THE MAYOR AND CQAII~fON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: SECTION ONE: FINDINGS OF FACT AND DECIARATION OF POLICY. The Mayor and Commion Council find that racial tension and conflict contribute substantially to the creation of juvenile delinquency and adult crime; that prejudice, intolerance and discri.mination against any individual or group because of race, religion, nationa] origin or cultural background promote such tension and conflict and that prejudice, discrimination, tension and conflict are, therefore, a menace to peace and public welfare; and further mine that to eliminate such prejudice and intolerance and thereby promote public health, welfare and security, an instr~entality should be established through which practices to achieve better human relations can be provided and persons and groups may be officially assisted in promoting good will and better relations among all people. SECTION 7W0: CREATION. There is hereby created the Htmman Relations Commission oE the City of San Bernardino, which shall be known as the Human Relations Co~ission. The Co~ission shall consist of 13 members who shall serve at the pleasure of the Mayor and Co~on Council. At the f~rst meeting of the Co~ission, it shall choose from its members a Chaixman, a Vice-Chairman and a Secretary who shall serve at the pleasure of the Commission< At the same meet- ing each Co~issioner shall, by lot drawn, so classify themsel~ves that: One member nominated by each Councilman shall serve for one year; one member nominated by each Councilman shall serve for two years; two members nominated by the Mayor shall serve for two years; and one member nominated by the Mayor shall serve for one i'~ a' 3 411 5',, 6 7 8 9 10 li ia 13 14 ~5 16 17 18 19 20 zi zz 23 24 25 26 27 28 ~, ~~ 31 I' ~ 32 I year. Thereafter, all members shall be appointed by the Mayor for terms of two years eacho Appointments in succeeding years shall be effective as of the first day of the anniversary month in which the said lots were so drawn. Each member of the Commission, after having been nominated, shall be appointed by the Mayor subject to the approval of the Com- mon Council. Each member shall be a local elector> Subsequent vacancies shall be filled and appointments shall be made in the manner hereinbefore set fortho Each member shall serve without com• pensation; however, necessary expenses in the conduct of his duties shall be a charge upon the General Fund, provided that the prior approval of the Mayor and Co~on Council is first had and obtained, SECTION THREE: DUTIES. The Commission shall: (a) Engage in research and education for the purpose of lessening racial and religious prejudice and of fostering attitudes among the various groups within its jurisdiction which lead to civic peace and intergroup understandingo (b) Develop and a~ninister programs and plans designed to promote the full accaptance of all citizens in the co~uaity in all aspects of community life, without regard to race, religion or national origin. (c) Cooperate with and assist in coordinating on a City- wide basis the work of those community agencies engaged in fostering mutual understanding and respect among all racial, religious, cul- tural and nationality groups in the City of San Bernardino, or in attempting to discourage discriminatory practices against any such group or any of its memberso (d) Cooperate with any City department in identifying and ameliorating htmman relations problems with which they may be concernedo (e) From time to ti.me recommend measures, including - 2 - ~ i s 3 4 S 6 7 8 9 lo 11 12 13 14 ~5 16 17 18 19 ~ 21 22 23 24 25 26 27 29 29 ~ 31 3Y legislation, to the Caumon Council which will serve to i.mprove himman relations within the City. (f) Upon the failure or refusal of any person to appear before the Co~ission, the Coamission may request the Mayor and Co~on Council to issue a subpoena to such person commanding his appearance before the Mayor and Co~on Council and the Co~ission. SECTION FOUR: MEETINGSe The Human Relations Com~ission shall meet not less than once a month in the Council Chambers, City Hall, San Bernardino, California, and shall adopt, by majority vote, such rules as it shall deem expedient for the conduct of its business. If a m~ber of the Com~ission shall fail to attend three consecutive regular meetings without being excused by the Co~is- sion, he shall automatically cease to be a member of the Commission~ and the Mayor shall fill such vacancy as hereinbefore set forth. Each meeting of the Co~ission shall be open to the public and shall be governed by the provisions of the Balph M. Brown Act, Gover~ent Code Sections 54950>S, et seq. of the State of Califor- nia.
