AN ORDINANCE OF THE MAYOR AND COMM~N -c/uNCIL OF THE CITY OF SAN
BERNARDINO APPROVING THE ANNEXATION OF DISTRICT NO. 149.

4 WHEREAS, heretofore, a petition was filed with the Common Council of
5 the City of San Bernardino requesting that certain uninhabited territory
6 contiguous to said City be annexed to the City of San Bernardino, and which said
7 petition described said terr~tory and the boundaries thereof proposed to be
8 annexed to the City; and
9 WHEREAS, said petition was filed by the owner of not less than one-
10 fourth of the area of land in such territory and representing not less than
11 one-fourth of the assessed value of such territory according to the last
12 preceding equalized assessment roll of the County of San Bernardino, in which
13 said County the City of San Bernardino is situated; and
14 WHEREAS, said petition requested the said territory be annexed to
15 and included in the said municipal corporation in accordance with the provisions
16 of the Government Code, Section 35300, et seq.; and
17 WHEREAS, on the 13th day of November, 1962, a resolution was adopted
18 by the aforesaid Common Council of the City of San Bernardino, California,
19 proposing the annexation of the aforesaid uninhabited territory, to be generally
20 known as ANNEXATION DISTRICT NO. 149, to the City of San Bernardino, and that
21 said resolution provided therein that the proposed annexation should be
22 generally known and identified as ANNEXATION DISTRICT NO. 149; and
23 WHEREAS, said resolution set forth therein that all the property
24 included in the aforesaid territory should be taxed equally with the other
25 property within the said City to pay the bonded indebtedness and any and all
26 general indebtedness and liability of the City of San Bernardino contracted prior
27 to or existing or outstanding at the time of the aforesaid proposed annexation
28 of the aforesaid property as provided in the hereinbefore mentioned Government
29 Code; and
30 WHEREAS, said resolution did fix, determine and declare that a
31 hearing be held on the 7th day of January, 1963, at the hour of 9:30 o'clock
32 A. M. in the Council Chambers of the City Hall in the City of San Bernardino,
1 and the same was the day, hour and place designated where any person owning real
2 estate within such territory so proposed to be annexed and having any objections
3 to the proposed annexation might object before the Common Council and show cause
4 why such territory should not be annexed, and furthermore, the said resolution
5 provided that at any time not later than the said hour set, as mentioned
6 hereinbefore for the said hearing, any owner of property within Dhe said
7 territory proposed to be annexed might file written protest with the City of
8 San Bernardino against such annexation; and
9 WHEREAS, no written protest of any kind or nature whatsoever were
10 filed with the City Clerk of the City of San Bernardino prior to 9:30 o'clock
11 A. M. on the 7th day of January, 1963, and thereafter on the 7th day of January,
12 1963, Resolution No. 6610 was adopted by the Mayor and Common Council declaring
13 that a maJority protest has not been presented; and
14 WHEREAS, it appears to the Common Council of the City of San Bernardino
15 that the aforesaid annexation proceedings have been completed and everything
16 performed at this time in accordance with said Government Code, as mentioned
17 hereinbefore, and any and all other laws in any way. connected with the said
18 annexation procedure having been complied with; and
19 WHEREAS, the Common Council of the City of San Bernardino desire to
20 approve at this time the annexation of the aforesaid territory.
21 NOW, THEREFORE, THE COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DOES
22 HEREBY ORDAIN AS FOLLOWS:

SECTION ONE: That said territory herein described as Annexation
24 District No. 149 is hereby annexed and incorporated in and made a part of the
25 City of San Bernardino.
26 SECTION TWO:: The territory herein referred to as being annexed to
27 the City of San Bernardino is particularly described as follows, to wit:
28 Those portions of Lots 35 and 36, a portion of Nineteenth
Street (also known as Linville Street) and a portion of
29 California Street according to the map of Mount Vernon
Orange Grove and Fruit Company Lands recorded in the
30 Recorder's Office in Book 12 of Maps, at page 16, records
of San Bernardino County, described as follows:

Beginning at a point on the present corporat limits of
the City of San Bernardino, said point being the intersection

of the center line of Nineteenth Street (also known as
Linville Street), 60.00 feet wide, and the center line
of California Street, 60.00 feet wide; thence Southerly
along said center line of said California Street to the
South line of Lot 36; thence Easterly along said South
line of Lots 36 and 35 to the East line of said Lot 35;
thence Northerly along said East 1iae of Lot 35 to its
intersection with the South line of said Nineteenth Street;
thence Easterly along said South line of said Nineteenth
Street to its intersection with the present corporate
limits of the City of San Bernardino; thence Northerly
along said corporate city limits line to its intersection
with the center line of said Nineteenth Street; thence
Westerly along said center line also being the present
corporate city limits line to the point of beginning.

SECTION THREE: That the above described property will be subject to
10 taxation equally with the property within such municipal corporation to pay its
11 proportion of the following bonded indebtedness of the City of San Bernardino,
12 which said bonded indebtedness was outstanding or theretofore authorized and
13 is outstanding at the time of said annexation, to wit:
14 A bonded indebtedness of $275,000.00 incurred for the acquisition and
15 construction of water works, including "Devil Canyon Water Works", water rights,
16 rights of way, pipe lines, wells and pumping plants, the outstanding indebtedness
17 thereon being $13,750.00, bearing interest at the rate of 5% per annum;
18 A bonded indebtedness of $490,000.00 incurred for the acquisition and
19 construction of a public library, including additions to and enlargements of

20 the public library system of said City, the outstanding indebtedness thereon
21 being $410,000.00, bearing interest at the rates of 4 3/4%, 3 1/4% and
22 3 1/2% per annum.
23 A bonded indebtedness of $1,116,000.00 incurred for the acquisition
24 and construction of additions to, relocations of and replacements of the fire
25 fighting system of said City, the outstanding indebtedness thereon being
26 $1,116,000.00, bearing interest at the rates of 4%, 3%, 2 1/2%, 2 3/4% and
27 2.9% per annum.

SECTION FOUR: The property herein annexed is declared to be a part
29 of Ward 5 and the boundaries of Ward 5 are hereby altered to include said
30 annexed territory; and said property is placed and declared to be in R-1,
31 Single Family Residential Zone.

SECTION FIVE: The City Clerk shall certify to the passage of this

1 Ordinance and shall cause the same to be published three consecutive times,
2 exclusive of holidays, in the San Bernardino Evening Telegram, a daily
3 newspaper designated for that purpose.
4 I HEREBY CERTIFY that the foregoing Ordinance was duly adopted by

the Mayor and Common Council of the City of San Bernardino at a regular meeting
