2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO APPROVING THE ANNEXATION OF DISTRICT NO. 150.

4 WHEREAS, heretofore, a petition was filed with the Common Council of
5 the City of San Bernardino requesting that certain uninhabited territory
6 contiguous to said City be annexed to the City of San Bernardino, and which said
7 petition described said territory and the boundaries thereof proposed to be
8 annexed to the City; and
9 WHEREAS, said petition was filed by the owners of not less than one-
10 fourth of the area of land in such territory and representing not less than
11 one-fourth of the assessed value of such territory according to the last
12 preceding equalized assessment roll of the County of San Bernardino, in which
13 said County the City of San Bernardino is situated; and
14 WHEREAS, said petition requested the said territory to be annexed to
15 and included in the said municipal corporation in accordance with the provisions
16 of the Government Code, Section 35300, et seq.; and
17 WHEREAS, on the 17th day of December, 1962, a resolution was adopted
18 by the aforesaid Common Council of the City of San Bernardino, California,
19
proposing the annexation of the aforesaid uninhabited territory, to be generally

,known as ANNEXATION DISTRICT NO. 150, to the City of San Bernardino and that
20
21 said resolution provided therein that the proposed annexation should be generally
22 known and identified as ANNEXATION DISTRICT NO, 150; and
23 WHEREAS, said resolution set forth therein that all the property
24 included in~the aforesaid tefrluoPYJshould be taxed equally with the other
25 property within the said City to pay the bonded indebtedness and any and all
26 general indebtedness and liability of the City of San Bernardino contracted
27 prior to or existing or outstanding at the time of the aforesaid proposed
28 annexation of the aforesaid property as provided in the hereinbefore mentioned
29 Government Code; and
30 WHEREAS, said resolution did fix, determine and declare that a hearing
31 be held on the 28th day of January, 1963, at the hour of 9:30 o'clock A. M. in
32 the Council Chambers of the City Hall in the City of San Bernardino, and the
1 same was the day, hour and place designated where any person owning real estate
2 within such territory so proposed to be annexed and having any objections to
3 the proposed annexation might object before the Common Council and show cause
4 why such territory should not be annexed; and, furthermore, the said resolution
5 provided that at any time not later than the said hour set, as mentioned
6 hereinbefore for the said hearing, any owner of property within the said
7 territory proposed to be annexed might file written protest with the City of
8 San Bernardino against such annexation; and
9 WHEREAS, no written protest of any kind or nature whatsoever were
10 filed with the City Clerk of the City of San Bernardino ppior to 9:30 o'clock
11 A. M. on the 28th day of January, 1963, and thereafter on the 28th day of
12 January, 1963, Resolution No. 6631 was adopted by the Mayor and Common Council
13 declaring that a majority protest has not been presented; and
14 WHEREAS, it appears to the Common Council of the City of San Bernardino
15 that the aforesaid annexation proceedings have been completed and everything
16 performed at this time in accordance with said Government Code, as mentioned
17 hereinbefore, and any and all other laws in any way connected with the said
18 annex~tion procedure having been complied with; and
19 WHEREAS, the Common Council of the City of San Bernardino desire to
20 approve at this time the annexation of the aforesaid territory.
21 NOW, THEREFORE, THE COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DOES
22 HEREBY ORDAIN AS FOLLOWS:

SECTION ONE: That said territory herein described as Annexation
24 District No. 150 is hereby annexed and incorporated in and made a part of the
25 City of San Bernardino.

SECTION TWO: The territory herein referred to as being annexed to
27 the City of San Bernardino is particularly described as follows, to wit:
28 All that portion of Government Lots 1 and 2, and that portion
of the South one-half of the Northeast one-quarter of Section
29 14, Township 1 North, Range 4 West, San Bernardino Base and
Meridian in the County of San Bernardino, State of California,
30 described as follows:
31 Beginning at a point in the present Corporate City Limit line
of the City of San Bernardino, said point being the Southeast
32 corner of the property conveyed to Joseph E. Bonadiman, Trustee,

as parcel number one in the deed recorded January 5, 1962 in
Book 5625, Page 76, Official Records of said County, said
point also being on the South line of said Government Lot 2
from which the Southeast corner of said Government Lot 2
bears South 650 06' East, 802.10 feet and South 640 31' East
171.40 feet; thence along said City Limit line, the following
courses and distances; North 300 34' East, 450.77 feet;
thence North 420 31' West, 282.20 feet; thence North 310 51'
West, 294.84 feet to a point on the North line of said Govern-
ment Lot 2 as shown on Record of Survey recorded in Book 7 of
Records of Surveys at page 37, Records of the County Recorder
of said County, said point being South 890 43' West, 986.40
feet from the Northeast corner of said Government Lot 2;
thence North 890 43' East along the said North line of Govern-
ment Lot 2, a distance of 414.10 feet; thence South 420 02'
East, 217.60 feet; thence Southeasterly along said City Limit
line, 557.00 feet more or less, to a point in the East line
of said Government Lot 2 which is North 00 36" West 742.90 feet
from the Southeast corner thereof; thence leaving said City
Limit line, North 00 36' West along said East line of
Government Lot 2 a distance of 519.50 feet to the Southeast
corner of the Northeast one-quarter of said Section 14;
thence North 00 18' East along the East line of said Northeast
one-quarter, 1271.11 feet to the Northeast corner of the
Southeast one-quarter of the Northeast one-quarter of said
Section 14; thence South 890 44' West along the North line
of said Southeast one-quarter of the Northeast one-quarter
1323.99 feet to the Northwest corner thereof; thence South
00 03' West along the West line of said Southeast one-quarter
of the Northeast one-quarter to the Northeast corner of said
Government Lot 1 of said Section 14, being also the Northeast
corner of the property conveyed to Joseph E. Bonadiman,
Trustee, by deed recorded January 5, 1962 in Book 5625,
page 75, Official Records of said County; thence North 890
29' 45" West along the North line of said Government Lot 1,
a distance of 156.30 feet to the Northwest corner of aforesaid
Bonadiman property; thence following the Wester1y line of
aforesaid Bonadiman property, the following courses and
distances; South 040 51' East, 264.12 feet; thence South 330
42' West, 241.80 feet; thence South 200 sY' West, 67.74 feet;
thence South 120 50'West, 130.40 feet; thence South 110 01'
West, 191.06 feet;-thence South 02050' East, 297.29 feet;
thence South 140 24' West, 107.33 feet to a point on the
South line of said Government Lot 1 which is North 890 43'
35" West, 342.63 feet along said South line from the Southeast
corner thereof; thence along the Westerly line of said first
mentioned parcel Number one of said Bonadiman property, South
260 27' East, 210.26 feet (South 260 10' East, 211.54 feet,
record); thence South 510 02' East, 316.55 feet (South 500
34' East, 316.50 feet, record); thence South 00 01' West
82.10 feet; thence South 320 32' 30" East, 277.86 feet to
a point in the South line of said Government Lot 2 which is
North 650 06' West along said South line 331.75 feet from
the point of beginning; thence South 650 06' East along said
South line of Government Lot 2 a distance of 331.75 feet to
the point of beginning.

SECTION THREE: That the above described property will be subject to
31 taxation equally with the property within such municipal corporation to pay its
32 proportion of the following bonded indebtedness of the City of San Bernardino,

1 which said bonded indebtedness was outstanding or theretofore authorized and is
2 outstanding at the time of said annexation, to wit:
3 A bonded indebtedness of $275,000.00 incurred for the acquisition and
4 construction of water works, including "Devil Canyon Water Works", water rights,
5 rights of way, pipe lines, wells and pumping plants, the outstanding indebtedness
6 thereon being $13,750.00, bearing interest at the rate of 5% per annum;
7 A bonded indebtedness of $490,000.00 incurred for the acquisition and
8 construction of a public library, including additions to and enlargements of the
9 public library system of said City, the outstanding indebtedness thereon being
10 $410,000.00, bearing interest at the rates of 4 3/4%, 3 1/4% and 3 1/2%
11 per annum;
12 A bonded indebtedness of $1,116,000.00 incurred for the acquisition
13 and construction of addition to, relocation of and replacements of the fire
14 fighting system of said City, the outstanding indebtedness thereon being
15 $1,116,000.00, bearing interest at the rates of 4%, 3%, 2 1/2%, 2 3/4% and
16 2.9% per annum.

SECTION FOUR: The property herein annexed is declared to be a part
18
of Ward 4 and the boundaries of Ward 4 are hereby altered to include said
19
annexed territory; and said property is placed and declared to be in R-l,
20
Single Family Residential Zone.

SECTION FIVE: The City Clerk shall certify to the passage of this
22 Ordinance and shall cause the same to be published three consecutive times,
23 exclusive of holidays, in the San Bernardino Evening Telegram, a daily
24 newspaper designated for that purpose.
25 I HEREBY CERTIFY that the foregoing Ordinance was duly adopted by
26
the Mayor and Common Council of the City of San Bernardino at a regular meeting
