AN ORDINANCE OF THE MAYOR AND CGlMON COUNCIL OF THE CITY OF SAN
BERNARDINO AMENDING ORDINANCE NO. 763 ENTITLED, "AN ORDINANCE PROVIDING FOR
THE LICENSING OF BUSINESS, SHOWS, EXHIBITIONS AND GAMES CONDUCTED OR CARRIED
ON IN THE CITY OF SAN BERNARDINO, FIXING THE RATE OF LICENSE THEREFOR AND
PROVIDING FOR COLLECTION THEREOF",

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN
AS FOLLOWS:
SECTION ONE: That Ordinance No. 763, Section Ill, is hereby
amended to read as follows:
"SECTION Ill: For every person acting as a solicitor, as defined in
this Section, $30.00 per quarter or any part thereof, payable quarterly in
advance, except those solicitors acting as an agent or representative for an
established place of business for which a license rate is established on the
total gross receipts of said business.
In order to be classified and to qualify as a business with an
established place of business, such business shall pay a license tax rate
based on its gross receipts and shall comply with each of the following
requirements:
1. A completely representative stock of the merchandise being
solicited shall be on display at the place of business;
2. The established place of business must be open at least 8 hours
a day, 5 days a week;
3. A floor salesman of the company shall be present at all times
that the place of business is open;
4. Said business or company shall have and maintain at said place
a sign not less than three (3) square feet bearing the name of the firm either
painted on the front of the building or on the unscreened glass facing the
front street, or said sign shall be affixed to the front of the building;
5. Ingress and egress shall be available to the place of business
from the main entrance of the building.
A solicitor, within the meaning of this Section, is defined to be any
person who goes from house to house, or from place to place, in the City of
San Bernardino, selling or taking orders for, or offering to sell or take
1 orders for, goods, wares or merchandise or any article for future delivery, or

2 for service to be performed in the future, or for the making, manufacturing or
3 repairing of any article or thing whatsoever for future delivery. Application
4 for the license provided for in this Section shall be accompanied by a bond in
5 the penal sum of $500.00, executed by a surety company, or in lieu thereof, a
6 cash bond of equal value, conditioned upon the making of final delivery of the
7 goods, wares or service to be performed in accordance with the terms of such
8 order. Any person aggrieved by the action of any such solicitor shall have a
9 right of action on the bond for the recovery of money or damages or both. Such
10 bond shall remain in full force and effect, and in case of a cash deposit,
11 such deposit shall be retained by the City of San Bernardino for a period of
12 90 days after the expiration of any such license. All orders taken by
13 licensed solicitors shall be in writing in duplicate, stating the terms thereof,
14 and the amount paid in advance, and one copy shall be given to the purchaser.
15 All solicitors shall be fingerprinted and photographed by the Police
16 Department. Solicitat<ion shall cease at sundown."
