor and Common at a /i._ ~ ~A~ 6L da~f - /?~*<!/; Council of the City of San Bernardi 0 meeting thereof, held on the , 1962, by the following vote, 13 14 15 16 to wit: AYES: councilmed~)/~~~ ,a%;;u (/ .
