AN ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING ORDIN-
ANCE NO. 2418 ENTITLED "AN ORDINANCE OF THE CITY OF SAN BERNARDINO
REGULATING FOOD HANDLERS AND BABY SITTERS AND PROVIDING FOR HEALTH
CERTIFICATES."
THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:

SECTION ONE: Ordinance No. 2418, Section One, is hereby
amended to read as follows:

SECTION ONE: (a) Any person who knowingly has cOl1lllll1nicable
tuberculosis, amebiasis, or salmonellosis shall not engage or serve
or seek employment in any work, occupation or employment which re-
quires or occasions the handling of any food, liquid, or material
intended for food or drink for human consumption, or the handling
of any dishes or other articles used in the preparation or service
of food or drink for human consu~t~o~,and no owner, manager, or
agent of such owner, or person in charge of any restaurant, itiner-
ant restaurant, vehicle or vending machine as defined in the
"California Restaurant Act", Chapter 11 of Division 21 of the Healt
and Safety Code, shall retain in the employ thereof for the per-
formance of such services, for a longer period than thirty days,
any person who does not hold and produce a health certificate as
specified in this Ordinance or for any period whatsoever, any per-
son known or reasonably believed to be infected with communicable
tuberculosis, amebiasis, or salmonellosis.
(b) No person who knows that he has cOl1lllll1nicable tub-
erculosis, amebiasis, or salmonellosis shall engage or serve or
seek employment in any work, occupation or employment involving
the care and supervision of a child as a baby sitter, and no employ
er, parent, or person shall retain in employment for the performanc
of such services, for a longer period than thirty days, any person
who does not hold and produce a health certificate as specified
in this Ordinance or for any period whatsoever, any person known

or reasonably believed to have communicable tuberculosis, amebiasis,

(c) The requirement for a health certificate shall ~ot
apply to domestic or household work or to t~mporary, occasional,
.
or intermittent functions of bona fide religious, charitable, or
public service organizations, including fraternal organizations,
veterans' organizations, established youth organizations, parent-
teacher associations and civic or community organizations or groups,
the primary purpose of which is the betterment of the cultural,
social, or economic welfare and environment of the cOUlDlmity when
and where no employee is assigned full time to care for or operate
equipment used in connection with such function, or to work involv-
ing only the immediate family of the worker or to other exclusions
provided for in the California Restaurant Act in reference to the
terms restaurant, itinerant restaurant, vehicle or vending machine.
SECTION TWO: This Ordinance is enacted as an emergency
measure and shall take effect and be in force on March 22, 1962, in
order to protect and preserve the public health, safety and welfare;
in order that cases of carriers of tuberculosis may be immediately
ferreted out; and further in order that this Ordinance shall take
effect at the same time as certain other provisions of Ordinance
No. 2418.
