2 AN ORDINANCE OF THE CITY OF SAN BERNARDINO CALLING A SPECIAL ELECTION
TO BE HELD ON THE ELEVENTH DAY OF DECEMBER, 1962, PERTAINING TO THE ANNEXATION

WHEREAS, by Resolution, the Mayor and Common Council of the City of
San Bernardino declared its intention to call a special election to be held in
certain inhabited territory contiguous to said City proposed to be annexed to
said City for the purpose of submitting to the qualified electors residing in
said territory the question whether or not said territory shall be annexed to

said City; and

WHEREAS, a copy of said resolution was published as required by
12
law; and
13
WHEREAS, at a time not later than the hour set by said resolution for
14
hearing objections to the proposed election and at a time not later than the
15
hour set for the heretofore recessed meeting for hearing objections to the
16
proposed election, no written protests were made by the owners of one-half of
17
the value of the territory proposed to be annexed as shown by the last equalized
18
assessment roll of the property within the territory proposed to be annexed; and
19
WHEREAS, thereafter on the 4th day of October, 1962, Resolution
20
No. 6511 was adopted by the Mayor and Common Council declaring that a majority
21
protest has not been presented; and
22
WHEREAS, all proceedings have been had in accordance with said
23
resolutions and the Annexation Act of 1913, reference thereto hereby being made
24
for further particulars.

NOW. THEREFORE. THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN

BERNARDINO DO ORDAIN AS FOLLOWS:

SECTION ONE: A special election hereby is called to be held on the
28 11th day of December. 1962. in the territory hereinafter described and proposed
29 to be annexed to the City of San Bernardino for the purpose of submitting to the
30 qualified electors residing in said territory the question whether or not such
31 territory shall be annexed to. incorporated in and made a part of said City of
32 Sa~Bernardino, and whether or not the property in said territory shall, after
1 such annexation, be subject to taxation equally with the property within the City
2 of San Bernardino to pay the entire bonded indebtedness of the City of San
3 Bernardino outstanding at the date of first publication of the notice of election
4 for annexation.
5 Said territory is described as follows:
6 All that portion of Lot 2 of the John Hancock Survey of a portion
of the Rancho Muscupiabe as per plat thereof, recorded in Book 2
7 of Maps, Page 42, records of the County Recorder of San Bernardino
County, State of California, described as follows:

Beginning at a point on the present corporate limits of the City
of San Bernardino, said point being the most Northerly corner
of that certain parcel of land described as Parcel No. 1 in
the deed to James A. Gorman, Jr., et ux, recorded June 5, 1950,
in Book 2585, Page 365, Official Records of the County Recorder
of said county; thence Southeasterly along said city limit line
and Northeasterly line of said Gorman's property to a point
that is North 650 06' West, a distance of 172.55 feet and North
00 38' West a distance of 1383.6 feet from the Southeast corner
of said Lot 2; thence South 20? 29' 30" West 127.65 feet; thence
South 670 40' 30" West 64.68 feet; thence South 420 32' 30"
West 103.5 feet more or less to the Northeast corner of that
certain parcel of land described in the deed to James A. Gorman,
Jr., et ux, recorded June 21, 1961, in Book 5463, Page 483
Official Records of said county; thence South 15. 25' East
192.23 feet; thence South 410 29' East, 102.51 feet more or
less to a point on the Southeasterly line of that parcel of
land conveyed to Wilbur T. Russell, et ux, by deed recorded
in Book 4761, Page 212, Official Records of said county; thence
South 440 22' West, 10.61 feet; thence South 8ge 22' West,
25.00 feet to the Northeast corner of that parcel of land
conveyed to Chub W. Morningstar, et ux, by deed recorded
October 25, 1949, in Book 2'78, Page 504, Official Records
of said county; thence South 100 14' 37" West 476.91 feet
along the Westerly line of that parcel of land conveyed to
the San Bernardino County Flood Control District by deed
recorded December 27, 1946, in Book 1984, Page 82, Official
Records of said county; thence South O. 38' East, 495.00
feet along said San Bernardino County Flood Control District's
property to the South line of said Lot 2, said South line
being the center line of Fortieth Street, 40.00 feet wide;
thence Westerly along said South line and center line, 182.00
feet to said present city limit line; thence Northerly along
said city limit line to the point of beginning.

The basis of bearing for this description being the East
line of said Lot 2.

SECTION TWO: TIME OF OPENING AND CLOSING OF POLLS. The polls at said

election shall be opened at 7 o'clock A. M. of the day herein fixed for the
29

holding of said election and shall be kept open until 7 o'clock P. M. of the
same day, when the polls shall be closed.

SECTION THREE: BALLOTS. Upon the ballots to be used at said election

1 there shall be printed the words:
2 SHALL ANNEXATION DISTRICT NO. 148 BE ANNEXED TO, INCORPORATED IN AND
3 MADE A PART OF THE CITY OF SAN BERNARDINO AND THE PROPERTY IN SUCH TERRITORY
4 BE, AFTER SUCH ANNEXATION, SUBJECT TO TAXATION EQUALLY WITH THE PROPERTY WITHIN
5 THE CITY OF SAN BERNARDINO, TO PAY ITS PRO-RATA PORTION, BASED UPON ASSESSED
6 VALUAtION. OF ALL BONDED INDEBTEDNESS OF THE CITY OF SAN BERNARDINO OUTSTANDING
7 AT THE DATE OF THE FIRST PUBLICATION OF THE NOTICE OF ELECTION FOR ANNEXATION?

8 Opposite these words there shall be printed the words "YES" and "NO",
9 and to the right of each of these last two words there shall be a voting square.
10 If an elector shall stamp a cross (+) in the voting square after the printed
11 word "YES", the vote of such elector shall be counted in favor of the annexation

of said territory to the City of San Bernardino, and if an elector shall stamp
a cress (+) in the voting square after the printed word "NO", the vote of such
elector shall be counted against such annexation.
In all particulars not herein recited said election shall be held in
conformity as near as may be with the laws of the State of California concerning
general elections and with said Annexation Act of 1913.
SECTION FOUR: For purpose of said election there hereby is established
in the territory described herein one (1) voting precinct which shall include all
of said territory. The following is the polling place of said election precinct,"i

SECTION FIVE: This Ordinance shall take effect upon its publication.
SECTION SIX: The City Clerk shall certify to the passage and adoption
ordinance by the Common Council of the City of San Bernardino and shall

cause the same to be published three consecutive days,'ex~lusive of holidays,

in the San Bernardino Evening Telegram, a daily newspaper of general circulation

printed and published within the City of San Bernardino, and once a week for
four (4) weeks prior to the date ~f the election in the Colton Daily Courier, a
5
newspaper of general circulation printed and published outside of the City of
6
San Bernardino but in the County of San Bernardino, California, which said
7
ordinance shall be preceded by the words "Notice of Election", and that due
8
publication of this ordinance as herein provided is hereby determined to be
9
sufficient notice of said election and the only notice that shall be required
10 I to be given.

I HEREBY CERTIFY that the foregoing ordinance was duly passed and
