THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORMIN AS FOLLOWS: SECTION ONE: .Ordinance No. 763 Section Forty Subsection (g) is hereby amended to read as follows: "(g) (1) Each person, firm, corporation or association operating, conducting or carrying on any public dance hall, dancing club, dine and dance club or night club, under the pro- visions of this ordinance shall employ, at his or its awn expense, a man to be designated as a "Special Officer", who shall be in attendance at all times that dancing is allowed. permitted or 60nducted at the establishment for which the license is issued Said "Special Officer" shall keep the peace at such dances and shall enforce all laws applicable thereto, and shall. upon re- quest of the Chief of Police of the City of San Bernardino, make a written report to the Chief of Police respecting any incident or disturbance at said establishment. The employment of the "Special Officer" shall be subject to the approval of 22 the Chief of Police of said city. who shall require the furnish- 23 ing of the person's name and address. his previous felony and 24 misdemeanor convictions and any additional relevant information. 25 (2) Every person, firm. corporation or association 26 so operating. conducting or carrying on any public dance club. 27 dancing club. dine and dance club or night club shall similarly 28 employ a woman to be designated as a ''Matron''. The person so 29 30 .31 32 designated shall be subj ect to the approval of the Chief of POlice. who shall require the furnishing of the person v s name and address, her previous felony and misdemeanor convictions. -and any additional relevant information. It shall be the duty II 1 of said "Matron" to generally assist the "Special Officer" in 2 the performance of his duties, and to report to him any viola- 3 tions of laws that she may observe, and any acts or conduct 4 contrary to public health, peace or morals. 5 (3) The approval of the Chief of Police of the 6 employment of a "Special Officer" and ''Matron'' is not an approval 7 of his or her qualifications to serve in such capacity and in 8 no way implies any assumption of liability of the part of the 9 City of San Bernardino for his or her acts or failure to act. 10 The sole purpose for requiring approval by the Chief of Police 11 is to insure compliance by the licensee with this ordinance. 12 13 14 15, 16i , 17i 18i 1 19! 1 j 20' i 21i 22 23 24' 25 26 27 28 29 30 31 32, (4) A "Special Officer" or ''Matron'' shall not be permitted to wear an official police uniform, badge or insignia or any uniform, badge or insignia that may be mistaken for, or confounded with, such official police uniform, badge or insignia. A "Special Officer" or ''Matron'' shall not carry or have in his possession a firearm except when required by the Rules and Regulations of the Police Department. (5) In any case where the Chief of Police of said City shall find that the preservation of public peace, health or morals does not require the attendance of a "Special Officer" and ''Matron'' in any public dancing hall, dancing club, dine and dance club or night club, as the same is defined in this ordi- nance, where no alcoholic beverages are sold or permitted or allowed to be consumed on the premises, he is, in the exercise of his discretion, authorized to waive the requirement for the attendance of a "Special Officer" and ''Matron''; provided that if, at any time after such a waiver has been made, the Chief of Police determines that the public peace, health or morals require the attendance of a "Special Officer" and ''Matron'', he shall so notify such licensee of such establishment in writ- ing and thereafter a "Special Officer" and ''Matron'' shall be -2- 22 The 23 JJ day of 24 25 26 27 28 10 11, I 12: , I I 13' 141 I 151 16! 171 181 I ! 19 20 21 29 30 31 32 II I I I 1 required to be in attendance in accordance with the provisions 2 of this ordinance; and, provided further, that in no case where 3 such establishment either sells, or permits or allows the con- 4 sumption of, alcoholic beverages on the premises, shall the 5' Chief of Police waive the provisions of this ordinance requiring 6 the attendance of a "Special Officer" and "Matron". 7 8 9 (6) The Chief of Police of said city may require, in special instances when law enforcement problems may be reasonably anticipated, that the "Special Officer" and ''Matron.' be a person with previous law enforcement experience."
