ORDINANCE NO. ~;;7 t, AN ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING ORDINANCE 2 NO. 1991 KNOWN AS THE "lAND USE ZONING ORDINANCE" AND PROVIDING FOR THE REGUlATION OF BUILDING COVERAGE AND PARKING REl,(UIREl1ENTS IN 3 CERTAIN DISTRICTS. 1 4 THE MAYOR fiND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO OR~IN AS FOLLOWS: 5 6 SECTION ONE: Ordinance No. 1991 Section Six Subsection 6.2C pertaining to the building coverage in the "R-3" Multiple Family 7 Residential District is hereby amended to read as follows: 8 "6.2C: BUILDING COVERAGE - The maximum permissab1e building 9 coverage shall be sixty (60) percent of the lot or lots, and shall 10 11 include habitable structures, carports and accessory buildings, attached or detached," 12 SECTION TWO: Ordinance No. 1991 Section Twelve Subsection 13 14 12.4C pertaining to the building coverage in the "C-3" General Commercial District is hereby amended to read as follows: "12.4C: BUILDING COVERAGE - The maximum permissab1e 15 16 coverage by any structure shall be fifty (50) percent of the lot 17 or lots except when there is compliance with the minimum parking 18 requirements," 19 SECTION THREE: Ordinance No. 1991 Section 20,7 pertaining 20 to parking space requirements is hereby amended to read as follows: 21 "20.7: PARKING SPACE REl,(UIREMENTS - Each building or 22 structure hereafter constructed, erected, structurally enlarged 23 or moved from one lot to another shall conform to the following 24 provisions relating to parking space requirements. Notwithstanding 25 any provision in Section 2.1 to the contrary, "parking space" as 26 sed herein shall mean space exclusive of driveways, ramps, columns, 27 loading areas, office or work areas, for the parking of one (1) utomobi1e. ' (I': ><MinJ.nll.un,dimens~ons as per th~s vra~nancfi! 2 3 4 5 6 7 8 9 10 ** Aisle Width - as used in this Ordinance shall mean that , 11 distance, including alleys, directly to the rear of the required 12 space clear of any obstructions and which is used for access to 13 said parking space. 14 All required parking spaces, except those in garages, shall 15 be adequately marked. 16 Access shall be provided by means of a paved driveway, which 17 shall be not less than ten (10) feet wide for a one-way driveway, 18 and not less than eighteen (18) feet wide for a two-way driveway. 19 ere a parking facility for ten or more parking spaces, in the 20 ~ase of a commercial or industrial use, or for fifteen or more 21 parking spaces in the case of a residential use, is provided, not 22 ess than two oneuway driveways or not less than one two-way drive- 23 Nay shall be provided for ingress and egress, except when such 24 [>arking facility is served by a driveway less than fifty (50) feet 25 ~n length measured from property line at point of entry to beginning 26 pf parking facility. 27 Three copies of a plan of the required parking layout shall 28 pe submitted to the Building and Safety Department at the time of ~ ~pplication for any building permit. Said plan shall be fully ~imensioned showing the required number of paved parking spaces 30 fnd ingress and egress as set forth herein, and shall include a 31 etailed and dimensioned layout for paved parking spaces, aisles, 32 -2- 1 2 3 4- 5 6 1, 7 8 9 10 11 12 13 14- 15 16 driveways, wheel or bumper stops, walls, curb cuts, and other improvements. In addition thereto said plans and specifications shall show finished grades and a drainage pattern for the discharge of water. The Superintendent of the Building and Safety Department shall have the discretion to authorize up to a five (5%) percent departure from the off-street parking requirements provided for herein when the proposed parking plan is in conformity to the intent and purpose of said requirements and provides the. number of spaces contemplated by this Ordinance. A. FOR ALL RESIDENTIAL USES: All parking spaces in residential districts shall be on the same lot with the main building or on a lot contiguous to and permanently available for such parking facilities. Such parking spaces shall be located to the rear of the required front setback line or street sideyard setback line, except in mountain areas or on hillside lots where garages or carports may be located in the required front yard when 17 approved by the Commission. Required front yard and street side 18 yards in single family districts shall not be used for required 19 parking spaces, except that such yards may be used for driveways. W No garage entry may be closer than eighteen (18) feet from the 21 street property line except in mountainous areas. This paragraph 22 is subject to and is modified by Section Four, Sub-Section 4.2~D 23 3a and 3b. A paved driveway to the parking spaces shall be provide ~ and the parking spaces and areas shall also be properly surfaced 25 and paved. 26 1. FOR "R-1" RESIDENTIAL DISTRICT - There shall be at 27 least one parking space within a garage or carport for each unit. 28 Notwithstanding the provisions of Section 4.2-D-3-b to the contrary 29 when a detached carport, garage or accessory building is located ~ fifty (50) feet or more to the rear of the front setback line or 31 street side yard setback line on corner lots, the said structures 32 may be located on the interior side or rear property lines if - 3 - 1 onstruction of said structures conforms to the applicable building 2 nd fire codes and regulations, and provision is made for drainage 3 f any water from said structure on to the same lot. Provision for 4 nine (9) foot clear access shall be provided to the rear yard. - 5 2. FOR "R_2", "R-3" and IR-4" - MULTIPLE RESIDENTIAL 6 DISTRICTS - There shall be at least one covered parking space with- 7 in a garage or carport for each unit. In addition to said covered 8 parking requirements the following additional parking requirements 9 shall apply to each building having two or more units. Such 10 additional parking may be either covered or uncovered with paved 11 parking spaces. U a. The additional parking shall be as follows: For each unit with two habitable rooms there shall 13 be one-quarter (1/4) of a parking space required for each unit in 14 addition to the covered parking requirement. 15 b. For each unit with three habitable rooms there 16 shall be one-half (1/2) of a parking space required for each unit 17 in addition to the covered parking requirement. 18 c. For each unit with four habitable rooms there shall 19 be three-quarters (3/4) of a parking space in addition to the ~ covered parking requirement. 21 d. For every unit with five or more habitable rooms 22 there shall be one (1) additional parking space required in addi- 23 tion to the covered parking requirement. ~ Habitable room is herein defined as an enclosed room or sub- 25 division in a residential building commonly used for living purpose . ~ It shall include all enclosed areas designed or potentially usable 27 for sleeping purposes, but not including any lobby, hall, closet, 28 storage space, water closet, bath, kitchen, toilet, slop sink or 29 general utility room, or service porch. When this additional ~ parking requirement is applied to a development, the criteria used 31 shall be the sum derived from the number of habitable roomS of all 32 un~ts, old and new, on the lot or lots. Fractional portions of -4- 1 the sum of the parking spaces will not be required. - 2 B. NON-RESIDENTIAL USE DISTRICTS - For buildings or 3 structures other than dwellings and for uses involving large 4 concentrations of people, there shall be at least one (1) parking 5 space on the same lot with the main building, or on lots immed- 6 iately contiguous thereto and available for use by the occupants, 7 in the following ratios for specific types of use: In no case 8 shall a residentially used lot have its required yard space used 9 for commercial parking or commercial access. Such residential lot 10 depth shall be>not less than one hundred (100) feet deep. Wherever 11 the rear portion of the nonresidential lot is used for commercial 12 parking, it shall conform to Section 8.2-E and Section 20.8. 13 1. FOR CHURCHES, THEATRES, AUDITORIUMS. AND SIMIlAR 14 PLACES OF ASSEMBLY: At least one (1) parking space for every five 15 (5) permanent seats. In cases where temporary or moveable seats 16 are provided for, there shall be one (1) parking space for every 17 fort~ (40) square feet of area within the auditorium or meeting 18 hall. In cases of a use without a building, there shall be one (1) 19 parking space for each five (5) persons normally attending or ro using the facilities. 21 2. FOR HOSPITALS AND INSTITUTIONS - There shall be at 22 least one (1) parking space for every two (2) beds provided for in 23 said building or one (1) parking space for every thousand (1000) ~ square feet of total floor space included within said building, 25 whichever provides the greater number of spaces. 26 3. FOR HOTELS AND CLUBS - There shall be at least one (1) 27 parkin~ space for every two (2) guest rooms for the first forty ~ (40) guest rooms and one (1) space for every four (4) guest roomS ~ over the initial forty (40). ~ 4. FOR TOURIST COURTS AND MOTELS = There shall be one (l) 31 parking space for every individual sleeping room or living unit. 32 In cases where large units may be subdivided into smaller units for -5- / 1 individual use, there shall be a parking space for each of the 2 smaller units. 3 5. FOR COMMERCIAL USES: 4 a. "C_l" Neighborhood Commercial District - There 5 shall be at least one (1) parking space per each one hundred 6 seventy-five (175) square feet of gross floor area. 7 b. "C-2" Community Commercial District - There shall 8 be at least one (1) parking space per each one hundred seventy= 9 five (175) square feet of gross floor area. 10 c. "C_3" and "C-3A" General Commercial District - There 11 shall be at least one (1) parking space per each three hundred and fifty (350) square feet of gross floor area or fraction thereof. d. "C-4" Central Business District: For new buildings, enlargement or increases in capacity of existing buildings, at least one (1) permanently maintained parking space shall be re- quired and for: (1) Commercial building having a gross floor area of less than seven thousand five hundred (7,500) square feet, there shall be one (1) space for each five hundred (500) square feet of said gross floor area; and for: (2) Commercial buildings having a floor area of more than seven thousand five hundred (7,500) square feet, there shall be one (1) parking space per each additional one thousand (1,000) square feet of gross floor area in said building or structure; and for: 5 1/2 OTHER COMMERCIAL USES: a. Public Assembly for Recreational uses within a building, there shall be one (1) parking space for each two hundred fifty (250) square feet of building area; and for: b. FOR "A-P" ADMINISTRATIVE AND PROFESSIONAL DISTRICT: There shall be at least one (1) parking space per each two hundred fifty (250) square feet of gross floor area or fraction in excess of fifty (50%) percent thereof. 7. "C-M" COMMERICAL - MANUFACTURING DISTRICT: parking shal be provided as required in the "C-4" Central Business and "M-l" Light Industrial District for uses listed in those Districts. 8. "11-1" LIGHT INDUSTRIAL DISTRICT: There shall be one (1) off-street parking space for each three (3) permanent employee located within three hundred (300) feet of the property served. I addition there shall be at least one (1) parking space for each truck operated by the concern and one (1) parking space for each sales person permanently employed. 8 1/2. "M-lA" LIMITED LIGHT MANUFACTURING - INDUSTRIAL DISTRICT: Every industrial or business concern, manufacturing establishment or research laboratory hereafter erected or establi- shed shall have: a. One parking space for every 1.2 employees. b. One space for every salesman employed by the concern. c. One space for every truck operated by the concern. 9. "M-2" GENERAL INDUSTRIAL DISTRICT: See provisions for Industrial Uses in the "M-l" Light Industrial District. SECTION FOUR: This Amendment shall be operative on July 1, 1964, ex.cept that where a person has filed with the Building and Safety Department prior to July 1, 1964, an application for a building permit acc~panied by complete plans for the erection of a building or structure which in all respects would comply with the provisions of Ordinance No. 1991 applicable at the time the application for the building permit was filed and with all other ordinances, statutes and regulations, and has paid the applicable -7- 10 11 12 1 plan check fee, and the permit is not issued prior to July 1, 1964, then as to such building or structure the operative date of the ordinance shall be the day after the day on which the building permit is issued or September 1, 1964, whichever is earlier. 2 3 4 5 6 Complete plans as used in this section shall mean final plans and specifications of sufficient clarity to define the nature and extent of the work proposed and to show in detail that it will conform to said Ordinance No. 1991, the building laws and all other relevant laws, ordinances, rules and regu1atio s. Such plans shall include but not be limited to the following: 1. Plot plan showing the location and size of all buildings 7 8 9 13 structures, yards, driveways and parking areas, and a legal 14 description. 15 2. Architectural plans including floor plans, elevations, 16 cross sections and details. 17 3. Structural plans including foundation plans, framing 18 plans and constructioa: details for all portions of the structure ,'- 20 19 as required. 4.
