AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO APPROVING THE ANNEXATION OF DISTRICT NO. 179.
WHEREAS, heretofore, a petition was filed with the Common Council of
the City of San Bernardino .equesting that certain uninhabited territory
contiguous to said City be annexed to the City of San Bernardino, and which
said petition described said territory and the boundaries thereof proposed to
be annexed to the City; and
WHEREAS, said petition was filed by the owners of not less than
one-fourth of the area of land in such territory, and representing' not less
than one-fourth of the assessed value of such territory according to the last
preceding equalized assessment roll of the County of San Bernardino, in which
said County the City of San Bernardino is situated; and
WHEREAS, said petition requesced the said territory to be annexed to
and included in the said municipal corporation in accordance with the
provisions of the Government Code, Section 35300, et seq.; and
WHEREAS, on the 7th day of February, 1966, a Resolution was adopted
by the aforesaid Common Council of the City of San Bernardino, California,
proposing the annexation of the aforesaid uninhabited territory, to be
generally known as ANNEXATION DISTRICT NO. 179, to the City of San Bernardino,
and that said Resolution provided therein that the proposed annexation
should be generally known and identified as ANNEXATION DISTRICT NO. 179; and
WHEREAS, said Resolution set forth therein that all the property
included in the aforesaid territory should be taxed equally with the other
property within the said City to pay the bonded indebtedness and any and all
general indebtedness and liability of the City of San Bernardino contracted
prior to or existing or outstanding at the time of the aforesaid proposed
annexation of the aforesaid property as provided in the hereinbefore mentioned
Government Cade; and
WHEREAS, said Resolution did fix, determine and declare that a
hearing be held on the 21st day of March, 1966, at the hour of 9:30 o'clock
A~ M. in the Council Chambers of the City Hall in the City of San Bernardino,

1 and the same was the day, hour and place designated where any person owning
2! real estate within such territory so proposed to be annexed and having any
3 " objections to the proposed annexation might object before the Common Council
4 and show cause why such territory should not be annexed; and furthermore, the
5 said Resolution provided that at any time not later than the said hour set,
6 as mentioned hereinbefore for the said hearing, any owner of property within
7 the said territory proposed to be annexed might file written protest with the
8 City of San Bernardino against such annexation; and
9 WHEREAS, no written protests of any kind or nature whatsoever were
10 filed with the City Clerk of the City of San Bernardino prior to 9:30 o'clock
11 A. M. on the 21st day of March, 1966, and thereafter on the 21st day of
12 March, 1966, Resolution No. 8097 was adopted by the Mayor and Common Council
13 declaring that a majority protest has not been presented; and
14 WHEREAS, it appears to the Common Council of the City of San
15 Bernardino that the aforesaid ~nnexaeian proceedings have been completed and
16 everything performed at this time in accordance with said Government Code,
17 as mentioned hereinbefore, ,and any and all other laws in any way connected
18 with the said annexation procedure having been complied with; and
19 WHEREAS, the Common Council of the City of San Bernardino desire to
20 approve at this time the annexation of the aforesaid territory.
21 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF
22 SAN BERNARDINO DO ORDAIN AS FOLLOWS:

SECTION ONE: That said territory herein described as Annexation
24 District No. 179 is hereby annexed and incorporated in and made a part of
25 the City of San Bernardino.

SECTION TWO: The territory herein referred to as being annexed to
27 the City of San Bernardino is particularly described as follows, to wit:
28 That portion of Lot 1, Block 46, Rancho San Bernardino as
per plat thereof recorded in Book 7 of Maps, page 2, and
29 Tippecanoe Subdivision as per plat thereof recorded in
Book 18 of Maps, page 51, records of the County Recorder
30 of San Bernardino County, State of California, described
as follows:

Beginning at a point on the Present Corporate Limits of
the City of San Bernardino, said point being the intersection

of the West line of Tippecanoe Avenue and the North line
of said Lot 1, Block 46, Rancho San Bernardino; thence
leaving said City Limit line, East along the Easterly
prolongation of said North line of Lot 1, Block 46, a
distance of 41.25 feet to the centerline of said Tippecanoe
Avenue; thence South along said centerline of Tippecanoe
Avenue to its intersection with the centerline of Sullivan
Street 50.00 feet wide; thence East along the centerline
of said Sullivan Street a distance of 467.25 feet to its
intersection with the Northerly prolongation of the East
line of Lot 5 of said Tippecanoe Subdivision; thence
South along said Northerly prolongation, the East lines
of Lots 5, 6, 7, 8, 9, 10 and 11 and the Southerly
prolongation thereof, a distance of 794.41 feet, more
or less, to the centerline of Central Avenue 82.50 feet
wide; thence West along the centerline of said Central
Avenue, a distance of 1328.00 feet, more or less, to its
intersection with the Southerly prolongation of the West
line of said Lot 1, Block 46, Rancho San Bernardino;
thence North along said Southerly prolongation, the West
line of said Lot 1, and said City Limit line to the
Northwest corner of said Lot 1; thence East along the
North line of said Lot 1 and said City Limit line to
the point of beginning.

SECTION THREE: That the above described property will be subject

to taxation equally with the property within such municipal corporation to
16
pay its proportion of the following bonded indebtedness of the City of
17
San Bernardino, which said bonded indebtedness was outstanding or theretofore
18
authorized and is outstanding at the time of said annexation, to wit:

A bonded indebtedness of $490,000.00 incurred for the acquisition
20
and construction of a public library, including additions to and enlargements
21
of the public library system of said City, the outstanding indebtedness
thereon being $350,000.00, bearing interest at the rates of 4 3/4%, 3 1/4%
and 3 1/2% per annum;

A bonded indebtedness of $1,116,000.00 incurred for the acquisition
25
and construction of additions to, relocations of and replacements of the
fire fighting system of said City, the outstanding indebtedness thereon being

$1,000,000.00, bearing interest at the rates of 4%, 3%, 2 1/2%, 2 3/4% and
28
2. 9% per annum.

SECTION FOUR: The property herein annexed is declared to be a
30 part of Ward 1 and the boundaries of Ward 1 are hereby altered to include
31 said annexed territory.

The following property is placed and declared to be in C-3A

1 General Limited Commercial Zone:
2 Lots 8, 9, 10 and 11, Tippecanoe Subdivision, as per plat
recorded in Book 18 of Maps, page 51, records of San
3 Bernardino County, (Generally the northeast corner of
Tippecanoe and Central Avenues).

The following property is placed and declared to be in M-IA

Limited Light Industrial Zone:

Lots 5, 6 and 7 of Tippecanoe Subdivision, as per plat
recorded in Book 18 of Maps, page 51, records of San
Bernardino County. Also, Lot 1, Block 46, Rancho San
Bernardino, as per plat recorded in Book 7 of Maps, page 2,
records of San Bernardino County. (Generally both sides
of Tippecanoe Avenue lying north of Central Avenue).

SECTION FIVE: The City Clerk shall certify to the passage of this
11 Ordinance and shall cause the same to be published three consecutive times,
12 exclusive of holidays, in the San Bernardino Evening Telegram, a daily
13 newspaper designated for that purpose.
14 I HEREBY CERTIFY that the foregoing Ordinance was duly adopted by
15 the Mayor and Common Council of the City of San Bernardino at an adjourned
