AN ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING ORDINANCE
NO. 1991 KNOWN AS THE "LAND USE ZONING ORDINANCE"; AND PROVIDING
FOR THE LOT AREA~ DIMENSIONS AND OTHER CONDITIONS TO USE IN THE
"R-l" AND "R-3" lJISTRICTS.
THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:
SECTION ONE: Ordinance No. 1991 Section Four Sub-section
4.2 A. is hereby amended to read as follows:
"A. AREA AND DIMENSIONS - the following area and 'dimenSion
provisions shall apply in the flR-l" District, except that where
a lot has a width of less than sixty (60) feet or an area of less
than 7200 square feet and was held under separate ownership or
was of record at the time Ordinance No. 1991 became effective,
such lot may be occupied by any use permitted in the district.
1. MINIMUM AREA - Except as provided for above, the minimum
lot area in the "R-l" District shall not be less than 7200 square
feet. It is further provided, to implement the recommendations
of the adopted General Plan, that minimum lot areas greater than
7200 square feet and minimum lot widths greater than 60 feet may
be established and delineated on the Zoning Map in accordance with
the following tables:

10 "6.2 MINIMUM LOT AREA, LOT DIMENSIONS AND OTHER CONDITIONS

AREA AND DIMENSIONS - The following area and dimension

16 ownership or was of record at the time Ordinance No. 1991 became
17 effective, such lot may be occupied by any use permitted in the
18 district subject to the area per dwelling unit requirement.

~ When the total lot area exceeds any multiple of the minimum lot
31 area per dwelling unit by fifty (50%) per cent or more of said
32 mipimum lot area per dwelling unit, one (1) additional dwelling

1 unit shall be permitted.
2 2. MINIMUM WIDTH - Sixty (60) feet.
3 3. MINIMUM DEPTH - One hundred thirty-five (135) feet."
4 SECTION THREE: This Ordinance is an urgency law necessary
5 for the immediate preservation of the public peace, health and
6 safety and shall go into effect, after its adoption, approval and
7 publication. The facts constituting such necessity are:
8 Ordinance No. 2484 which established a restrictive interim
9 Land Use Plan and District within the area of influence of
10 the new State College will be inoperative after February 19,
11 1965. Therefore, it is necessary that uniform zoning require~
12 ments for the "R--l" and "R-3" Districts be established at
13 the earliest date before February 19, 1965, in order that
14 the area in the zone of influence of the State College will
15 have necessary conditions to use compatible with the General
16 Plan and the new Zoning plan for such area. and similar to
17 other like zoning districts in the City.
18 SECTION FOUR: If any section, sub-section, sentence, clause
19 or phrase of this Ordinance is for any reason held to be invalid
W or unconstitutional by the decision of any court of competent
21 jurisdiction, such decision shall not affect the validity of the
22 remaining portions of the Ordinance. The Common2Council hereby
23 declares that it would have passed this Ordinance and each section,
24 sub-section, sentence; clause and phrase hereof, irrespective of
25 the fact that anyone or more of the sections, sub-sections,
26 sentences, clauses or phrases hereof be declared invalid or
27 unconstitutional.

29 by the Mayor and Common Council of the City of San Bernardino at
