AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO APPROVING THE ANNEXATION OF DISTRICT NO. 171. WHEREAS, heretofore, proceedings were initiated by the Common Council of the City of San Bernardino, on its own motion, to annex to the City of San Bernardino certain contiguous uninhabited territory hereinafter described; and WHEREAS, on the 3rd day of May, 1965, a resolution was adopted by the aforesaid Common Council of the City of San Bernardino, California, declaring that proceedings had been initiated by said Council, and proposing the annexation, for the reasons therein stated, of the aforementioned uninhabited territory to the City of San Bernardino, and that said resolution provided that the proposed annexation should be generally known and identified as Annexation District No. 171; and WHEREAS, said resolution set forth therein that all the property included in the aforesaid territory should be taxed equally with the other property within the said City to pay the bonded indebtedness and any and all general indebtedness and liability of the City of San Bernardino contracted prior to or existing or outstanding at the time of the aforesaid proposed annexation of the aforesaid property as provided in the hereinbefore mentioned Government Code; and WHEREAS, said resolution did fix, determine and declare that a hearing be held on the 14th day of June, 1965, at the hour of 9:30 o'clook A. M. in the Council Chambers of the City Hall in the City of San Bernardino, and the same was the day, hour and place designated where any person owning real estate within such territory so proposed to be annexed and having any objections to the proposed annexation might object before the Common Council and show cause why such territory should not be annexed, and, furthermore, the said resolution provided that at any time not later than the said hour set, as mentioned hereinbefore for the said hearing, any owner of property within the said territory proposed to be annexed might file written protest w~h the City of San Bernardino against such ~nnexation; and 1 WHEREAS, no written protests of any kind or nature whatsoever were 2 filed with the City Clerk of the City of San Bernardino prior to 9:30 o'clock 3 A. M. on the 14th day of June, 1965. 4 WHEREAS, on the 14th day of June, 1965, the date set for the hearing 5 of protests against the proposed annexation, Resolution No. 7751 was adopted 6 by the Common Council of the City of San Bernardino declaring that a majority 7 of protests has not been presented; and 8 WHEREAS, it appears to the Common Council of the City of San 9 Bernardino that the aforesaid annexation proceedings have been completed and 10 everything performed at this time in accordance with said Government Code, 11 as mentioned hereinbefore, and any and all other laws in any way connected 12 with the said annexation procedure having been complied witb; and 13 WHEREAS, the Common Council of the City of San Bernardino desire 14 to approve at this time the annexation of the aforesaid territory. 15 NOW, THEREFORE, THE COMMON COUNCIL OF THE CITY OF SAN BERNARDINO 16 DOES HEREBY ORDAIN AS FOLLOWS: 17 SECTION ONE: That said territory herein described as Annexation 18 District No. 171 is hereby annexed and incorporated in and made a part of the 19 City of San Bernardino. 20 SECTION TWO: The territory herein referred to as being annexed to 21 the City of San Bernardino is particularly described as follows, to wit: 22 Those portions of Blocks "A" and "B", Tract 1938 as p.er plat thereof recorded in Book 28 of Maps, page 24, records of the County Recorder of San Bernardino County, State of California, and that portion of Hillcrest Avenue, vacated, adjoining said Tract on the South, described as follows: 23 24 25 26 Beginning at the point of intersection of the Present Corporate Limits of the City of San Bernardino with the South line of Hillcrest Avenue, 30.00 feet wide, vacated, as delineated on the map of said Tract 1938; thence West along the South line of said Hillcrest Avenue; vacated, to its intersection with the Southerly prolongation of the West line of Lot 18, Block "A" of said Tract 1938; thence North along said Southerly prolongation and the West line of said Tract 1938 and the Colton City Limit line and the Northerly prolongation of the West line of said Tract 1938 a distance of 805.03 feet to a point on the North line of Grant Street, 35.10 feet wide as delineated on said Map of Tract 1938, said point being the Northwest corner of Lot 31, Block 54, 27 28 29 30 31 32 - 2 - 1 Rancho San Bernardino as per plat thereof recorded in Book 7 of Maps, page 2, records of the County Recorder of said County; thence South 030 OS' 00" East along said San Bernardino City Limit line, a distance of 374.60 feet to an angle point therein; thence South 350 10 rOO" East along said San Bernardino City Limit line to the point of beginning. 2 3 4 5 SECTION THREE: That the above described property will be subject 6 to taxation equally with the property within such municipal corporation to 7 pay its proportion of the following bonded indebtedness of the City of San 8 Bernardino, which said bonded indebtedness was outstanding or theretofore 9 authorized and is outstanding at the time of said annexation, to wit: 10 A bonded indebtedness of $490,000.00 incurred for the acquisition 11 and construction of a public library, including additions to and enlargements 12 of the public library system of said City, the outstanding indebtedness 13 thereon being $370,000.00, bearing interest at the rates of 4 3/4%, 3 1/4% 14 and 3 1/2% per annum; 15 A bonded indebtedness of $1,116,000.00 incurred for the acquisition 16 and construction of additions to, relocations of and replacements of the 17 fire fighting system of said City, the outstanding indebtedness thereon being 18 $1,000,000.00, bearing interest at the rates of 4%, 3%, 2 1/2%, 2 3/4% and 19 2.9% per annum. 20 SECTION FOUR: The property herein annexed is declared to be a 21 part of Ward 3 and the boundaries of Ward 3 are hereby altered to include 22 said annexed territory, and said property is placed and declared to be in 23 R-1-7200 Single Family Residential Zone. 24 SECTION FIVE: The City Clerk shall certify to the passage of this 25 Ordinance and shall cause the same to be published three consecutive times, 26 exclusive of holidays, in the San Bernardino Evening Telegram, a daily 27 newspaper designated for that purpose. 28 I HEREBY CERTIFY that the foregoing Ordinance was duly adopted by t1?~ City ~f San Bernardino ~gufar meeting j;L~1tL 29 the Mayor and Common Council of the /;( ,.f dday of , 1965, by the 30 thereof, held on the 31 following vote, to wit: 32 - 3 - 1 AYES: Councilmen 2 3 NOES: 4 5 6 7 8 9 The foregoing (~~~ 10 of 11 12 13 14 15 16 Approved as to form: 17 4lnZF ABSENT: ()Jch~ ~ ~..~ 01 City Clerk Ii Ordinance is hereby approved this ~j1 day , 1965. 18 (~~~~ City Att ney 19 20 21 22 23 24 25 26 27 28 29 30 31 32 4 " ;'1 ,~ iPfd t - 4 - Mayor~e ~y~~~~
