ORDINANCE NO 2649
AN ORDINANCE OF THE CITY OF SAN BERNARDINO APPROVING AND
ADOPTING THE REDEVELOPMENT PLAN FOR CENTRAL CITY PROJECT NO.1,
CALIF.. R..79.
WHEREAS, the Redevelopment Agency of the City of San Bernardin4,
California, (hereinafter referred to as the "Agency") has formulateJ,
prepared and duly adopted a Redevelopment Plan for the Central City
Project No.1, Calif. R-79; and
WHEREAS, the Planning Commission of the City of San Bernardino
has submitted its report and recommendation, recommending appro.al
of said Redevelopment Plan; and
WHEREAS, the Agency has adopted rules for owner participation
Qnd rules for reasonable preference for persons in business in the
Project Area; and
WHEREAS, the Agency has submitted to the Common Council of
the City. of San Bernardino said Redevelopment Plan, accompanied by
the Report of the Agency, as required by Section 33352 of the
California Health and Safety Code; and
WHEREAS, this Common Council considered and prescribed certain
covenants, conditions and restrictions for said Redevelopment Plan,
as set forth in Addenda to said Plan, pursuant to Section 33338 of
the California Health and Safety Code; and
WHEREAS~ all action required by law has been taken by all
appropriate public agencies; and
WHEREAS, after due notice, public hearings have been held by
the Agency and this Common Council; and
WHEREAS, at said public hearings the Agency and this Common
Council did consider all matters required by law;
NOW;) THEREFORE,~ the Mayor and Common Council of the City of
San Bernardino do ordain as follows:

22 SECTION TWO: The purposes and intent of the Common Council
,-
23 with respect to the Project Area are to,:
M (a) Eliminate the conditions of blight existing in the Projec
25 Area;
~ (b) Insure, as far as possible, that the causes of the
n blighting conditions will be either eliminated or protected against;
28 (c) Provide participation for owners and a reasonable pre-
~ fer~nce for persons engaged in business in the ~Project Area;
~ (d) Encourage and insure the rehabilitation, rebuilding, and
31 development of the Project Area;
32 (e) Encourage and foster the economic revitalization of the

1 Project Area;
2 (f) Relocate the owners and occupants of the Project Area
3 as needed; and
4 (g) Redevel~p and rebuild the public facilities in the
5 Project Area to provide safe and more efficient service for the
6 people in the area and the general public as a whole_
7 SECTION THREE: The Redevelopment Plan, together with said
8 Addenda, for the Central City Project No~ 1 hereby is incorporated
9 herein by reference and made a part hereof as fully as if it were
10 set out at length herein.
11 SECTION FOUR:: Said Redevelopment Plan for the Central City
12 Project No. 1 hereby is approved and adopted and designated as
13 the Official Redevelopment Plan for the Central City Project No.1,
14 Calif. R:-79 Area.
15 SECTION FIVE: The Connnon Council hereby finds and det;ermines
16 that:
17 (a) The Project Area is a blighted area~ the redevelopment
18 of which is necessary to effectuate the public purposes declared
19 in the Community Redevelopment Law of the State of California;
~ (b) Said Redevelopment Plan for the Central City Project
21 No. 1 will redevelop the Project Area in conformity with the
22 Community Redevelopment Law of the State of California and in the
23 interests of the public peace, health, safety and welfare;
24 (c) The adoption and carrying out of said Redevelopment Plan
25 for the Central City Project No,,' 1 is economically sound and
26 feasible;
27 (d) Said Redevelopment Plan for the Central City Project No.
28 1 conforms to the adopted General (Master) Plan of the City of San
29 Bernardino;
30 (e) The carrying out of said Redevelopment Plan for the
31 Central City Project No. 1 will promote the public peace, hea.lth~
32 saf~ty and welfare of the City of San Bernardino~ and will effectM
uate the purposes and policies of the Connnunity Redevelopment Law

of the State of California;
(f) The condemnation of real property; as provided for in
the Redevelopment Plan for the Project Area, is necessary to the
execution of that Plan and adequate provisions have been made for
payment for property to be acquired as provided by law;
(g) The Agency has a feasible method and plan for the
relocation of families and persons to be temporarily or permanentl
displaced from housing facilities in the Project Area;
(h) There are or are being provided in the Project Area, or
in other areas not generally less desirable in regard to public
utilities and public and commercial facilities and at rents or

prices within the financial means of the famili;s and persons
displaced from the Project Area, decent, safe, and sanitary dwell-
ings equal in number to the number of and available to such dis-
placed families and persons and reAsonably accessible to their
places of employment;
(i) The financial aid provided and to be provided in the
f~deral contracts is necessary to enable land in the Project Area
to be redeveloped in accordance with the Redevelopment Plan for
the Project Area;
U) In order to implement and facilitate the effectuation of
said Redevelopment Plan hereby approved and adopted, it is found
and determined that certain official action must be taken by this
Common Council with reference, among other things, to changes in
zoning,' the opening, closing,' abandoning, widening or changing the
26 grade of streets, and other modification of street layouts, and
27 the establishment and opening of malls; and other public action,

28 and accordingly, this Common Council hereby:

(1) Pledges its cooperation in helping to carry out
30 such Redevelopment Plan;

(2) Requests the various officials, departments,
32 G~ds and agencies of the City of San Bernardino having administrat

1 ive responsibilities in the premises likewise to cooperate to such

end and to exercise their respective functions and powers in a
3 ,I manner consistent with said Redevelopment Plan; and

Stands ready to consider and take appropriate

5 action upon proposals and measures designed to effec'tuate said
6 Redevelopment Plan';

'SECTION SIX:
This Common Council is satisfied permanent
8 housing facilities will be available within three years from the
9 time occ~pants of the Project Area are displaced and that pending
10 the development of such facilities there will be available to such
11 displaced occupants adequate temporary housing facilities at rents
12 comparable to those in the City of San Be~ardino at the time of
13 their disp lacement"
14 SECTION SEVEN: All written and oral objections to said
15 Redevelopment Plan hereby are overruled~
16 SECTION EIGHT: The Oity Clerk hereby is directed to send a
17 certified copy of this Ordinance to the Agency. and the Agency
18 hereby is vested with the responsibility for carrying out the
19 Redevelopment Plan for the Central City Project No" 1. CALIF!;,: R-79"
20 SECTION NINE: The City Clerk hereby is directed to record
21 with the County Recorder of San Bernardino County. California. a
22 description of the land within the Project Area. and a statement
23 that proceedings for the redevelopment of the Project Area have
24 been instituted under the California Community Redevelopment Law.
25 The Agency hereby is directed to effectuate recordation of a copy
U of said Redevelopment Plan in compliance with the provisions of
27 Section 27295 of the Government Code to the extent applicable"
28 SECTION TEN: The Building Department of the City of San
~ Bernardino hereby is directed for a period of two years after the
~ effective date of this Ordinance to advise all applicants for
31 building permits that the site for which a building permit is
32 sou~ht for the construction of buildings or for other improvements

SECTION ELEVEN:
The City Clerk is directed to transmit a
3 copy of this Ordinance to the Auditor and Tax Assessor of San
4 Bernardino County, and to the governing body of each of the taxing
5 agencies 1thich levies taxes upon any property in the Project Area..
6 SECTION TWELVE,: The City Clerk shall cl;lrtify to thl;l adoption
7 of this Orl!1inancl;l,sb&ll".cause thl;l same to be published for three
8 consecutive days in the Evening Telegram, a daily newspaper
9 published in the City of San Bernardino; California, and the same
10 shall go into effect and be in full force and operation from and
11 after thirty (30) days after its final passage and adoption.
