INCLUDING ITS APPENDIXES A THROUGH F, INCWSlVE AND TABLES; AND REPEALING ORDINANCE NO. 2402. 9 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO 10 DO ORDAIN AS FOLLOWS: 11 SECTION ONE: This Ordinance shall be known as the "UNIFORM 12 PLUMBING ORDINANCE 0 II 13 SECTION TWO: Those certain rules and regulations which 14 provide for and govern the installation, alteration and repair of 15 plumbing, gas and drainage systems and the inspections thereof, 16 the examination, registration and licensing of persons engaged in 17 the business of plumbing, or laboring at the trade of plumbing 18 or with gas and drainage systems in the City of San Bernardino, 19 the creation of a Board of Plumbing Examiners and prescribing 20 its duties and the duties of the plumbing examiner and the 21 plumbing inspector, and the penalties for violations thereof, as 22 set forth in that certain code printed in book form, and entitled 23 "Uniform Plumbing Code, 1964 Edition", as prepared and promul- 24 gated by the Western Plumbing Officials Association, three (3) 25 copies of which code have heretofore been filed with and are now 26 on file in the Office of the City Clerk of the City of San 27 Bernardino, and which copies are identified by certificates 28 attached thereto, reading substantially as follows: 29 "I, JACK T. FELTON~ hereby certify that the three annexed 30 codes entitled "Uniform Plumbing Code, 1964 Edition", were filed .31 in the office of the City Clerk of the City of San Bernardino on 32 the 19th day of August, 1965, and are true, correct and complete ~ copies of said Code which is sought to be adopted by reference 2 by ordinance of the Mayor and Conunon Council of said City. 3 JACK T. FELTON, City Clerk of the City of San Bernardino."; 4 be and the same are hereby established as rules and regulations 5 and a code of said City; and each and every part of said code, 6 and each and every provision therein contained, including its 7 Appendixes A through F, inclusive, and Tables, is hereby 8 referred to and designated as the'Uniform Plumbing Code, 1964 9 Edition", and is hereby adopted and made a part hereof as though 10 fully set forth at length in this ordinance. 11 SECTION THREE: The following sections and provisions of 12 the Uniform Plumbing Code, 1964 Edition, are hereby amended to 13 read as follows: 14 Section 1.1. ADMINISTRATIVE AUTHORITY AND ASSISTANTS. 15 Whenever the term "administrative authority" is used in this code 16 it shall be construed to mean the Chief Plumbing Inspector or his 17 authorized representative. 18 Section 1.2. ASSISTANTS. Whenever the term "assistants" is 19 used in this code it shall be construed to mean the Plumbing 20 Inspec tors. 21 Section 1.3. DEPARTMENT HAVING JURISDICTION. Unless other- 22 wise provided for by law, the Office of the Administrative 23 Authority shall be part of the Department of Building and Safety. 24 Section 1.7. VIOLATIONS AND PENALTIES. Any person, firm 25 or corporation violating or causing or permitting the violation 26 of any of the provisions of this code or ordinance shall be 27 deemed guilty of a misdemeanor and upon conviction thereof shall 28 be punishable by a fine of not to exceed Five Hundred Dollars 29 ($500.00) or by imprisonment in the City Jail for not to exceed 30 six (6) months, or by both such fine and imprisonment. Each .3~ separate day or any portion thereof during which any violation 32 of this code or ordinance occurs or continues shall be deemed to 2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 .31 32 constitute a separate offense, and upon conviction thereof shall be punishable as herein provided. The issuance or granting of a permit or approval of plans and specifications shall not be deemed or construed to be a permit for, or an approval of, any violation of any of the provisions of this code. No permit presuming to give authority to violate or cancel the provisions of this code shall be valid, except insofar as the work or use which it authorizes is lawful. The issuance or granting of a permit or approval of plans shall not prevent the Administrative Authority from thereafter requiring the correction of errors in said plans and specifications or from preventing construction operations being carried on thereunder when in violation of this code or of any other ordinance or from revoking any Certificate or Approval when issued in error. Every permit issued by the Administrative Authority under the provisions of this code shall expire by limitation and become null and void, if the work authorized by such permit is not commenced within sixty (60) days from the date of issuance of such permit, or if the work authorized by such permit is suspended or abandoned at any time after the work is commenced for a period of sixty (60) days. Before such work can be recommenced a new permit shall be first obtained so to do. When work for which a plumbing permit is required by this ordinance is started or proceeded with prior to obtaining said permit, the fees specified in the Uniform Plumbing Code shall be doubled, but the payment of such double fee shall not relieve any person from fully complying with the requirements of this code in the execution of the work nor from any other penalties prescribed herein. Section 1.12. COST OF PERMIT. Every applicant for a permit to install, add to, alter, 3 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 .31 32 relocate or replace a plumbing or drainage system or part thereof, shall state in writing on the application form provided for that purpose, the character of work proposed to be done and the amount and kind in connection therewith, together with such information pertinent thereto as may be required. Such applicant shall pay for each permit issued at the time of issuance, a fee in accordance with the following schedule, and at the rate provided for each classification shown therein. Any person who shall commence any plumbing work for which a permit is required by this code without first having obtained a permit therefor shall, if subsequently permitted to obtain a permit,pay double the permit fee fixed by this section for such work, provided, however, that this provision shall not apply to emergency work when it shall be proved to the satisfaction of the Administrative Authority that such work was urgently necessary and that it was not practical to obtain a permit therefor before the commencement of the work. In all such cases a permit must be obtained as soon as it is practical to do so, and if there be an unreasonable delay in obtaining such permit, a double fee as herein provided shall be charged. For the purpose of this section a sanitary plumbing outlet on or to which a plumbing fixture or appliance maybe set or attached shall be construed to be a fixture. Fees for reconnec- tion and retest of existing plumbing systems in relocated buildings shall be based on the number of plumbing fixtures, gas systems, water heaters, etc., involved. When interceptor traps or house trailer site traps are installed at the same time as a building sewer on any lot, no sewer permit shall be required for the connection of any such trap to an appropriate inlet fitting provided in the building sewer by the permittee constructing such sewer. . 4 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 .31 32 1 When a permit has been obtained to connect an existing building or existing work to the public sewer or to connect to a new private disposal facility, backfilling of private sewage disposal facilities abandoned consequent to such connection is included in the building sewer permit. A Journeyman Plumber is a person who labors at the trade of plumbing as an employee of a contractor who is licensed to engage in the business of plumbing. Sec tion 2.4 APPOINTMENT OF BOARD OF EXAMINERS. The Board of Plumber Examiners shall be under the Department having juris- diction provided for by law or the charter provisions and unless otherwise provided for shall consist of five (5) members: two (2) qualified Plumbing Contractors, two (2) qualified Journeyman Plumbers, and one (1) from the public at large. One (1) member of the Plumbing Division shall act as Secretary 5 l and shall serve as an ex officio member. 2 The Board shall be appointed by the authority empowered to 3 appoint such boards upon the taking effect of this code. 4 The members of said Board shall serve for two (2) years, 5 unless sooner removed for malfeasance in office, neglect of duty 6 or incapacity. 7 Section 2.6. APPLICATION FEE. Every person applying for 8 a Plumber's Certificate of Qualification or Registration shall pay 9 to the Secretary of the Board of Plumber Examiners at the time he 10 makes such application the following fees: Il (a) Journeyman Plumber's Certificate $3.50 12 Section 209. EXPIRATION OF CERTIFICATES OF QUALIFICATION 13 OR REGISTRATION. Every Certificate of Qualification or Registration 14 shall remain in force and effect until its expiration date unless l5 cancelled or revoked. 16 (a) Journeyman Plumber's Certificate of Qualification or 17 Registration shall expire on December 31st of each year. 18 Section 2.10. FEES FOR RENEWAL OF CERTIFICATES OF QUALI- 19 FICATION OR REGISTRATION. All Plumber Certificates of Qualification 20 except Certificates which have been cancelled or revoked, may be 21 renewed from year to year upon request and payment of the required 22 renewal fee. If a renewal of a Certificate be requested and the 23 required fee paid within 30 days of the expiration date of such 24 Certificate, the renewal fee shall be $1.00. If such renewal be 25 requested and the required fee paid more than 30 days, but less 26 than 90 days after the expiration date of such certificate, the 27 fee shall be $3.50 and the Board of Plumber Examiners may require 28 the applicant to make out a new application and take an examination, 29 or the Board may at its discretion renew the expired Certificate. 30 Section 702(c) Each waste outlet for a plumbing fitting .31 that requires roughing in above floor shall be immediately in the 32 rear of the fixture trap and no concealed change of direction or 6 17 18 19 20 21 22 23 24 25 26 27 28 29 30 .31 32 1 offset shall be installed between any such fixture trap and its 2 vent. Any exposed fitting installed between a trap and its vent 3 shall be so located as to be readily removable for cleaning pur- 4 poses. This is to eliminate blockage as much as possible in 5 trap arms. 6 Section 704: TRAPS PROHIBITED. No form of trap which 7 depends for its seal upon the action of movable parts or concealed 8 interior partitions shall be used. Full "s" traps are prohibited. 9 Bell traps are prohibited. Crown-vented traps are prohibited. 10 No fixture shall be double trapped. Drum traps may be installed 11 12 13 14 only when permitted by the Administrative Authority for special conditions. Section 907(e). Fixtures shall be set level and in proper alignment with reference to adjacent walls. No water closet shall 15 be set closer than fifteen inches (15") from center to any 16 vertical surface. No urinal shall be set closer than twelve (12) inches from its center to any side wall or partition nor closer than twenty-four (24) inches center to center. SECTION FOUR: Said Uniform Plumbing Code is hereby amended by deleting therefrom the following sections, sub-sections and provisions: Section Sec tion Section Section 310 (e) 802 (f) and 1008 (c) - 1 1310 (a) (g) SECTION FIVE: Said Uniform Plumbing Code is hereby amended by adding thereto the sections and sub-sections hereinafter set forth to read as follows: Section 1.2(a). QUALIFICATIONS. Each inspector shall be a practical plumber having not less than two (2) years' experience as a journeyman plumber. Section 1.15. LIABILITY OF CITY OFFICIAL OR EMPLOYEE. Neither this Ordinance nor the said Uniform Plumbing Code shall be construed as imposing upon the City of San Bernardino any 7 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 .31 32 liability or responsibility for damage from defective plumbing or drainage system, or the installation thereof, nor shall the City of San Bernardino, or any official or employee thereof be held as assuming any such liability or responsibility by reason of the inspection authorized thereunder. Section 1.16. SUiSTANCES OR EQUIPMENT POLWTING WATER. No person shall advertise, sell or offer for use or sale, any water- treating chemical or substance, water-using or water-treating chemical or substance, water-using or water-operated equipment, mechanism or contrivance, if the Health Officer finds that the use of such chemical or substance, equipment, mechanism or contrivance may cause contamination or pollution of the domestic water system. Such devices may be permitted when equipped with back-flow protection meeting the requirements of the Uniform Plumbing Code. Section 1.71. Where work for which a permit is required by this code is completed prior to the issuance of said permit, an additional fee of ten (10) percent of the cost of the project, or the sum of $200.00, whichever is less, shall be paid, and it shall be the duty of the Chief Plumbing Inspector to levy and collect said additional fees. The payment of such fee shall not relieve any persons or firms from fully complying with other provisions of this code or from any other penalties prescribed herein. Section 207 (d). An approved two-way clean-out fitting shall be installed at the lower end of every building drain and shall be located two (2) feet outside the dwelling or building which it serves. Such clean-out shall be extended to the finish grade and made readily accessible. Section 403(c). The minimum size for the building drain installed in any ~mImercial construction shall be 4" in size. Section 410. HOUSE DRAINS SHALL CONNECT TO ONE OUTLET. In a single family dwelling all plumbing drains shall connect to 8 lone outlet. Such outlet shall not exceed ninety (900) degrees 2 from the direction of the closest public sewer or if there is 3 no public sewer then from the proposed public sewer. If more than 4 one stub-out is used, the contractor installing the plumbing 5 shall connect all such stub-outs to each other so that there 6 shall be one outlet. The materials used shall be as required 7 elsewhere in this code. 8 Section 1009 (n). All horizontal water piping, including 9 lawn sprinkler systems, installed underground shall have not less 10 than six inches (6") of earth cover. 11 Section 1103 (c). The following are the only materials 12 approved for the installation of sewers for buildings and 13 structures in the City of San Bernardino: 14 15 16 17 Wedge Lock Speed Seal Bank Seal Transite Cast Iron Pacific Clay Products Gladding McBean Co. Mission Clay Products Johns-Manville SECTION SIX: The word "City" in the aforesaid sections 18 and code shall be deemed to refer to and designate the City of 19 San Bernardino, and any reference to any act or legislative 20 enactment therein referred to shall be deemed to designate and 21 embrace the statutes of the State of California, and amendments 22 thereof, dealing with the subject matter thereby and therein 23 referred to. 24 SECTION SEVEN: REVOCATION. The Mayor and Connnon Council 25 of the City of San Bernardino shall have the power, upon 26 reconnnendation of the Plumbing Inspector, to suspend or revoke 27 the license of any person violating the terms and provisions of 28 said Plumbing Code, provided that such suspension or revocation 29 shall not be ordered by said Mayor and Connnon Council without 30 first holding a public hearing thereof and without giving .31 reasonable notice of such hearing to the person, firm or 32 corporation so charged with said violation. 9 1 SECTION EIGHT: If any section, sub-section, sentence, 2 clause or phrase of this Ordinance or said code is for any 3 reason held to be invalid or unconstitutional by the decision of 4 any court of competent jurisdiction, such decision shall not 5 affect the validity of the remaining portions of said Ordinance 6 or code. The Mayor and Common Council of the City of San 7 Bernardino hereby declare that they would have passed said 8 Ordinance and code, and each section, sub-section, sentence, 9 clause and phrase thereof, irrespective of the fact that any 10 one or more other sections, sub-sections, clauses or phrases be 11 declared invalid or unconstitutional. 12 18 19 20 21 22 23 24 25 26 27 28 SECTION NINE: Ordinance No. 2402 is hereby repealed. 13 I HEREBY CERTIFY that the foregoing ordinance was duly 14 adopted by the Mayor and Common Council of the City of San 15 16 a~/r;AJ/ v!f!:::J;A f(' day of ./ , 1965, by Bernardino at meeting thereof, held on the 17 the following vote, to wit.
