2 AN ORDINANCE OF THE MAYOR AND COMMON CO CIL OF THE CITY OF SAN
BERNARDINO APPROVING THE ANNEXATION OF DISTRICT N0. 159.

4 WHEREAS, heretofore, a petition was filed with the Common Council of
5 the City of San Bernardino requesting that certain uninhabited territory
6 contiguous to said City be annexed to the City of San Bernardino, and which
7 said petition described said territory and the boundaries thereof proposed to
$ be annexed to the City; and
9 WHEREAS, said petition was filed by the owners of not less than one-
10 fourth of the area of land in such territory and representing not less than
11 one-fourth of the assessed value of such territory according to the last
12 preceding equalized assessment roll of the County of San Bernardino, in which
13 said County the City of San Bernardino is situated; and
14 WHEREAS, said petition requested the said territory to be annexed to
15 and included in the said municipal corporation in accordance with the provisions
16 of the Government Code, Section 35300, et seq.; and
17 WHEREAS, on the 20th day of May, 1963, a resolution was adopted by
1B the aforesaid Common Council of the City of San Bernardino, California, pro-
19 posing the annexation of the aforesaid uninhabited territory, to be generally
~ known as ANNEXATION DISTRICT N0. 159, to the City of San Bernardino and that
21 said resolution provided therein that the proposed annexation should be
22 generally known and identified as ANNEXATION DISTRICT N0. 159; and
23 WHEREAS, said resolution set forth therein that all the property
24 included in the aforesaid territory should be taxed equally with the other
25 property within the said City to pay the bonded indebtedness and any and all
26 general indebtedness and liability of the City of San Bernardino contracted
27 prior to or existing or outstanding at the time of the aforesaid proposed
2B annexation of the aforesaid property as provided in the hereinbefore mentioned
29 Government Code; and
30 WHEREAS, said resolution did fix, determine and declare that a
31 hearing be held on the 1st day of July, 1963, at the hour of 9:30 o`clock A. M.
32 in the Council Chambers of the City Hall in the City of San Bernardino, and
1 the same was the day, hour and place designated where any person owning real
2 estate within such territory so proposed to be annexed and having any objections
3 to the proposed annexation might object before the Common Council and show
4 cause why such territory should not be annexed; and furthermore, the said
5 resolution provided that at any time not later than the said hour set, as
6 mentioned hereinbefore for the said hearing, any owner of property within the
7 said territory proposed to be annexed might file written protest with the City
$ of San Bernardino against such annexation; and
9 WHEREAS, no written protests of any kind or nature whatsoever were
10 filed with the City Clerk of the City of San Bernardino prior to 9:30 o'clock
11 A. M. on the 1st day of July, 1963, and thereafter on the 1st day of July, 1963,
12 Resolution No. 6830 was adopted by the Mayor and Common Council declaring that
13 a majority protest has not been presented; and
14 WHEREAS, it appears to the Common Council of the City of San Bernardino
15 that the aforesaid annexation proceedings have been completed and everything
16 performed at this time in accordance with said Government Code, as mentioned
17 hereinbefore, and any and all other laws in any way connected with the said
18 annexation procedure having been complied with; and
19 WHEREAS, the Common Council of the City of San Bernardino desire to
20 approve at this time the annexation of the aforesaid territory.
21 NOW, THEREFORE, THE COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
22 DOES HEREBY ORDAIN AS FOLLOWS:
23 SECTION ONE: That said territory herein described as Annexation
24 District No. 159 is hereby annexed and incorporated in and made a part of the
25 City of San Bernardino.
26 SECTION TWO: The territory herein referred to as being annexed to
27 the City of San Bernardino is particularly described as follows, to wit:
2B Those portions of Lots 1 and 2, Block 54, Rancho San Bernar-
dino, as per plat thereof recorded in Book 7 of Maps, Page 2,
29 Records of the County Recorder of San Bernardino County,
State of California, described as follows:

Beginning at a point on the present corporate limits of the
31 City of San Bernardino, said point being the Northeast
corner of said Lot 2; thence Southerly along the East line
32 of said Lot 2 and said City limit line to a point that is

1 860.00 feet North of the Southwest corner of said Lot 1,
said point also being the Northwest corner of that certain
2 parcel of land conveyed to Isabel Phister Soule by deed
recorded January 7, 1959 in Book 4695, Page 656, Official
3 Records of said county; thence Easterly along the North
line of said Soule property 375.00 feet to the Northeast
4 corner thereof; thence Southerly along the East line of
said Soule property, a distance of 514.20 feet to the
5 intersection with the Northerly line of Highway No. 26 as
delineated on the State of California, Division of Highways
6 right of way map of Route No. 26, Section 61 A, Sheet 1-A;
thence in a Southwesterly direction, a distance of 450.00
7 feet more or less to the Southeast corner of that certain
parcel of land described in the deed recorded May 28, 1959
8 in Book 4832, Page 324, Official Records of said county;
said point being on the present corporate limits of the
9 City of Colton; thence the following bearings and distances
along the Colton City limit line as described in that
10 certain document recorded October 11, 1960 (document No. 368);
thence South 81° 47' 07" West along the Northerly right of
11 way of said State Highway No. 26, a distance of 522,86 feet
to the beginning of a tangent curve concave to the North,
12 having a radius of 2500 feet; thence Southwesterly along
said curve a distance of 249.64 feet through an angle of
13 OS° 43' 17"; thence Northwesterly, a distance of 88.07
feet along a non-tangent curve concave to the Northeast
14 having a radius of 609.75 feet, through an angle of 08°
16' 32"; thence tangent to said curve North 43° 25' 36"
15 West, a distance of 241.89 feet; thence North 78° OS' S0"
West, a distance of 552.55 feet; thence South 08° 59' S7"
16 West a distance of 112.61 feet to an intersection with a
line that is parallel with and 495 feet North of the South
17 line of said Lot 2, Block 54; thence South 89° 42' S7" West
along said parallel line to the intersection with a line
18 that is perpendicular to the Northerly right of way line
of said State Highway No. 26 at a point which is distant
19 South 81° 00` 03" East 1364 feet from the West line of
said Lot 2; thence North 8° 59' S7" East along said
20 perpendicular line to a point distant 60.69 feet Southerly
of the North line of the South 660 feet of said Lot 2,
21 Block 54; thence North 84° 58' 35" West, a distance of
51.58 feet; thence North 82° O1' 18" West, a distance of
22 93.38 feet; thence North 28° 33' 26" West, a distance of
199.43 feet along the Easterly right of way line of State
23 Highway No. 43; thence Northwesterly, a distance of 219.33
24 feet along a tangent curve concave to the Northeast, having
a radius of 600 feet through an angle of 20° 56' 40";
25 thence tangent to said curve North 07° 36` 46" West, a
distance of 82.34 feet; thence North 82° 23' 14" East, a
26 distance of 18.00 feet; thence North 4° 41' 23" West, a
distance of 235.31 feet; thence North 52° 36' 46" West,
27 a distance of 42.43 feet; thence North 11° 59' 11" West,
a distance of 510.38 feet to the south line of Colton
Avenue (also known as "F" Street) said Colton Avenue
28 delineated on the licensed Land Surveyor's Map recorded
29 May 28, 1948 in Book 4, Page 12, Records of Survey`s;
thence South 86° 18' 11" West, a distance of 69.03 feet
~ to the beginning of a tangent curve concave to the North-
west having a radius of 2889.93 feet; thence Westerly
along said curve, a distance of 232.70 feet; through an
31 angle of 4° 36` 48"; thence leaving said Colton City limit
North 11° 45' 40" East to the intersection of the center
32 line of said Colton Avenue, said center line being the

1 present corporate limit line of the City of San Bernardino;
thence Easterly along said center line and said San Bernardino
2 City limit line to the intersection of that certain parcel
of land described in the deed recorded January 6, 1914, in
3 Book 532 of Deeds, Page 206; thence North 48° 40' East,
362.00 feet more or less along said city limit line to the
4 center line of South "E" Street, 82.50 feet wide; thence
Northerly along the center line of said South "E" Street
5 and said San Bernardino City limit line to the intersection
with the Westerly prolongation of the Northerly line of
6 that certain parcel conveyed to the Smith Packing Company
by deed recorded January 24, 1957 in Book 4139, Page 89,
7 Official Records of said County; thence Easterly along said
city limit line to the point of beginning.

9 SECTION THREE: That the above described property will be subject to
10 taxation equally with the property within such municipal corporation to pay
11 its proportion of the following bonded indebtedness of the City of San Bernardi
12 which said bonded indebtedness was outstanding or theretofore authorized and is
13 outstanding at the time of said annexation, to wit:
14 A bonded indebtedness of $275,000.00 incurred for the acquisition
15 and construction of water works, including "Devil Canyon Water Works", water
16 rights, rights of way, pipe lines, wells and pumping plants, the outstanding
17 indebtedness thereon being $13,750.00, bearing interest at the rate of 5%
18 per annum;
19 A bonded indebtedness of $490,000.00 incurred for the acquisition
~ and construction of a public library, including additions to and enlargements
21 of the public library system of said City, the outstanding indebtedness thereon
22 being $410,000.00, bearing interest at the rates of 4 3/4%, 3 1/4% and 3 1/2%
23 per annum;
24 A bonded indebtedness of $1,116,000.00 incurred for the acquisition
25 and construction of additions to, relocation of and replacements of the fire
26 fighting system of said City, the outstanding indebtedness thereon being
27 $1,116,000.00, bearing interest at the rates of 4%, 3%, 2 1J2%, 2 3/4% and
2S 2.9% per annum.
29 SECTION FOUR: The property herein annexed is declared to be a part
~ of Ward 3 and the boundaries of Ward 3 are hereby altered to include said
31 annexed territory; and said property is placed and declared to be in C-3A
32 General Limited Commercial Zone.

SECTION FIVE: The City Clerk shall certify to the passage of this
Ordinance and shall cause the same to be published three consecutive times,
exclusive of holidays, in the San Bernardino Evening Telegram, a daily news-
paper designated for that purpose.
I HEREBY CERTIFY that the foregoing Ordinance was duly adopted by
the Mayor and Common Council of the City of San Bernardino at a regular meeting
