HomeMy WebLinkAbout2721 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 1 ORDINANCE NO",~/~2 / 2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO APPROVING THE ANNEXATION OF DISTRICT NO. 176. 3 4 WHEREAS, heretofore, proceedings were initiated by the Common Ii 51 Ii 6 Ii 'I 7 II 8 I Council of the City of San Bernardino, on its own motion, to annex to the City of San Bernardino certain contiguous uninhabited territory hereinafter described; and WHEREAS, on the 6th day of December, 1965, a resolution was adopted 9 by the aforesaid Common Council of the City of San Bernardino, California, declaring that proceedings had been initiated by said Council and proposing the annexation, for the reasons therein stated, of the aforementioned uninhabited territory to the City of San Bernardino, and that said resolution provided that the proposed annexation should be generally known and identified as Annexation District No. 176; and WHEREAS, said resolution set forth therein that all the property included in the aforesaid territory should be taxed equally with the other property within the City to pay the bonded indebtedness and any and all general indebtedness and liability of the City of San Bernardino contracted prior to or existing or outstanding at the time of the aforesaid proposed annexation of the aforesaid property as provided in the hereinbefore mentioned Government Code; and WHEREAS, said resolution did fix, determine and declare that a hearing be held on the 17th day of January, 1966, at the hour of 9:30 o'clock A. M. in the Council Chambers of the City Hall in the City of San Bernardino, and the same was the day, hour and place designated where any person owning real estate within such territory so proposed to be annexed and having any objections to the proposed annexation might object before the Common Council and show cause why such territory should not be annexed; and, furthermore, the said resolution provided that at any time not later than the said hour set, as mentioned hereinbefore for the said hearing, any owner of property within the said territory proposed to be annexed might file written protest with the City of San Bernardino against such annexation; and . 1 WHEREAS, no written protests of any kind or nature whatsoever were 2 i filed with the City Clerk of the City of San Bernardino prior to 9:30 o'clock 3 A. M. on the 17th day of January, 1966. 4 WHEREAS, on the 17th day of January, 1966, the date set for the 5 hearing of protests against the proposed annexation, Resolution No. t~~~ 6 was adopted by the Common Council of the City of San Bernardino declaring 7 that a majority of protests has not been presented; and 8 WHEREAS, it appears to the Common Council of the City of 9 San Bernardino that the aforesaid annexation proceedings have been completed 10 and everything performed at this time in accordance with said Government 11 Code, as mentioned hereinbefore, and any and all other laws in any way 12 connected with the said annexation procedure having been complied with; and 13 WHEREAS, the Common Council of the City of San Bernardino desire 14 to approve at this time the annexation of the aforesaid territory. 15 NOW, THEREFORE, THE COMMON COUNCIL OF THE CITY OF SAN BERNARDINO 16 DO ORDAIN AS FOLLOWS: 17 SECTION ONE: ThaLsaid::te:rrl.toqr hereindescribedc.as 'Annexation 18 District No. 176 is hereby annexed and incorporated in and made a part of 19 the City of San Bernardino. 20 SECTION TWO: The territory herein referred to as being annexed to 21 the City of San Bernardino is particularly. described as follows, to wit: 22 That portion of Lot 44, Block 54, Rancho San Bernardino as per plat thereof recorded in Book 7 of Maps, page 2, 23 records of the County Recorder of San Bernardino County, State of California, described as follows: 24 25 Beginning at a point on the Present Corporate Limits of the City of San Bernardino, said point being at the intersection of the North line of Lot 45 of said Block 54 of the Rancho San Bernardino and the centerline of Arrowhead Avenue; thence West along said City Limit line and along the North line of said Lot 45 to the centerline of South "E" Street; thence North along said centerline of South "E" Street a distance of 95 feet more or less to the Westerly prolongation of the North line of the property described in the Deed to Robert N. Moodey, a married man, recorded September 1, 1965, in Book 6464, page 790, Official Records of said County, said point being West 83.00 rods, more or less from the Northeast COrner of the land conveyed to John Garner by Deed dated July 29, 1875 and recorded in Book "0" of Deeds, page 564, records of said County, said Northeast corner being 26 27 28 29 30 31 32 . - 2 - 1 North 39.00 rods, more or less, from the Southeast corner of the land designated as "Sold to Lewis Meinzer" on the plat recorded in Book 1 of Maps, page 37, records of said County; thence East along said Westerly prolongation and North line of said Robert N. Moodey property and its Easterly prolongation, to the centerline of said Arrowhead Avenue; thence South along said centerline of Arrowhead Avenue and said City Limit line a distance of 95 feet more or less to the point of beginning. 2 3 4 ' 5 6 SECTION THREE: That the above described property will be subject 7 to taxation equally with the property within such municipal corporation to 8 pay its proportion of the following bonded indebtedness of the City of 9 San Bernardino which said bonded indebtedness was outstanding or theretofore 10 authorized and is outstanding at the time of said annexation, to wit: 11 A bonded indebtedness of $490,000.00 incurred for the acquisition 12 and construction of a public library, including additions to and enlargements 13 of the public library system of said City, the outstanding indebtedness 14 thereon being $350,000.00, bearing interest at the rates of 4 3/4%, 3 1/4% 15 and 3 1/2% per annum; 16 A bonded indebtedness of $1,116,000.00 incurred for the acquisition 17 and construction of additions to, reloc~tions of and replacements of the 18 fire fighting system of said City, the outstanding indebtedness thereon being 19 $1,000,000.00, bearing interest at the rates of 4%, 3%, 2 1/2%, 2 3/4% and 20 2.9% per annum. 21 SECTION FOUR: The property herein annexed is declared to be a 22 part of Ward 3 and the boundaries of Ward 3 are hereby altered to include 23 said annexed territory; and said property is placed and declared to be in 24 C-M Commercial-Manufacturing Zone. 25 SECTION FIVE: The City Clerk shall certify to the passage of this 26 Ordinance and shall cause the same to be published three consecutive times, 27 exclusive of holidays, in the San Bernardino Evening Telegram, a daily 28 newspaper designated for that purpose. 29 I HEREBY CERTIFY that the foregoing Ordinance was duly adopted by 30 the Mayor and Common Council of the City of San Bernard~no at an adjourned 31 regular meet ing thereof, held on the ,-;( Y-;::;/ day , ~7/ I f I' .' o :et./'J.'". ). / / 32 19fi6, by the following vote, to wit: - 3 - 22 23 /' The foregoing Ordinance is hereby approved this =1,.-;;./ day of l<."l-nd~/r ' 1966. //" }/ 1/ 1 AYES: Councilmen C". 2 3 '- A;;.:,.;.- NOES: 4 5 6 7 8 9 10 11 12 13 14 15 Approved as to form: 16 ,,~ ~A.J 17 18 19 20 21 24 25 26 27 28 FI LED 29 30 JAN 281966 31 ~~?
