I 1 ORDINANCE NO.;? 7J 5 , 2 3 AN ORDINANCE CALLING A SPECIAL ELECTION TO BE HElJJ IN THE CITY OF SAN BERNARDINO ON TUESDAY, THE 7th DAY OF JUNE, 1966, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED ELECTORS OF SAID CITY FOR THEIR APPROVAL OR DISAPPROVAL, THREE PROPOSED CHARTER AMENDMENTS TO THE CHARTER OF THE CITY OF SAN BERNARDINO RELATING TO INCREASING THE NUMBER OF WARDS AND COUNCILMEN FROM FIVE TO SEVEN AND PROVIDING FOR OTHER PROCEDURAL CHANGES; PERTAINING TO A FOUR YEAR TERM FOR THE MAYOR, AND PERTAINING TO THE APPOINTMENT OF THE CHIEF OF POLICE. WHEREAS, the Mayor and Common Council of the City of San Bernardino desire to call a special municipal election for the purpose of submitting the hereinafter set forth three proposed Charter Amendments to the qualified electors of the City of San Bernardino for their approval or disapproval; NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: SECTION ONE: That a special municipal election be and the same is hereby called and will be held in the City of San Bernardino on Tuesd~y, the 7th day of June, 1966, for the purpose of submitting to the qualified electors of said City for their approval or disapproval, those certain 17 proposed Charter Amendments as proposed and submitted by the Mayor and Common 18 19 i I 201 Council by Resolution No. 8100, Resolution No. 8101 and Resolution No. 8102, which said Resolutions were duly and regularly passed and approved by the Mayor and Common Council. 21 SECTION TWO: That said proposed Charter Amendments shall be voted 22 upon at said election in the form of three propositions as follows: 23 "Proposed Charter Amendment No.1: Shall Article I, Section 3; 241 Article II, Sections 10, 13 and 14; Article III, Sections 30 and 31; Article 251 VIII, section 136; Article IX, Section 160; Article XII-A, Sections 215 and 26 219 of the Charter of the City of San Bernardino be amended; and Article IV, 27 Section 53 of the Charter of said City be repealed as set forth in City 28 Resolution No. 8100, increasing the number of wards and councilmen from five 29 to seven; making certain legislative, election, ward and procedural changes; 30' and validating election procedures commenced after ratification by the 31 electorate?" 32 . "Proposed Charter Amendment No.2: Shall Section l2-A be added 'I ! 1 to Article II of the Charter of the City of San Bernardino as set forth in 2 City Resolution No. 8101, providing that the term of office of the Mayor shall 3 be for four years?" 4\ 51 I i 6', , 71 81 1 9 "Proposed Charter Amendment No.3: Shall Article X, Section 182 of the Charter of the City of San Bernardino be amended as set forth in City Resolution No. 8102, eliminating the necessity for the appointment of a Chief of Police in May of each odd-numbered year?" SECTION THRE: Said election and the voting thereat shall be by ballot. Said ballots shall be prepared, printed and distributed as prescribed 10 by law. Each ballot used at said election shall have printed thereon in 11 addition to any other matter required by law, the following: 12 MEASURES SUBMITTED TO 131 VOTE OF THE VOTERS 14' 15 161 I , 171 18' PROPOSED CHARTER AMENDMENT NO.1: Shall Article I, Section 3; Article II, Sections 10, 13 and 14; Article III, Sections 30 and 31; Article VIII, Section 136; Article IX, Section 160; Article XII-A, Sections 215 and 219 of the Charter of the City of San Bernardino be amended; and Article IV, Section 53 of the Charter of said City be repealed as set forth in City Resolution No. 8100, increasing the number of wards and councilmen from five to seven; making certain legislative, election, ward and procedural changes; and validating election procedures commenced after ratification by the electorate? NO YES i 19 20 21 22 PROPOSED CHARTER AMENDMENT NO.2: Shall Section l2-A be added 1 to Article II of the Charter of the City of San Bernardino as 23' set forth in City Resolution No. 8101, providing that the term of office of the Mayor shall be for four years? NO 29 30 SECTION FOUR: Any qualified elector may vote at said election in 31 favor or proposed Charter Amendment No. 1 by stamping an X on his ballot, in 32 ehe square at the right of the word "YES" following the proposed amendment to - 2 - 11 be voted upon; and any qualified elector may vote at said election against said 2 proposed amendment by stamping an X on his ballot in the square at the right 3 of the word "NO" following said proposed amendment to be voted upon. Any 4 qualified elector may vote at said election in favor of proposed Charter , 51 Amendment No. 2 by stamping an X on his ballot in the square at the right of 61 the word "YES" following the proposed amendment to be voted upon; and any 7', I 81 9! 101 I Hi qualified elector may vote at said election against said proposed amendment by stamping an X on his ballot in the square at the right of the word "NO" following said proposed amendment to be voted upon. Any qualified elector may vote at said election in favor of proposed Charter Amendment No. 3 by stamping an X on his ballot in the square at the right of the word "YES" I 12! following the proposed amendment to be voted upon; and any qualified elector 131 I , , 14! may vote at said election against said proposed amendment by stamping an X on his ballot in the square at the right of the word "NO" following said 15 proposed amendment to be voted upon. 16 SECTION FIVE: That said special municipal election be and the 17 same is hereby consolidated with the direct primary election to be held on 181 Tuesday, the 7th day of June, 1966, and the election precincts, polling places, I 19' voting booths and election officers for said election shall be the same 20 election precincts, polling places, voting booths and election officers for 21 this special municipal election; and the proposed amendments hereinabove 22 submitted shall be printed upon the same ballot used in said direct primary 23 election. 24! SECTION SIX: That within the time prescribed by the State 25, Constitution, said entire proposed amendments shall be published once in 26 the San Bernardino Evening Telegram, being a newspaper of general circulation, 27 printed, published and circulated in said City. In addition, and pursuant to 28 the provisions of said State Constutition, copies of said proposed Charter 29 Amendments shall be printed in pamphlet form, and mailed to each of the 30 qualified'eiectors of said City, and a notice shall be published in the 31 aforesaid newspaper as required by said Constitution to the effect that 32 additional copies of said proposed Charter Amendments may be obtained from - 3 - II 1 the City Clerk upon application thereof. 2 3 SECTION SEVEN: The passage of this Ordinance is an emergency matter, and said Ordinance shall be in force and take effect immediately after I its passage and app~oval.
