ESTABLISHING A PARKING AND BUSINESS IMPROVEMENT AREA WITHIN SAID CITY . . .AND PROVIDING FOR THE USES TO WHICH SUCH ADDITIONAL TAX REVENUE SHALL BE PUT"; AND CHANGING THE CLASSIFICATION AND RATE OF ADDITIONAL TAX IMPOSED UPON CERTAIN CLASSIFICATIONS THEREUNDER. THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: SECTION ONE: The Mayor and Common Council find that the rates of additional tax heretofore imposed upon all businesses and activities within the improvement area established under Ordinance No. 2711 require changes for certain classifications of businesses conducted within said area as hereinafter set forth. SECTION TWO~ Ordinance No. 2711 Section Three is hereby amended to read as follows: "SECTION THREE: There is hereby imposed upon each type of business, including any profession, conducted within said area, a tax during each taxing period of 1966 and succeeding years, in addition to the tax imposed upon such business pursuant to Ordin- ance No. 763. Such-additional tax shall be imposed at the rates set forth hereinafter for the specified classifications regardless of whether the business is taxed upon a flat rate or gross receipts or other basis. Such additional tax shall be imposed upon each business in accordance with the classifications set forth in Ordinance No. 763 which classifications are incorporated herein by reference. The additional rate imposed upon each such classification shall be as follows~ (a) An additional annual tax of twenty-five percent (25%) shall be imposed upon those businesses conducted within said area classified as "professional" or "manufacturing and wholesale". (b) An additional tax of one hundred percent KlOO%) shall be imposed upon any other business conducted within said . area. II II , 1 Inasmuch as a previous rate of one hundred percent (100%) 2 has been imposed upon all businesses within said area in all 3 classifications, those businesses referred to in Section Three 4 (a) hereinabove shall not be required to pay an amount more than 5 twenty-five percent (25%) additional. annual license tax for the 6 calendar year of 1966 regardless of the term of the license or 7 licenses or the manner of payment thereofo 8 SECTION THREE: This ordinance is an emergency and 9 urgency measure necessary for the immediate preservation of the 10 public peace, health or safety and shall go into effect on 11 April 1, 1966. The facts constituting such necessity are: 12 The City of San Bernardino does not have sufficient funds 13 at present to enable it to promote business areas and to provide 14 for adequate parking within the business areas. As a result, 15 businesses are moving out of the City and areas which were once 16 a larger source of tax revenue for the City are deteriorating 17 and becoming blighted. This ordinance would provide a means 18 by which the City could raise the necessary funds to be used 19 for the purposes set forth herein in order to stimulate the 20 interest of the public and to keep businesses within the City. 21 In order that this problem may be solved without delay and the 22 City may have the necessary funds for the first quarter of the 23 business year of 1966, it is imperative that this ordinance 24 take effect on April 1, 1966. 25 SECTION FOUR~ If any section, subsection, sentence, 26 clause or phrase of this ordinance is for any reason held to be 27 invalid or unconstitutional by the decision of any Court of 28 competent jurisdiction, such decision shall not affect the 29 validity of the remaining portions of the ordinance. The Common 30 Council hereby declares that it would have passed this ordinance .31 and each section, subsection, sentence, clause and phrase hereof, 32 . irrespective of the fact that anyone or more of the sections, ~- 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 .31 32 1 2 :3 4 5 6 7 subsections, sentences, clauses or phrases hereof be declared invalid or unconstitutional.
