ORDINANCE NO. t>?f/~,9' AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AMENDING ORDINANCE NO. 2048 ENTITLED, "AN ORDINANCE OF THE CITY OF SAN BERNARDINO PROVIDING FOR THE CONDUCTING OF THE PRIMARY AND GENERAL ELECTIONS TO BE HELD ON EACH ODD NUMBERED YEAR IN THE CITY OF SAN BERNARDINO PURSUANT TO SECTION TEN OF THE CHARTER OF THE CITY OF SAN BERNARDINO, CALIFORNIA". THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: SECTION ONE: That Ordinance No. 2048, Section One, is hereby amended to read as follows: "SECTION ONE: That a primary election shall be held on the first Tuesday in February, 1963 and a like election shall be held on the first Tuesday in February every four years thereafter, in the City of San Bernardino for the nomination of candidates for the following offices: 1. Mayor; 2. Member of the City Council from the Third Ward; 3. Member of the City Council from the Fifth Ward; 4. City Clerk; 5. City Treasurer; 6. City Attorney." SECTION TWO: That Ordinance No. 2048, Section Two, is hereby amended to read as follows: "SECTION TWO: That a primary election shall be held on the first Tuesday in February, 1965 and a like election shall be held on the first Tuesday in February,eva6y four years thereafter, in the City of San Bernardino for the nomination of candidates for the following offices: 1. Mayor; 2. Member of the City Council from the First Ward; 3. Member of the City Council from the Second Ward; 4. Member of the City Council from the Fourth Ward. That the members of the Council shall be nominated for the respective offices as provided by the Charter of said City of San Bernardino, that is to say, that said members of said Council shall be nominated from each of the following wards by the qualified electors of said wards r~8pectively, to wit: 1 2 3 4 5 6 I' 7 " 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 The first, second, third, fourth and fifth wards." . SECTION THREE: That Ordinance No. 2048, Section Three, Sub-sections (a), (c), (d), (f) and (g) are hereby amended to read as follows: "SECTION THREE: (a) That said primary elections shall be held in accordance with the provisions of Part 1, and Chapters 1 and 2 of Part 2 of Division XII of the Elections Code, except as otherwise set forth in this Ordinance. (c) That nomination papers for the following respective offices shall be signed by voters of the area for which the candidate is to be nominated as follows, to wit: Mayor, City Clerk, City Treasurer and City Attorney: Not less than twenty (20) voters, nor more than thirty (30) voters; and Councilmen: Not less than fifteen (15) voters, nor more than twenty-five (25) voters. (d) Any candidate for a City office who at a primary election shall receive a majority of all the ballots cast for candidates for the office for which such candidate seeks nomination, shall be elected to such office. (f) Filing fee. The City Clerk shall supply all forms required for nominations and election to all City offices. Such forms shall be distributed without charge to all such candidates applying therefor; provided, however, that such forms shall not be distributed except upon the prepayment of the filing fees. The filing fee for any office shall be two per cent of the first year's salary for the office for which the candidate is issued papers. No nomination papers shall be issued or filed except upon proof of said prepayment. The filing fee shall not be refunded in the event the candidate fails to qualify as a candidate. (g) The City Clerk is authorized to issue to each candidate one list of the registered voters residing within the district in which the candidate is running for office. Such lists shall be furnished by the City Clerk pro~tly after the closing of nominations, and as soon as such lists are made available by the Registrar of Voters of the County of San Bernardino." SECTION FOUR: That Ordinance No. 2048, Section Five, is hereby - 2 - 10 11 12 13 1 I 2 ;1 all 4 i' I 5 I amended to read as follows: # "SECTION FIVE: That the hour of seven o'clock A. M. on the date of said elections is hereby fixed as the hour for opening the polls, and the hour of seven o'clock P. M. of said date is hereby fixed as the hour for closing the polls at such elections; provided, however, that if at said hour of 6 closing there are any other voters in the polling places or in line at the door 7 thereof who are qualified to vote and who have not been able to do so since 8 appearing, the polls shall be kept open a sufficient time to enable them to 9 vote, but no one who shall arrive at a polling place after seven o'clock P. M. shall be entitled bo vote, although the polls may be open when such person arrives. That primary and general elections shall be held at the regularly designated polling places in each precinct as designated in the Resolution setting forth the number of consolidated precincts and the location of each 14 polling place. The officers of election appointed and the polling places 15 designated for the primary election shall be the officers and polling places of 16 the general election so far as possible. Said Resolution shall also set forth 17 the list of the names of the election officers appointed. Each precinct board 18 shall consist of one (1) Inspector, one (1) Judge and three (3) Clerks. 19 Not earlier than the seventy-fifth nor later than the fifty-fourth 20 day before any primary election, and not earlier than the fifty-fourth day nor 21 later than the tenth day before any general municipal election, the City Clerk 22 shall publish a notice of the election at least once in one or more newspapers 23 published and circulated in the City of San Bernardino.
