HomeMy WebLinkAbout25331 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 ~ 21 22 23 ~ 25 26 27 28 29 30 31 32 ORDINANCE N0. ~1~ AN ORDINANCE OF THE CITY OF SAN BERNARDINO APPROVING THE ANNEXATION TO THE CITY OF SAN BERNARDINO OF CERTAIN INHABITED TERRITORY DESIGNATED AS "ANNERATION DISTRICT N0, 156", UPON THE TERMS CONTAINED IN THE QUESTION SUBMITTED AT A SPECIAL ELECTION HELD IN SAID TERRITORY ON THE TWENTY-FOURTH DAY OF SEPTEMBER, 1963. WHEREAS, pursuant to the provisions of an Act of the Legislature of the State of California known as the "Annexation Act of 1913", and pursuant to Ordinance No. 2511 adopted by the Mayor and Cotm¢on Council of the City of San Bernardino on the 22nd day of July, 1963, a special election was held on the 24th day of September, 1963, in that certain inhabited territory contiguous to the City of San Bernardino designated as "Annexation District No. 156" and which is hereinafter more particularly described; and WHEREAS, at said special election the following question was sub- mitted to the qualified electors residing in said territory: SHALL ANNERATION DISTRICT N0. 156 BE ANNERED T0, INCORPORATED IN AND MADE A PART OF THE CITY OF SAN BERNARDINO AND THE PROPERTY IN SUCH TERRITORY BE, AETER SUCH ANNERATION, SUBJECT TO TAXATION EQUALLY WITH THE PROPERTY WITHIN THE CITY OF SAN BERNARDINO, TO PAY ITS PRO-RATA PORTION, BASED UPON ASSESSED VALUATION OF ALL BONDED OF THE CITY OF SAN BERNARDINO OUTSTANDING AT THE DATE OF THE FIRST PUBLICATION OF THE NOTICE OF ELECTION FOR ANNEXATION? WHEREAS, it appears from the canvass of the returns of the votes cast at said special election that a majority of all votes cast in said territory on the question of said annexation and the assumption of said indebtedness favor annexation upon the terms contained a.n the question submitted; and WHEREAS, it appears that said special election and all proceedings relating thereto have been conducted strictly in accordance with law. NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: SECTION ONE: That the annexation of that certain inhabited territory contiguous to the City of San Bernardino designated as "Annexation District No, 156" be and the same is hereby approved upon the terms contained 1 ~~ in the aforesaid question which was submitted at the special election held on 2 ~~ the 24th day of September, 1963. Said territory is described as follows; 3 That portion of Lots 11, 12, 13 and 14, Arrowhead Suburban Farms~ Tract "A" as per plat thereof recorded in Book 21 4 of Maps, Page 6, Records of San Bernardino County, State of California, described as follows: 5 Beginning at a point on the present Corporate City Limit 6 line of the City of San Bernardino, said point being at the intersection of the South line of "C" Street as 7 delineated on the map of Arrowhead Suburban Farms, Tract "B", as per plat thereof recorded in Book 21 of Maps, 8 page 44, Records of San Bernardino County, with the East line of Electric Avenue, 40.00 feet wide as delineated 9 on said map of said Arrowhead Suburban Farms, Tract "B"; thence Northerly along said East line of said Electric 10 Avenue and the San Bernardino City Limit line, a distance of 260.00 feet, more or less, to its intersection with 11 the Easterly prolongation of the North line of the property conveyed to Ernest 0. Skeen and Irene S, Skeen, husband 12 and wife, by deed recorded October 24, 1945 in Book 1839, page 60 of Official Records of said County; thence West 13 along said Easterly prolongation and the North line of said Skeen property to the West line of said Lot 14; 14 thence South along said West line of Lot 14, being also the West line of said Skeen property, to its intersection 15 with the Easterly prolongation of the North line of the property conveyed to the Community Bible Church (Independent 16 and Fundamental) of 324 Fortieth Street, San Bernardino, California, a Corp, by deeds recorded November 27, 1945 17 in Book 1834, page 425, Official Records and March 1, 1957 in Book 4168, page 511 Official Records of said County; 18 thence West along said Easterly prolongation and the North lines of said property to the West line of said Lot 13; 19 thence North along said West line a distance of 9.10 feet, more or less, to the Northeast corner of the property ~ conveyed to Roy A. Stewart and Martha G. Stewart, husband and wife, by deed recorded March 24, 1937, in Book 1175, 21 page 77, Official Records of said County; thence West along the North line of said Stewart land and along the North line 22 of the property conveyed to M. 0. Bunnell, a widower, by deed recorded September 2, 1955 in Book 3802, page 222, 23 Official Records of said County, a distance of 257.70 feet, more or less, to the West line of said Lot 12; thence 24 continuing West along the Easterly prolongation of the North line and along the North line of the property 25 conveyed to John 0. Bellinger and A. Virginia Bellinger, husband and wife, by deed recorded September 1, 1950, in 26 Book 2632, page 34, Official Records of said County, and along the North line of the property conveyed to Carl Sanderlin 2~ and Beaulah Sanderlin, husband and wife, by deed recorded August 12, 1957 in Book 4300, page 198 „ Official Records of 28 said County, a distance of 350.00 feet, more or less, to the East line of Acre Lane, 20.00 feet wide, being also the 29 West line of said Lot 11; thence South along said East line of Acre Lane and its Southerly prolongation, 276.00 feet 30 more or less, to the centerline of "C" Street, now known as Fortieth Street, 40.00 feet wide aS delineated on said map 31 of Arrowhead Suburban Farms Tract "A"; thence East along said centerline of said Fortieth Street, 1205.00 feet, 32 more or less, to the Southerly prolongation of the East line - Z - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 of Electric Avenue as delineated on said map of Arrowhead Suburban Farms Tract "A"; thence North along said Southerly prolongation and the East line of said Electric Avenue to the point of beginning. SECTION TWO: The City Clerk shall certify to the adoption of this Ordinance and cause the same to be published three consecutive days, exclusive of holidays, in the San Bernardino Evening Telegram, a newspaper of general circulation in the City of San Bernardino. SECTZON THI2EE: The property herein annexed is declared to be a part of Ward 4 and the boundaries of Ward 4 are hereby altered to include said annexed territory; and said property is placed and declared to be in R-1, Single Family Residential Zone.
