HomeMy WebLinkAbout2618 22 23 25 26 29 32 1 ORDINANCE NO._!::..>rt / ~ 2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO APPROVING THE ANNEXATION OF DISTRICT NO. 165. 3 4 WHEREAS, heretofore, proceedings were initiated by the Common 5 Council of the City of San Bernardino, on its own motion, to annex to the 6 City of San Bernardino certain contiguous uninhaibted territory hereinafter 7 described; and 8 WHEREAS, on the 14th day of September, 1964, a resolution was 9 adopted by the aforesaid Common Council of the City of San Bernardino, 10 California, declaring that proceedings had been initiated by said Council, 11 and proposing the annexation, for the reasons therein stated, of the 12 aforementioned uninhabited territory to the City of San Bernardino, and that 13 said resolution provided that the proposed annexation should be generally 14 known and identified as Annexation District No. 165; and 15 WHEREAS, said resolution set forth therein that all the property 16 included in the aforesaid territory should be taxed equally with the other 17 property within the said City to pay the bonded indebtedness and any and all 18 general indebtedness and liability of the City of San Bernardino contracted 19 prior to or existing or outstanding at the time of the aforesaid proposed 20 annexation of the aforesaid property as provided in the hereinbefore 21 mentioned Government Code; and WHEREAS, said resolution did fix, determine and declare that a hearing be held on the 26th day of October, 1964, at the hour of 9:30 A. M. 24 in the Council Chambers of the City Hall in the City of San Bernardino, and the same was the day, hour and place designated where any person owning real estate within such territory so proposed to be annexed and having any 27 objections to the proposed annexation might object before the Common Council 28 and show cause why such territory should not be annexed; and, furthermore, the said resolution provided that at any time not later than the said hour 30 set, as mentioned hereinbefore for the said hearing, any owner of property 31 within the said territory proposed to be annexed might file written protest w~th the City of San Bernardino against such annexation; and 1 WHEREAS, no written protests of any kind or nature whatsoever were 2 filed with the City Clerk of the City of San Bernardino prior to 9:30 o'clock 3 A. M. on the 26th day of October, 1964. 4 WHEREAS, on the 26th day of October, 1964, the date set for the 5 hearing of protests against the proposed annexation, Resolution No. 7419 was 6 adopted by the Common Council of the City of San Bernardino declaring that a 7 majority of protests has not been presented; and 8 WHEREAS, it appears to the Common Council of the City of San 9 Bernardino that the aforesaid annexation proceedings have been completed and 10 everything performed at this time in accordance with said Government Code, 11 as mentioned hereinbefore, aU9 any and all other laws in any way connected 12 with the said annexation procedure having been complied with; and 13 WHEREAS, the Common Council of the City of San Bernardino desire 14 to approve at this time the annexation of the aforesaid territory. 15 NOW, THEREFORE, THE COMMON COUNCIL OF THE CITY OF SAN BERNARDINO 16 DOES HEREBY ORDAIN AS FOLLOWS: 17 SECTION ONE: That said territory herein described as Annexation 18 District No. 165 is hereby annexed and incorporated in and made a part of the 19 City ef San Bernardino. ~ SECTION TWO: The territory herein referred to as being annexed to 21 the City of San Bernardino is particularly described as follows, to wit: 22 That portion of Sections 17, 18, and 19, Township 1 North, Range 4 West, San Bernardino Base and Meridian, if said Section lines were extended across the Muscupiabe Rancho as per plat thereof recorded in Book 7 of Maps, Page 23, Records of the County Recorder, San Bernardino County, State of California and all of Tract No. 3398 as per plat thereof recorded in Book 46 of Maps, Pages 14 and 15, Records of said County and all of Tract No. 3440 as per plat thereof recorded in Book 46 of Maps, Page 8, Records of said County, and that portion of Irvington Land and Water Company's Subdivision as per plat thereof recorded in Book 1, Records of Survey, Page 32, records of said County, described as a whole as follows: 23 ~ 25 26 ~ 28 29 Beginning at a point on the Present Corporate Limits of the City of San Bernardino, said point being the Northeast corner of said Section 18; thence South along the East line of said Section 18 and the West line of Lot 2, Block 3, Wiggins Tract as per plat thereof recorded in Book 3 of Maps, Page 74, Records of said County, to the Southwest corner of said Lot 2; thence leaving said Corporate Limit Line Southerly along the East line of said Section 18, a distance of 190.00 feet more or less to the center line ~ 31 32 - 2 - 1 of Kendall Drive; thence Southeasterly along said center line of Kendall Drive to the intersection of the center line of that certain 60.00 foot strip of land, known as State Street as described in the deed to San Bernardino County Flood Control District by deed recorded February 28, 1945, in Book 1735, Page 358, Official Records of said County; thence Southerly along said center line of State Street to the intersection with the center line of State Highway No. 395; thence Northwesterly along said center line of State Highway 395 to the intersection of the center line of Orange Avenue, said Orange Avenue being vacated as per the minutes of the County Board of Super- visors, recorded in Book "F", Page 210, Records of the County Surveyor of said County; thence Northeasterly along said center line of Orange Avenue to the center line of said Kendall Drive; thence Southeasterly along said center line of Kendall Drive to the intersection with the South- westerly prolongation of the Southeasterly line of that certain parcel of land conveyed to Faye B. Davis, a married woman, by deed recorded April 5, 1955 in Book 3612, Page 155, Official Records of said County; thence Northerly along said Southwesterly prolongation and Southeasterly line to the North line of said Section 18; thence East along said North line a portion thereof being the Corporate Limit Line of said City to the point of beginning. 2 3 4 5 6 7 8 9 10 11 12 13 14 15 SECTION THREE: That the above described property will be subject to 16 taxation equally with the property within such municipal corporation to pay 17 its proportion of the following bonded indebtedness of the City of San 18 Bernardino, which said bonded indebtedness was outstanding or theretofore 19 authorized and is outstanding at the time of said annexation, to wit: 20 A bonded indebtedness of $490,000.00 incurred for the acquisition 21 and construction of a public library, including addi~ions to and enlargements 22 of the public library system of said City, the outstanding indebtedness 23 thereon being $390,000.00, bearing interest at the rates of 4 3/4%, 3 1/4% 24 and 3 1/2% per annum; 25 A bonded indebtedness of $1,116,000.00 incurred for the acquisition 26 and construction of additions to, relocations of and replacements of the fire 27 fighting system of said City, the outstanding indebtedness thereon being 28 $1,045,000.00, bearing interest at the rates of 4%, 3%, 2 1/2%, 2 3/4% and 29 2.9% per annum. 30 SECTION FOUR: The property herein annexed is declared to be a part 31 of Ward 5 and the boundaries of Ward 5 are hereby altered to include said 32 a~nexed territory; and said property is placed and declared to be in R-l - 3 - 10 11 12 13 14 15 16 1 Single Family Residential Zone. 2 SECTION FIVE: The City Clerk shall certify to the passage of this 3 Ordinance and shall cause the same to be published three consecutive times, 4 exclusive of holidays, in the San Bernardino Evening Telegram, a daily 5 newspaper designated for that purpose. 6 I HEREBY CERTIFY that the foregoing Ordinance was duly adopted by 7 the Mayor and Common Council of the City of San Bernardino at an adjourned 8 ~?-:T L , day of '7~1d-MM(U/ regular meeting thereof, held on the 9 1964, by the following vote, to wit: AYES: Councilmen V /' -1 ~ y' ~ /kUe- / 7~d..- NOES: ABlfuNT : a/cu-J ~ c;;;:-~</ City Clerk 17 The foregoing Ordinance is hereby approved this /c:Jd day 18 of ;?;~v , 1964. 19 20 21 22 23 24 25 26 27 28 29 30 31 32 Mayor of the of San Bernardino Approved as to form: c{f~~~~ FI LED NO" 1 01964 ~.
