HomeMy WebLinkAbout2691 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 1 ORDINANCE NO. ;;..~ '// 2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO APPROVING THE ANNEXATION OF DISTRICT NO. 174. 3 4 WHEREAS, heretofore, proceedings were initiated by the Cornmon 5 Council of the City of San Bernardino, on its own motion, to annex to the 6 City of San Bernardino certain contiguous uninhabited territory hereinafter 7 described; and 8 WHEREAS, on the 23rd day of August, 1965, a resolution was 9 adopted by the aforesaid Common Council of the City of San Bernardino, California, declaring that proceedings had been initiated by said Council and proposing the annexation, for the reasons therein stated, of the aforementioned uninhabited territory to the City of San Bernardino, and that said resolution provided that the proposed annexation should be generally known and identified as Annexation District No. 174; and WHEREAS, said resolution set forth therein that all the property: included in the aforesaid territory should be taxed equally with the other property within the said City to pay the bonded indebtedness and any and all general indebetedness and liability of the City of San Bernardino contracted prior to or existing or outstanding at the time of the aforesaid proposed annexation of the aforesaid property as provided in the hereinbefore mentioned Government Code; and WHEREAS, said resolution did fix, determine and declare that a hearing be held on the 4th day of October, 1965, at the hour of 9:30 o'clock A. M. in the Council Chambers of the City Hall in the City of. San Bernardino, and the same was the day, hour and place designated where any person owning real estate within such territory so proposed to be annexed and having any objections to the proposed annexation might object before the Cornmon Council and show cause why such territory should not be annexed; and, furthermore, the said resolution provided that at any time not later than the said hour set, as mentioned hereinbefore for the said hearing, any owner of property within the said territory proposed to be annexed might file written protest with the City of San Bernardino against such annexation; and 1 WHEREAS, no written protests of any kind or nature whatsoever were 2 filed with the City Clerk of the City of San Bernardino prior to 9:30 o'clock 3 A. M. on the 4th day of October, 1965. 4 WHEREAS, on the 4th day of October, 1965, the date set for the 5 hearing of protests against the proposed annexation, Resolution No.;1oY;rf 6 was adopted by the Common Council of the City of San Bernardino declaring 7 that a majority of protests has not been presented; and 8 WHEREAS, it appears to the Common Council of the City of 9 San Bernardino that the aforesaid annexation proceedings have been completed 10 and everything performed at this time in accordance with said Government 11 Code, as mentioned hereinbefore, and any and all other laws in any way 12 connected with the said annexation procedure having been complied with; and 13 WHEREAS, the Common Council of the City of San Bernardino desire 14 to approve at this time the annexation of the aforesaid territory. 15 NOW, THEREFORE, THE COMMON COUNCIL OF THE CITY OF SAN BERNARDINO 16 DOES HEREBY ORDAIN AS FOLLOWS: 17 SECTION ONE: That said territory herein described as Annexation 18 District No. 174 is hereby annexed and incorporated in and made a part of 19 the City of San Bernardino. ~ SECTION TWO: The territory herein referred to as being annexed to 21 the City of San Bernardino is particulaily described as follows, to wit: 22 That portion of Lot 1, Block 54, RANCHO SAN BERNARDINO, as per plat thereof recorded in Book 7 of Maps, Page 2, 23 records of the County Recorder of San Bernardino County, State of California, described as follows: 24 25 Commencing at the intersection of the North line of Colton Avenue, 82.50 feet wide, and the Present Corporate City Limit Line of the City of San Bernardino, said point also being the Southeast corner of the property conveyed to Rose M. Lambert, designated as Parcel No. 4 in the deed recorded January 7, 1959 in Book 4695, Page 550, Official Records of said County; thence North along said City Limit Line to its intersection with the center line of Frontage Road, known as Rosewood Drive, 60.00 feet wide; said point being the true point of beginning; thence East along the center line of said Rosewood Drive to the center line of Waterman Avenue 82.50 feet wide as delineated an the map of said Rancho San Bernardino; thence South along said center line of Waterman Avenue to the center line of State Freeway known as Highway No. 99; thence Southwesterly along ~ 27 28 ~ ~ 31 32 - 2 - 1 said center line of Highway No. 99 to the intersection with the present corporate limit line of said City of San Bernardino; thence North along said Corporate Limit Line to the true point of beginning. 2 3 4 SECTION THREE: That the above described property will be subject 5 to taxation equally with the property within such municipal corporation to 6 pay its proportion of the following bonded indebtedness of the City of 7 San Bernardino, which said bonded indebtedness was outstanding or theretofore 8 authorized and is outstanding at the time of said annexation, to wit: 9 A bonded indebtedness of $490,000.00 incurred for the acquisition 10 and construction of a public library, including additions to and enlargements 11 of the public library system of said City, the outstanding indebtedness 12 thereon being $370,000.00, bearing interest at the rates of 4 3/4%, 3 1/4% 13 and 3 1/2% per annum; 14 A bonded indebtedness of $1,116,000.00 incurred for the acquisition 15 and construction of additions to, relocations of and replacements of the 16 fire fighting system of said City, the outstanding indebtedness thereon being 17 $1,000,000.00, bearing interest at the rates of 4%, 3%, 2 1/2%, 2 3/4% and 19 18 2.9% per annum. SECTION FOUR: The property herein annexed is declared to be a 20 part of Ward 3 and the boundaries of Ward 3 are hereby altered to include 21 said annexed territory; and said property is placed and declared to be in 23 22 C-M Commercial-Manufacturing Zone. SECTION FIVE: The City Clerk shall certify to the passage of this 24 Ordinance and shall cause the same to be published three consecutive times, 25 exclusive of holidays, in the San Bernardino Evening Telegram, a daily 26 newspaper designated for that purpose. 27 I HEREBY CERTIFY that the foregoing Ordinance was duly adopted by 28 29 regular the Mayor and Common Council of the City of San /,f'd Bernardino at a ~A./ 30 1965, by the following vote, to wit: meeting thereof, held on the day of 31 32 - 3 - 10 11 12 13 14 15 16 II I 1 AYES: ?
