2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO APPROVING THE ANNEXATION OF DISTRICT NO. 164.

WHEREAS, heretofore, proceedings were initiated by the Common
5
Council of the City of San Bernardino, on its own motion, to annex to the
6
City of San Bernardino certain contiguous uninhabited territory hereinafter
7
described; and
8
WHEREAS, on the 14th day of September, 1964, a resolution was
9
adopted by the aforesaid Common Council of the City of San Bernardino,
10
California, declaring that proceedings had been initiated by said Council,
11
and proposing the annexation, for the reasons therein stated, of the
12
aforementioned uninhabited territory to the City of San Bernardino, and that
13
said resolution provided that the proposed annexation should be generally
14
known and identified as Annexation District No. 164; and
15
WHEREAS, said resolution set forth therein that all the property
16
included in the aforesaid territory should be taxed equally with the other
17
property within the said City to pay the bonded indebtedness and any and all
18
general indebtedness and liability of the City of San Bernardino contracted
19
prior to or existing or outstanding at the time of the aforesaid proposed
20
annexation of the aforesaid property as provided in the hereinbefore
21
mentioned Government Code; and

WHEREAS, said resolution did fix, determine and declare that a
23
hearing be held on the 26th day of October, 1964, at the hour of 9:30 A. M.
24
in the Council Chambers of the City Hall in the City of San Bernardino, and
25
the same was the day, hour and place designated where. ~ny person owning real
26
estate within such territory so proposed to be annexed and having any
27
objections to the proposed annexation might object before the Common Council
28
and show cause why such territory should not be annexed; and, furthermore,
29
the said resolution provided that at any time not later than the said hour
30
set, as mentioned hereinbefore for the. said hearing, any owner of property
31
within the said territory proposed to be annexed might file written protest
32
wjth the City of San Bernardino against such annexation; and
1 WHEREAS, no written protests of any kind or nature whatsoever were
2 filed with the City Clerk of the City of San Bernardino prior to 9:30 o'clock
3 A. M. on the 26th day of October, 1964.
4 WHEREAS, on the 26th day of October, 1964, the date set for the
5 hearing of protests against the proposed annexation, Resolution No. 7418 was
6 adopted by the Common Council of the City of San Bernardino declaring that a
7 majority of protests has not been presented; and
8 WHEREAS, it appears to the Common Council of the City of San
9 Bernardino that the aforesaid annexation proceedings have been completed and
10 everything performed at this time in accordance with said Government Code,
11 as mentioned hereinbefore, and any and all other laws in any way connected
12 with the said annexation procedure having been complied with; and
13 WHEREAS, the Common Council of the City of San Bernardino, desire
14 to approve at this time the annexation of the aforesaid territory.
15 NOW, THEREFORE, THE COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
16 DOES HEREBY ORDAIN AS FOLLOWS:

SECTION ONE: That said territory herein described as Annexation
18
District No. 164 is hereby annexed and incorporated in and made a part of the
19
City of San Bernardino.

SECTION TWO: The territory herein referred to as being annexed to
21
the City of San Bernardino is particularly described as follows, to wit:

Those portions of Section 4, 5, 6, 7, 8, 9, 16, and 17,
Township 1 North, Range 4 West, San Bernardino Base and
Meridian if said Section lines were extended across the
Muscupiabe Rancho as per plat thereof recorded in Book 7
of Maps, Page 23, Records of the County Recorder, San
Bernardino County, State of California and that portion
of Wiggins Tract as per plat thereof, recorded in Book
3 of Maps, Page 74, records of said County, described as
follows:

Commencing at Station 26 as delineated on the map of said
Muscupiabe Rancho, said point being on the present
corporate limits of the City of San Bernardino; thence
South 390 30' East along said Corporate Limit Line, 600.90
feet to the true point of beginning; thence Southeasterly
along said Northerly line of Muscupiabe Rancho to Station
No. 27 as delineated on said Map of Muscupiabe Rancho;
thence Easterly along said North line of Muscupiabe Rancho
to the intersection with the North-South center line of
said Section 5; thence South along said center line and
the North-South center line of said Section 8 to a

Northerly line of Parcel No. 4 as described in the deed to
the San Bernardino County Flood Control District, recorded
April 23, 1940 in Book 1415, Page 37, Official Records of
said County, said Northerly line being described in said
deed as, "thence South 820 40' East, 513.88 feet to the
beginning of a curve concave to the right with a central
angle of 230 33' 30" and a radius of 2050 feet"; thence
South 820 40' East to the termination of the above
mentioned course; thence along said curve 842.90 feet;
thence North 720 10' 30" East, 318.82 feet; thence South
690 17' 30" East, 302.06 feet; thence North 840 50' East,
906.65 feet to the West line of that certain parcel
conveyed to C. F. Martin by deed recorded in Book 740 of
Deeds, Page 199, records of said County; thence Northerly
along the West line of said Martin property to the Northwest
corner thereof; thence Easterly along the North line of
said Martin property to the Northeast corner thereof;
thence South 220 36' West, 626.13 feet; thence South 410
08' West 241.56 feet; thence South 100 58' East, 127.05
feet; thence South 410 09' West, 50.00 feet to the most
Northerly point of that certain parcel No. 4 as described
in said deed to the San Bernardino County Flood Control
District; thence South 390 05' East, 85.12 feet to the
most Northwesterly corner of that certain parcel of land
conveyed to the San Bernardino County Flood Control District
by deed recorded September 25, 1956, in Book 4046, Page 396,
Official Records of said County; thence South 590 47' 20"
East, 595.66 feet; thence Soutp 290 29' West, 700.0 to the
most Southerly corner of the last mentioned deed to the
San Bernardino County Flood Control District; thence South

Northerly termination of a line described in said parcel
No. 4 in the above mentioned deed to the San Bernardino
County Flood Control District; said line being described

said parallel line to the point of intersection with a
line that is the Westerly prolongation of a line that is
210.00 feet South of, measured at right angles to and
parallel with the North line of Lot 140, Tract 1748 as
per plat thereof recorded in Book 25, of Maps, Page 59,
Records of said County; thence Easterly along said
Westerly prolongation of said last mentioned line to the
West line of Lot 139 of said Tract No. 1748; thence
Southerly along the West line of Lots 139, 138, 137 and
136 of said Tract 1748, being the East line of Western
Avenue, to the Northwest corner of Lot 135 of said Tract
1748, said point being on the present corporate limits
of said City; thence along the boundaries of said City,
the following bearings and distances; thence continuing
Southerly along said East line of Western Avenue to a

straight line to a point that is South 210 48' East,

Station No. 26 as delineated on the map of 'said
Muscupiabe Rancho; thence North 210 48' West 1608.00
feet; thence North 00 25' West to a point that is
1151.44 feet South of said Station No. 26; thence South
390 30" East, 600.90 feet; thence North 00 25' West
1151.44 feet to the True Point of Beginning.

SECTION THREE: That the aboye described property will be subject to

taxation equally with the property within such municipal corporation to pay
9
its proportion of the following bonded indebtedness of the City of San
10
Bernardino, which said bonded indebtedness was outstanding or theretofore
11
authorized and is outstanding at the time of said annexation, to wit:

A bonded indebtedness of $490,000.00 incurred for the acquisition
13
and construction of a public library, including additions to and enlargements
14
of the public library system of said City, the outstanding indebtedness
15
thereon being $390,000.00, bearing interest at the rates of 4 3/4%, 3 1/4%
16
and 3 1/2% per annum;
17
A bonded indebtedness of $1,116,000.00 incurred for the acquisition
18
and construction of additions to, relocations of and replacements of the fire
19
fighting system of said City, the outstanding indebtedness thereon being
$1,045,000.00, bearing interest at the rates of 4%, 3%, 2 1/2%, 2 3/4% and
21 2.9% per annum.
SECTION FOUR: The property herein annexed is declared to be a
part of Ward 5 and the boundaries of Ward 5 are hereby altered to include

said annexed territory; and said property is placed and declared to be in
R-1 Single Family Residential Zone.

SECTION FIVE: The City Clerk shall certify to the passage of this
27
Ordinance and shall cause the same to be published three consecutive times,
28
exclusive of holidays, in the San Bernardino Evening Telegram, a daily
29
newspaper designated for that purpose.

I HEREBY CERTIFY that the foregoing Ordinance was duly adopted by

the Mayor and Common Council of the City of San Bernardino at an adjourned
