AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO Al'l'ROVING THE ANNEXATION OF DISTRICT NO. 175.
WHEREAS, heretofore, a petition was filed with the Common Council of
the City of San Bernardino requesting that certain uninhabited territory
contiguous to said City be annexed to the City of San Bernardino, and which
said petition described said territory and the boundaries thereof proposed to
be annexed to the City; and
WHEREAS, said petition was filed by the owners of not less than
one-fourth of the area of land in such territory, and representing not less
than one-fourth of the assessed value of such territory according to the last
preceding equalized assessment roll of the County of San Bernardino, in which
said County the City of San Bernardino is situated; and
WHEREAS, said petition requested the said territory to be annexed
to and included in the said municipal corporation in accordance with the
provisions of the Government Code, Section 35300, et seq.; and
WHEREAS, on the 18th day of October, 1965, a Resolution was adopted
by the aforesaid Common Council of the City of San Bernardino, California,
proposing the annexation of the aforesaid uninhabited territory, to be
generally known as ANNEXATION DISTRICT NO. 175, to the City of San Bernardino,
and that said Resolution provided therein that the proposed annexation should
be generally known and identified as ANNEXATION DISTRICT NO. 175; and
WHEREAS, said Resolution set forth therein that all the property
included in the aforesaid territory should be taxed equally with the other
property within the said City to pay the bonded indebtedness and any and all
general indebtedness and liability of the City of San Bernardino contracted
prior to or existing or outstanding at the time of the aforesaid proposed
annexation of the aforesaid property as provided in the hereinbefore mentioned
Government Code; and
WHEREAS, said Resolution did fix, determine and declare that a
hearing be held on the 29th day of November, 1965, at the hour of 7:00 o'clock
l'~ M. in the Council Chambers of the City Hall in the City of San Bernardino,
1 and the same was the day, hour and place designated where any person owning
2 real estate within such territory so proposed to be annexed and having any
3 objections to the proposed annexation might object before the Common Council
4 and show cause why such territory should not be annexed; and furthermore, the
5 said Resolution provided that at any time not later than the said hour set,
6 I as mentioned hereinbefore for the said hearing, any owner of property within
7 the said territory proposed to be annexed might file written protest with the
8 City of San Bernardino against such annexation; and
9 WHEREAS, no written protests of any kind or nature whatsoever were
10 filed with the City Clerk of the City of San Bernardino prior to 7:00 o'clock
11 F. M. on the 29th day of November, 1965, and thereafter on the 29th day of
12 November, 1965, Resolution No. 1952 was adopted by the Mayor and Common
13 Council declaring that a majority protest bas not been presented; and
14 WHEREAS, it appears to the Common Council of the City of San
15 Bernardino that the aforesaid annexation proceedings have been completed and
16 everything performed at this time in accordance with said Government Code,
17 as mentioned hereinbefore, and any and all other laws in any way connected
18 with the said annexation procedure having been complied with; and
19 WHEREAS, the Common Council of the City of San Bernardino desire
20 to approve at this time the annexation of the aforesaid territory.
21 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
22 BERNARDINO DO ORDAIN AS FOLLOWS:

SECTION ONE: That said territory herein described as Annexation
24 District No. 175 is hereby annexed and incorporated in and made a part of
25 the City of San Bernardino.

SECTION TWO: The territory hereinireferred to as being annexed to
27
the City of San Bernardino is particularly described as follows, to wit:

That portion of Section 10, Township 1 North, Range 4 West,
SAN BERNARDINO BASE AND MERIDIAN, according to Government
Survey, described as follows:

Beginning at a point on the City Limit Line of the City of
San Bernardino, said point being the Northeast corner of
the Northwest quarter of the Southeast quarter of said
Section 10; thence Westerly along said City Limit Line
and the North line of the South half of said Section 10

to the Southwest corner of Southeast quarter of the Northwest
quarter of said Section 10; thence North along the West line
of said Southeast quarter of the Northwest quarter to the
Northwest corner thereof; thence East along the North line of
the South half of the North half of said Section 10 to the
Northeast corner of the Southwest quarter of the Northeast
quarter of said Section 10; thence South along the East line
of said Southwest quarter of the Northeast quarter to the
point of beginning.

SECTION THREE: That the above described property will be subject
taxation equally with the property within such municipal corporation to
8 pay its proportion of the following bonded indebtedness of the City of San
9 Bernardino, which said bonded indebtedness was outstanding or theretofore
10 authorized and is outstanding at the time of said annexation, to wit:
11 A bonded indebtedness of $A90,000.00 incurred for the acquisition
12 and construction of a public library, including additions to and enlargements
13 of the public library system of said City, the outstanding indebtedness
14 thereon being $350,000.00, bearing interest at the rates of 4 3/4%, 3 1/4%
15 and 3 1/2% per annum;
16 A bonded indebtedness of $1,116,000.00 incurred for the acquisition
17 and construction of additions to, relocations of and replacements of the
18 fire fighting system of said City, the outstanding indebtedness thereon being
19 $1,000,000.00, bearing interest at the rates of 4%, 3%, 2 1/2%, 2 3/4%
20 and 2.9% per annum.

SECTION FOUR: The property herein annexed is declared to be a
22 part of Ward 4 and the boundaries of Ward 4 are hereby altered to include
23 said annexed territory; and said property is placed and declared to be in
24 R-1-14,400 Single Family Residential Zone.

SECTION FIVE: The City Clerk shall certify to the passage of this
26 Ordinance and shall cause the same to be published three consecutive times
27 exclusive of holidays, in the San Bernardino Evening Telegram, a daily
28 newspaper designated for that purpose.
