HomeMy WebLinkAbout2729 1 i: ;i 2 SAN 3 4 ORDINANCE NO. ~7~? AN ORDINANCE OF THE MAYOR AND C<!1MON COUNCIL OF THE CITY OF BERNARDINO AFPROVING THE ANNEXATION OF DISTRICT NO. 178. WHEREAS, heretofore, proceedings were initiated by the Common 5 Council of the City of San Bernardino, on its own motion, to annex to the 6 City of San Bernardino certain contiguous uninhabited territory hereinafter 7 described; and 8 WHEREAS, on the 17th day of January, 1966, a resolution was adopted 9 by the aforesaid Common Council of the City of San Bernardino, California, 10 declaring that proceedings had been initiated by said Council and proposing 11 the annexation, for the reasons therein stated, of the aforementioned 12 uninhabited territory to the City of San Bernardino, and that said resolution 13 provided that the proposed annexation should be generally known and identified 14 as Annexation District No. 178; and 15 WHEREAS, said resolution set forth therein that all the property 16 included in the aforesaid territory should be taxed equally with the other 17 property within the City to pay the bonded indebtedness and any and all 18 general indebtedness and liability of the City of San Bernardino contracted 19 prior to or existing o~ outstanding at the time of the aforesaid proposed 20 annexation of the aforesaid property as provided in the hereinbefore 21 mentioned Government Code; and 22 WHEREAS, said resolution did fix, determine and declare that a 23 hearing be held on the 28th day of February, 1966, at the hour of 7:00 o'clock 24 P. M. in the Council Chambers of the City Hall in the City of San Bernardino, 25 and the same was the day, hour and place designated where any person owning 26 real estate within such territory so proposed to be annexed and having any 27 objections to the proposed annexation might object before the Common Council 28 and show cause why such territory should not be annexed; and, furthermore, 29 the said resolution provided that at any time not later than the said hour 30 set, as mentioned hereinbefore for the said hearing, any owner of property 31 within the said territory proposed to be annexed might file written protest 32 w~th the City of San Bernardino against such annexation; and 1 WHEREAS, there was one written protest filed with the City Clerk 2 of the City of San Bernardino prior to 7:00 o'clock P. M. on the 28th day 3 of February, 1966; and' 4 WHEREAS, on the 28th day of February, 1966, the date set for the 5 hearing of protests against the proposed annexation, Resolution No. 8052 6 was adopted by the Common Council of the City of San Bernardino declaring 7 that a majority of protests has not been presented; and 8 WHEREAS, it appears to the Common Council of the City of 9 San Bernardino that the aforesaid annexation proceedings have been completed 10 and everything performed at this time in accordance with said Government 11 Code, as mentioned hereinbefore, an9 any and all other laws in any way 12 connected with the said annexation procedure having been complied with; and 13 WHEREAS, the Common Council of the City of San Bernardino desire 14 to approve at this time the annexation of the aforesaid territory. 15 NOW, THEREFORE, THE COMMON COUNCIL OF THE CITY OF SAN BERNARDINO 16 DO ORDAIN AS FOLLOWS: 17 SECTION ONE: That said territory herein described as Annexation 18 District No. 178 is hereby annexed and incorporated in and made a part of 19 the City of San Bernardino. 20 SECTION TWO: The territory herein referred to as being annexed to 21 the City of San Bernardino is particularly described as follows, to wit: 22 Those portions of Blocks 29, 30, 31 and 54, Rancho San Bernardino as per plat thereof recorded in Book 7 of Maps, Page 2, records of the County Recorder of San Bernardino County, State of California, and of the Osborn Tract as per plat thereof recorded in Book 8 of Maps, page 6, records of the County Recorder of said County, and of Tract 1963 as per plat thereof recorded in Book 28 of Maps, page 52, records of the County Recorder of said County, described as follows: 23 24 25 26 27 Beginning at a point on the Present Corporate Limits of the City of San Bernardino, said point being 759.00 feet South of the Southeast corner of Lot 9 of said Block 31; thence along the San Bernardino City Limit line, being the boundaries of annexations numbered 109, 81, 8, 157, 27, 98, 105 and of the Charter of 1905 to said City, the following courses and distances; thence West a distance of 426.25 feet (25 5/6 rods); thence North a distance of 379.50 feet (23 rods); thence West to the centerline of Arrowhead Avenue; thence Southerly along the centerline of Arrowhead Avenue a distance of 1270.00 28 29 30 31 32 . - 2 - 1 feet, more or less, to its intersection with the Easterly prolongation of the North line of the property~described in the Deed to Robert N. Moodey, a married man, recorded September 1, 1965 in Book 6464, page 790, Official Records of said County; thence leaving said City Limit line, West along said Easterly prolongation, the North line and the Westerly prolongation of said North line of the Moodey property to the centerline of South "E" Street; thence South along said centerline of South "E" Street, a dis- tance of 95.00 feet more or less to the North line of Lot 45 of said Block 54, said point being on said City Limit Line of the City of San Bernardino; thence West along said North line of Lot 45 and said City Limit Line to the West line of said South "E" Street; thence Southerly along the West line of said South "E" Street and continuing along said City Limit line to the North line of the South one-half of Lot 29 of said Block 54; thence Westerly along the North line of the South one- half of said Lot 29 to the Northwest corner of the South one-half of said Lot 29; thence Northwesterly to a point which is South 50. East, 760.32 feet from the most Easterly corner of Lot 48 of the Fairview Survey as per plat thereof recorded in Book 1 of Maps, page 43, records of the County Recorder of said County; thence North 130 East, 521.40 feet; thence East, 64.68 feet; thence North to the South line of Lot 36 of said Block 54; thence West to the Southwest corner of said Lot 36; thence North along the West line of said Lot 36 to its intersection with the Northeasterly line of Lot 73 of said Fairview Survey; thence Northwesterly along the Northeasterly line of said Lot 73 to the centerline of Colton Avenue; thence Northeasterly along the centerline of Colton Avenue to its intersection with the centerline of Mill Street; thence Easterly along the centerline of said Mill Street to a point which is 200.00 feet West of the West line of said Arrowhead Avenue, 82.50 feet wide; thence South along a line that is parallel with said West line of Arrowhead Avenue, a distance of 191.25 feet; thence Easterly along a line that is 150.00 feet South of and parallel with the South line of said Mill Street, a distance of 241.25 feet to the centerline of said Arrowhead Avenue; thence Southerly along the center- line of Arrowhead Avenue (sometimes known as "c" Street) to the Westerly prolongation of the South line of Tract No. 1878, Case's Acres as per plat thereof recorded in Book 27 of Maps, at page 23, records of the County Recorder of said County; thence Easterly along the Westerly prolongation of the South line of said Tract No. 1878 and the South line of said Tract No. 1878 to the Southeast corner of said Tract No. 1878; thence Northerly along the East line of said Tract No. 1878 to a point 420.00 feet South of the North line of Lot 1 of said Block 31; thence Easterly and parallel with the North line of said Lot 1 to the East line of Lot 2 of said Block 31, said point being the West line of Lot 39, Block 54, of said Rancho San Bernardino; thence Southerly along said West line of Lot 39 of said Block 54 and its Southerly prolongation to the center- line of Central Avenue; thence leaving said City Limit line, South along the Southerly prolongation of the East line of said Lot 9, Block 31, a distance of 759.00 feet to the point of beginning. 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 - 3 - 1 SECTION THREE: That the above described property will be subject 2 to taxation equally with the property within such municipal corporation to 3 pay its proportion of the following bonded indebtedness of the City of San 4 Bernardino which said bonded indebtedness was outstanding or theretofore 5 authorized and is outstanding at the time of said annexation, to wit: 6 A bonded indebtedness of $490,000.00 incurred for the acquisition 7 and construction of a public library, including additions to and enlargements 8 of the public library system of said City, the outstanding indebtedness 9 thereon being $350,000.00, bearing interest at the rates of 4 3/4%, 3 1/4% 10 and 3 1/2% per annum; 11 A bonded indebtedness of $1,116,000.00 incurred for the acquisition 12 and construction of additions to, relocations of and replacements of the 13 fire fighting system of said City, the outstanding indebtedness thereon being 14 $1,000,000.00, bearing interest at the rates of 4%, 3%, 2 3/4%, 2.9% and 15 2 1/2% per annum. 16 SECTION FOUR: The property herein annexed is declared to be a part 17 of Ward 3 and Ward 1. All parcels lying west of the State Highway 395 shall 18 be a part of Ward 3 and the boundaries of Ward 3 are hereby altered to include 19 said annexed territory. All parcels lying east of the State Highway 395 shall 20 be a part of Ward 1 and the boundaries of Ward 1 are hereby altered to include 21 said annexed territory. 22 The following parcel is placed and declared to be in R-1-7200 23 Single Family Residential Zone: 24 l'ARCEL NO.1: 25 Beginning at the southwest corner of Lot 22, Block 1, Scenic Knoll Tract No. 1963; thence north along the east 26 line of Scenic Drive a distance of 75 feet; thence north 298 feet to the west right of way line of State Highway 27 395; thence southeasterly along the west right of way line of State Highway 395 to a point 722 feet north 28 of the north line of the south one-half of Lot 29, Block 54, Rancho San Bernardino; thence in a south- 29 westerly direction 800 feet to the north line of the south one-half of Lot 29, said BlocK; thence west 30 27.28 feet; thence inaJnorthwesterly direction 225 feet to the east line of Lot 23, Block I, Scenic Knoll Tract 31 No. 1963; SECTION FIVE: The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published three consecutive times, exclusive of holidays, in the San Bernardino Evening Telegram, a daily newspaper designated for that purpose.
