HomeMy WebLinkAbout2760 6i 7 I 8! ! , 9i I I 10' i , , 11i i 12] 13i I 141 , I 15j 16i i , 171 18i I 19' 20 21 22 23 24 25 26 I 1 NOTICE OF ELECTION ORDINANCE NO. ,~'16 (/ / 2 AN ORDINANCE OF THE CITY OF SAN BERNARDINO CALLING A SPECIAL ELECTION TO BE HELD ON THE TWENTIETH DAY OF SEPTEMBER, 1966, PERTAINING TO THE ANNEXATION OF A DISTRICT CALLED: 31 4, I , 5: , I "ANNEXATION DISTRICT NO. 182" WHEREAS, by Resolution, the Mayor and Common Council of the City of San Bernardino declared its intention to call a special election to be held in certain inhabited territory contiguous to said City proposed to be annexed to said City for the purpose of submitting to the qualified electors residing in said territory the question whether or not said territory shall be annexed to said City; and WHEREAS, a copy of said Resolution was published as required by law; and WHEREAS, at a time not later than the hour set by said Resolution for hearing objections to the proposed election, no written protests were made by the owners of one-half of the value of the territory proposed to be annexed as shown by the last equalized assessment roll of the property within the territory proposed to be annexed; and WHEREAS, thereafter on the 18th day of July, 1966, Resolution No.8264 was adopted by the Mayor and Common Council declaring that a majority protest has not been presented; and WHEREAS, all proceedings have been had in accordance with said Resolutions, and the Annexation Act of 1913, reference thereto hereby being made for further particulars. NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: 27 the 20th day of September, 1966, in the territory hereinafter described SECTION ONE: A special election hereby is called, to be held on 28 and proposed to be annexed to the City of San Bernardino, for the purpose of 29 submitting to the qualified electors residing in said territory the question 30 whether or not such territory shall be annexed to, incorporated in and made 31 a part of said City of San Bernardino, and whether or not the property in 32: ~aid territory shall, after such annexation, be subject to taxation equally / 10 11 12 13 14 15, I 16' 171 18' I 19: I I 20 21 " 22 I 23' 24 25 26 27 28 29 30 31 32 1 with the property within the City of San Bernardino to pay the entire bonded 2 indebtedness of the City of San Bernardino outstanding at the date of the 3 first publication of the notice of election for annexation. 4, 51 Said territory is described as follows: Those portions of Sections 19, 29 and 32, Township 1 North, Range 3 West, San Bernardino Meridian and that portion of Blocks 16 and 17, West Highlands as per plat thereof recorded in Book 5 of Maps, page 77, records of the County Recorder of San Bernardino County, State of California, described as fo llows : 6 7 8 9 Beginning at a point on the Present Corporate Limits of the City of San Bernardino, said point being the East one-quarter corner of said Section 19; thence leaving said City Limit line, South along the East line of said Section 19, a distance of 2540.00 feet, more or less, to the Southeast corner of said Section 19; thence continuing South along the West line of said Section 29, a distance of 725.00 feet; thence East a distance of 412.5 feet, more or less, to the West line of the property conveyed to W. P. Rowe & Son, a partnership by Deed recorded August 11, 1965, document number 863, in Book 6450, page 366, Official Records of said County; thence North 140 40' West along said West line to the Northwest corner of said Rowe & Son property; thence North 89~ 44' East a distance of 170.01 feet; thence South 730 51' East, a distance of 265.59 feet; thence South 45~ 06' East a distance of 198.70 feet; thence South 340 14' West, a distance of 10.35 feet; thence South 470 16' East, a distance of 219.20 feet; thence Nort~ 780 50' East, a distance of 241. 70 feet; thence North 140 27' 22" East, a distance of 507.00 feet, more or less, to the North line of said Section 29; thence East along said North line to the Northeast corner of the Northwest one-quarter of the Northeast one-quarter of said Section 29; thence South along the East line of the West one-half of the East one- half of said Section 29 and along the centerline of Orange Street, 40.00 feet wide, a distance of 5370.00 feet, more or less, to the centerline of Highland Avenue; thence West along the centerline of said Highland Avenue to its inter- section with the centerline of Central Avenue; thence South along the said centerline of Central Avenue to its inter- section with the centerline of Pacific Street; thence West along the said centerline of Pacific Street to its inter- section with the West line of the East one-half of the West one-half of said Section 32; thence North along said West line of the East one-half of the West one-half of said Section 32 to the said centerline of Highland Avenue; thence West along said centerline of Highland Avenue to its intersection with the centerline of Victoria Avenue; thence North along said centerline of Victoria Avenue to its intersection with the centerline of Lynwood Drive, 82.50 feet wide; thence West along said centerline of Lynwood Drive to a point which is East thereon a distance of 353.52 feet from the Southerly prolongation of the West line of Lot 5, Block 16 of said West Highlands; thence North and parallel with said West line of Lot 5, Block 16, a distance of 41.25 feet to the South line of said Lot 5, Block 16; thence North 080 35' East a distance of 917.78 feet to a point in the North line of Lot 6 of said Block 16, . - 2 - 81 I I 9' I 101 111 , 12! , I 13. ; ; 14' 15 16 17; , 18i 191 20 21 22 231 24 ! Leedom, Jr., et ux, by Deed recorded November 25, 1957 in BOo<<:::4326, page 411, Official Records of said County, a distance of 355.70 feet to the East line of said Lot 5, Block 17; thence East a distance of 33.54 feet to a point in the Northeasterly line of Lot 6 of said Block 17; thence North 00 04' West a distance of 2195.00 feet to a point in the North line of the Southeast one-quartter of said Section 19 which point is West thereon, a distance of 486.00 feet from the Northeast corner of said Southeast one-quarter; said point also being on the City Limit line of said City of San Bernardino; thence East along said North line of the Southeast one-quarter and along said City Limit line a distance of 486.00 feet to the point of beginning. 2 3\ 4 5 6 7 SECTION TWO: TIME OF OPENING AND {:LOSING OF POLLS. The polls at said election shall be opened at 7 b'clock A. M. of the day herein fixed for the holding of said election and shall be kept open until 7 o'clock 1'. M. of the same day, when the polls shall be closed. SECTION THREE: BALLOTS. Upon the ballots to be used at said election there shall be printed the words: SHALL ANNEXATION DISTRICT NO. 182 BE ANNEXED TO, INCORPORATED IN AND MADE A PART OF THE CITY OF SAN BERNARDINO AND THE PROPERTY IN SUCH TERRITORY BE, AFTER SUCH ANNEXATION, SUBJECT TO TAXATION EQUALLY WITH THE PROPERTY WITHIN THE CITY OF SAN BERNARDINO, TO PAY ITS PRO-RATA l'ORTION, BASED UPON ASSESSED VALUATION OF ALL BONDED INDEBTEDNESS OF THE CITY OF SAN BERNARDINO OUTSTANDING AT THE DATE OF THE FIRST PUBLICATION OF THE NOTICE OF ELECTION FOR ANNEXATION? Opposite these words there shall be printed the words "YES" and "NO", and to the right of each of these last two words there shall be a voting square. If an elector shall stamp a cross (+) in the voting square after the printed word "YES", the vote of such elector shall be counted in ~avor of the annexation of said territory to the City of San Bernardino, - 3 - 6[ 7! 81 91 ! , 101 111 ! , 121 131 , 141 1 15 1 I I 1 and if an elector shall stamp a cross (+) in the voting square after the 2 printed word "NO", the vote of such elector shall be counted against such 3 annexat ion~ 4! In all particulars not herein recited, said election shall be held 1 51 , , in conformity as near as may be with the laws of the State of California concerning general elections, and with said Annexation Act of 1913. SECTION FOUR: For purpose of said election there hereby is established in the territory described herein one (1) consolidated voting precinct which shall include all of said territory. Lentz Patton State Hospital 21 SECTION FIVE: This Ordinance shall take effect upon its 22 publication. 23 SECTION SIX: The City Clerk shall certify to the passage and 24 adoption of this Ordinance by the Common Council of the City of San Bernardino 25 and shall cause the same to be published three consecutive days, exclusive 26 of holidays, in the San Bernardino Evening Telegram, a daily newspaper of 27 general circulation printed and published within the City of San Bernardino, 28 and once a week for four (4) weeks prior to the date of the election in the 29 Highland Messenget, a newspaper of general circulation printed and published 30 outside of the City of San Bernardino but in the County of San Bernardino, 31 California, which said Ordinance shall be preceded by the words '~otice of 32 E'lection", and that due publication of this Ordinance as herein provided is - 4 - 9 10' 111 I 121 I , 131 I I 14' 15i 161 17: , 181 , 191 201 , 211 22" 23 24 ' 25 26 27 28 29 30, 31 32 " " 1 hereby determined to be sufficient notice of said election and the only 2 3 notice that shall be required to be given.
