AN ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING
ORDINANCE NO. 763 ENTITLED IN PART, "AN ORDINANCE PROVIDING FOR
THE LICENSING OF BUSINESSES. . ."1 AND ESTABLISHING REGUIATIONS
AND THE AMOUNT OF A FEE FOR THE BUSINESS OF A SWAP-MEET.
THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
5 DO ORDAIN AS FOLLOWS:

SECTION ONE: Ordinance No. 763 is hereby amended by
7 adding thereto Section 97-A to read as follows~

"SECTION 97-A. For every person, firm or corporation
9 conducting, managing, carrying on or engaging in the business of
10 a "Swap-Meet" in the City of San Bernardino, $5.00 per day or
11 50i per vehicle, whichever is the greater.
12 The words "Swap-Meet" as used in this ordinance shall be
13 deemed to mean any business wherein any person, firm or corpor-
14 ation or agent thereof rents spaces to various dealers or indi-
15 viduals for selling or offering for sale goods, wares, merchan-
16 dise, or things or articles of value, and wherein an admission
17 fee is charged to enter the area where the merchandise is being
18 offered for sale.
19 The license shall be issued on a daily basis for a mini-
20 mum fee of $5.00 per day which shall be paid prior to the conduc-
21 ting of each "Swap-Meet". Upon completion of the "Swap-Meet",
22 a copy of a numbered receipt shall be filed with the City Clerk
23 to determine the number of dealers or individuals participating
24 in the sale.
25 The amount of each succeeding license shall be based
26 upon the number of spaces rented at the previous sale at the
27 rate of 50i per space, or shall be the minimum daily fee of
28 $5.00, whichever is greater. The receipts for the space rental
29 shall be written in triplicate on numbered receipts, and shall
30 contain the name and address of the dealer or individual, and
.31 the make and license number of his automobile. One copy of the
32 ,receipt shall be furnished to the dealer, one copy filed with
1 the City Clerk immediately after the sale, and one copy retained
2 by the "Swap-Meet" operator for a period of five (5) years for
3 audit purposes."

SECTION TWO: This ordinance is an emergency and urgency
5 measure necessary for the immediate preservation of the public
6 peace, health or safety and involves a tax upon businesses, and
7 shall go into effect immediately after its adoption, approval
8 and publication. The facts constituting such necessity are:
9 Several businesses are scheduled to commence business
10 in the immediate future for the conducting of the business of a
11 "Swap-Meet", which business is not regulated by any existing law
12 and for which a fee for a business license has not been estab-
13 lished.
