HomeMy WebLinkAbout2682 10 12 13 14 15 16 20 21 22 23 24 25 26 1 NOTICE OF ELECTION ORDINANCE NO. ~ If F ~ 2 AN ORDINANCE OF THE CITY OF SAN BERNARDINO CALLING A SPECIAL ELECTION TO BE HELD ON THE TWENTY-SIXTH DAY OF OCTOBER, 1965, PERTAINING TO THE ANNEXATION OF A DISTRICT CALLED: 3 4 "ANNEXATION DISTRICT NO. 173" 5 WHEREAS, by Resolution, the Mayor and Common Council of the City 6 of San Bernardino declared its intention to call a special election to be 7 held in certain inhabited territory contiguous to said City proposed to be 8 annexed to said City for the purpose of submitting to the qualified electors 9 residing in said territory the question whether or not said territory shall be annexed to said City; and 11 WHEREAS, a copy of said Resolution was published as required by law; and WHEREAS, at a time not later than the hour set by said Resolution for hearing objections to the proposed election, no written protests were made by the owners of one-half of the value of the territory proposed to be annexed as shown by the last equalized assessment roll of the property 17 within the territory proposed to be annexed; and 18 WHEREAS, thereafter on the 16th day of August, 1965, Resolution 19 No. 7828 was adopted by the Mayor and Common Council declaring that a majority protest has not been presented; and WHEREAS, all proceedings have been had in accordance with said Resolutions and the Annexation Act of 1913, reference thereto hereby being made for further particulars. NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: SECTION ONE: A special election hereby is called, to be held on 27 the 26th day of October, 1965, in the territory hereinafter described and 28 proposed to be annexed to the City of San Bernardino, for the purpose of 29 submitting to the qualified electors residing in said territory the question 30 whether or not such territory shall be annexed to, incorporated in and made 32 ~aid territory shall, after such annexation, be subject to taxation equally 31 a part of said City of San Bernardino, and whether or not the property in 10 13 14 15 20 21 22 23 24 25 26 1 with the property within the City of San Bernardino to pay the entire bonded 2 indebtedness of the City of San Bernardino outstanding at the date of the 3 first publication of the notice of election for annexation. 4 Said territory is described as follows: 5 Those certain Tracts and portions of Tracts 3732 as per plat thereof recorded in Book 48 of Maps, pages 39 and 40; Tract 1741 as per plat thereof recorded in Book 27 of Maps, page 41; Tract 4417 as per plat thereof recorded in Book 57 of Maps, page 55; Tract 4000 as per plat thereof recorded in Book 52 of Maps; page 84; Tract 2902 as per plat recorded in Book 40 of Maps, pages 40, 41, 42; Tract 3654 as per plat thereof recorded in Book 57 of Maps, page 39; Tract 3429 as per plat thereof recorded in Book 55 of Maps, page 45; Tract 4698 as per plat thereof recorded in Book 58 of Maps, page 30; Tract 3995 as per plat thereof recorded in Book 53 of Maps, pages 93 and 94; Hockaday Subdivision as per plat thereof recorded in Book 8 of Maps, page 90; Rancho Muscupiabe as per plat thereof recorded in Book 11 of Maps, page 38 and that portion of Lot 8, Block 58, Rancho San Bernardino as per plat thereof recorded in Book 7 ofcMaps, page 2, records of the County Recorder of San Bernardino County, State of California, described as follows: 6 7 8 9 11 12 16 Beginning at the intersection of the Northerly prolon- gation of the centerline of California Street, 60.00 feet wide with the Northeasterly line of the Atchison, Topeka and Santa Fe Railway Company's Right of Way; thence South 380 31' 55" East along said Northeasterly line of the Atchison, Topeka and Santa Fe Railway Company's Right of Way and along the Present Corporate Limits of the City of San Bernardino to a point in the West line of Annexation No. 13 to said City; thence along said City Limit line the following courses and distances; thence South along the West line of Annexation No. 13 to the North line of said Rancho San Bernardino; thence West along said North line of said Rancho to a point 150.00 feet West of the West line of Muscott Street; thence South and parallel with the West line of said Muscott Street to the North line of Lot 2 of said Hockaday Sub; thence West along said North line of Lot 2 to the Northwest corner of said Lot 2; thence South along the West line of said Lot 2 to the Southwest corner thereof; thence East along the South line of said Lot 2 to a point 150.00 feet West of the West line of said Muscott Street; thence South and parallel with the West line of said Muscott Street to the centerline of 23rd Street, 50.00 feet wide; thence West along the said centerline of 23rd Street to the Northerly prolongation of the West line of Lot 43 of said Tract No. 3995; thence South along said Northerly prolongation and West line of said Lot 43 to the Southwest corner of said Lot 43; thence East along the South line of Lots 43 and 42 of said Tract 3995 to the Southeast corner of said Lot 42, said point being 150.00 feet West of the West line of said Muscott Street; thence South and parallel with said West line to the North line of Highland Avenue; thence Westerly along the North line of Highland Avenue to the Northerly prolongation of 17 18 19 27 28 29 30 31 32 - 2 - 10 11 1 the West line of Lot 1, Block 58 of said Rancho San Bernardino; thence Southerly along the Northerly pro- longation of the West line of said Lot 1, the West line of Lot 1 of said Block 58 to the Northeast corner of Lot 10, Tract 1711 as per plat thereof recorded in Book 25 of Maps, page 27, records of the County Recorder of said County; thence Westerly along the North line of Lots 10, 11, 12, 13, 14 of said Tract 1711 to the Northwest corner of said Lot 14; thence North along the Northerly prolongation of the West line of said Lot 14, being along a line which is 380.00 feet West of the East line of said Lot 8, Block 58, Rancho San Bernardino to the center line of said Highland Avenue; thence Westerly along said centerline of Highland Avenue to the intersection with the centerline of said California Street, 60.00 feet wide; thence leaving said City Limit line, North along the centerline of said California Street and its Northerly prolongation to the point of beginning. 2 3 4 5 6 7 8 9 12 said election shall be opened at 7 o'clock A. M. of the day herein fixed for SECTION TWO: TIME OF OPENING AND CLOSING OF POLLS. The polls at 13 the holding of said election and shall be kept open until 7 o'clock P. M. 14 of the same day, when the polls shall be closed. 15 16 17 18 19 20 21 22 23 24 25 SECTION THREE: BALLOTS. Upon the ballots to be used at said election there shall be printed the words: SHALL ANNEXATION DISTRICT NO. 173 BE ANNEXED TO, INCORPORATED IN AND MADE A PART OF THE CITY OF SAN BERNARDINO AND THE PROPERTY IN SUCH TERRITORY BE, AFTER SUCH ANNEXATION, SUBJECT TO TAXATION EQUALLY WITH THE PROPERTY WITHIN THE CITY OF SAN BERNARDINO, TO PAY ITS PRO-RATA PORTION, BASED UPON ASSESSED VALUATION OF ALL BONDED INDEBTEDNESS OF THE CITY OF SAN BERNARDINO OUTSTANDING AT THE DATE OF THE FIRST PUBLICATION OF THE NOTICE OF ELECTION FOR ANNEXATION? Opposite these words there shall be printed the words "YES" and "NO", and to the right of each of these last two words there shall be a 26 voting square. If an elector shall stamp a cross (+) in the voting square 27 after the printed word "YES", the vote of such elector shall be counted in 28 favor of the annexation of said territory to the City of San Bernardino, 29 and if an elector shall stamp a cross (+) in the voting square after the 30 printed word "NO", the vote of such elector shall be counted against 31 such annexation. 32 In all particulars not herein recited, said election shall be - 3 - 1 held in conformity as near as may be with the laws of the State of California 2 concerning general elections and with said Annexation Act of 1913. 3 SECTION FOUR: For purpose of said election there hereby is 4 established in the territory described herein two (2) consolidated voting 5 precincts which shall include all of said territory. The following are the 6 polling places of said election precincts, and the following named persons 7 hereby are designated as officers of election and shall constitute the 8 boards of election for such election precincts: 9 Consolidated Voting Precinct No. 1 shall be comprised of County 11 10 Precincts Muscoy 3 and Mt.
