AN ORDINANCE AMENDING ORDINANCE NO. 1987 ENTITLED "AN ORDlNANCJ1;
REGULATING THE OPERATION OF TAXICABS AND CHAUFFEURED LIMOUSINES", I
AND ADDING PROVISIONS CONCERNING NOTICES TO APPEAR AND THE VALIDITY!
OF SAID ORDINANCE.
THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO 00
ORDAIN AS FOLLOWS:
SECTION ONE: Ordinance No. 1987 is hereby amended by adding
thereto Section Fifty-One, NOTICE TO APPEAR, to read as follows:

SECTION FIFTY-ONE. NOTICE TO APPEAR. If any person is arre~t~;'~;
for a violation of any provision of this Ordinance and such pers~~~

is not immediately taken before a magistrate as prescribed in the '
Penal Code, the arresting officer shall prepare in duplicate a
written Notice to Appear in court within five days, containing the
name and address of such person, the offense charged and the time
and place where such person shall appear in court.
Any person willfully violating his written promise to appear
in court is guilty of a misdemeanor regardless of the disposition
of the charge upon which he was originally arrested.
When a person signs a written promise to appear at the time
and place speCified in the written promise to appear and has not
posted bail as provided in Section 853.1 of the Penal Code, the
magistrate shall issue and have delivered for execution a warrant
for his arrest within twenty days after his failure to appear as
promised, or if such person promises to appear before an officer
authorized to accept bail other than a magistrate and fails to do
so on or before the dat~ which he promised to appear, then, within
twenty days after the delivery of such written promise to appear
by the officer to a magistrate having jurisdiction over the offensd.
SECTION TWO: Ordinance No. 1987 is hereby amended by adding
thereto Section Fifty-Two, VALIDITY, to read as follows:

to be invalid or unconstitutional by the decision of any court
of competent jurisdiction, such decision shall not affect the
validity of the remaining portions of the Ordinance. The Common

4 Council hereby declares that it would have passed this Ordinance,

and each section, subsection, sentence, clause and phrase hereof,
irrespective of the fact that anyone or more of the sections, sub-I
sections, sentences, clauses or phrases hereof be declared invalid
or unconstitutional.
